(7:00 p.mi) Margaret Tucker ET AL, part of Government Lot 1,’Section 2 of Clitherall Township by West-Battle Lake, requested a variance to subdivide an existing 2.62 acre parcel into two lots. Each lot would iiiave 100’ of width. One of the proposed lots would have 59,300 square feet of area and the other lot would have 55,000'square feet of area. The minimum size for metes and bounds parcels in the shoreland area is 5 acres. The mihimum size for platted lots on a . ■ ■ general development lake is 100’ of water frontage, 100’ of width at the building setback and 20,000 square feet of area. Also, requesting a variance to leave an existing shed less than 10’ from the proposed lot line. Alice Hofstad , represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. A letter from Bob and Becky Cox in opposition to the variance as requested was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and carried with Rod Boyer voting no, to approve the proposed subdivision as requested with the conditions that a' registered surveyor’s drawing must be provided and all structures must be placed at least 10’ from the lot line when the proposed subdivision is officially recorded. Discussion of the Magnotto Application - (7:10 p.m.); The following is from the April 14, 2011 Board of Adjustment Meeting- Andrew & Leanne Magnotto - Approved the application as requested with a condition. (8:26 p.m.) Andrew and Leanne Magnotto, Lots 51 and 52 Block 1 of Crystal Beach. West McDonald Lake in Dora Township, requested the following; Requesting to replace the roof on the existing 20’ by 28’ structure. The proposed replacement will be in the same footprint. The existing pitch of the roof is 6:12 and will be.replaced by a 12:12 pitch roof. Requesting to replace existing 16’ by 10’ deck, which is currently 36’ frbmithe ordinary high water level and , other impervious surfaces on property with a new 14’ by 16’ covered deck approximateiy 48’ from the ordinary high - water level. Replacement would decrease the impervious surface from 13.7% to 12.8%. The proposed replacement project will be approximately 48’ back from the ordinary high water levei on West McDonald Lake and 35’ back from ordinary high water levei on Brown Lake. Requesting a 52’ setback variance from the ordinary high water ievel-;on West McDonaid and 165’ setback variance from ordinary high water level on Brown Lake. The current structure is approximately 8’ from the alley. Proposed project will not change location. Current shed is'approximateiy 3’ from the alley, 23’ from Brown Lake and 75’ from West McDonald Lake. Proposing to replace roof on existing structure. Requesting setback variance of 177’ from Brown Lake and 25’ variance from VVest McDonald. Location of shed will not be changed. Shed is 10’ from holding tank. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer, and unanimously carried, to approve the variance as requested and as depicted on the drawing submitted with the application with the condition that no portion of the proposed development can be within 50’ of West McDonald Lake. It was also noted that the variances as approved do not directly or indirectly grant any other variances than.those outlined in the request. Hardship/practical difficuity is substandard iots of record and iakes on two sides of the property. At the May 5, 2011 Board of Adjustment Meeting- Mark Running, Land and Resource Department, reported that the measurements presented at the Aprii-j14^-2011 meeting were not accurate and a site inspection indicated additional concerns with the location of the hoiding tank and the proposed development. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and carried with Rod Boyer abstaining, to approve the variances necessary to repiace the roof on the ■ existing. 20’ by 28’ structure as described in the variance application and to deny all other variances as requested for ' the other deveiopment/improvements noted in the variance application. As was pointed out to me by that office, the boat shed--#2 on the drawing—is quite close to the proposed property line. Actually, the shed is on the property line. We can handle that in two ways. Number 1, our preferred way, is to leave it where it is, and move it only if it is an issue with a purchaser of lot B. Number 2, if you cannot approve that variance, we will move the shed at least 10 feet from the proposed property line and in compliance with all ordinances. Property Address: 39359 Little Mo Road Dear Mr. Stein: We are writing in opposition to the variance requested by Ms. Tucker to split her 200’ lot into two 100’ lots. We are the owners of the property directly to the west of the subject property; our property address is 39341 Little Mo Road. We purchased our property in August of 2008, with the intention of demolishing the' existing seasonal cabin and building a year-round house. This property arid this shoreline appealed to us because it is not crowded or over-developed like the shoreliries on so many other lakes. When we bought our lot, we assumed that the surrounding lots and the shoreline would remain as they currently are, especially given the fact that these lots have had existing cabins on them for many years. We did not anticipate that an additional house would be built between our property and Ms. Tucker’s cabiri. Giveri that her lot has been a 200’ lot since this shoreline was initially developed, we did not imagine that she would be allowed to split it jn.two. ■ : ;• The west 100’ of the subject property is completely wooded with ho current access to the road or the lake. Developing it will undoubtedly affect the shoreline. Many shoreline boards and shoreline owners are strongly against additional development on the shorelines of their lakes due to environmental, water quality and aesthetic concerris.
