A Conditional Use Permit Application (as stated by the Applicant on the Application): Proposed CIC
“Lakes n Woods Storage LLC” is proposing a 33-unit storage development - residential and
commercial uses are strictly prohibited. The units will be privately owned, and the roads will
be privately maintained. This application is for the site grading and construction of storage
units and the privately owned driveways to access the storage units. There will be no outdoor
storage. The proposal is located South of 39523 Coleman Trail, Section 2 of Clitherall
Township: West Battle Lake (56-239), General Development (GD).
Aaron Anderson and Matt Hoen represented the Application.
Mel T. Tucker expressed concerns on commercial use, have time to speak to legal counsel &
the lack time of notice. Wayne Johnson expressed concerns on the location, type of proposed
units and the elevation (run-off). Laurie Bassett expressed concerns that this use is industrial
/ commercial. Peggy Feagins expressed concerns on the road, run-off, lighting and the use
not fitting-in this location. Steve Wagner expressed concerns on the number of units. Ann
Rasmusson expressed concerns with run-off; asked where Harms Farms is located and who
enforces the stipulations.
All correspondence has been forwarded to the Planning Commission for their review.
Motion: A motion by Wass, second by Trites to accept the request of the Applicant to table
the application to the August 12, 2020 Meeting and allow the applicant the opportunity to: 1.
Address density and compatibility with the residential area. 2. Address the timeframe and
phasing of the development. 3. Address meeting of the road authority’s requirements for the
access road. 4. Clarify Clitherall Township’s Ordinance and its prohibition of this use. 5.
Address issues stated in the multiple communications, such as lighting, run-off, safety &
enforcement of covenants (rules). Roll Call Vote: All Members in favor, except Frazier.
Adjourn: At 8:37 P.M., Motion by Gabe, second by Frazier to adjourn the Meeting. Roll Call
Vote: All Members in favor. The next Meeting will be held via Go To Meeting and is scheduled
for 6:30 P.M. on July 8, 2020.

Meeting of the Otter Tail County Planning Commission was held on August 12, 2020 at 6:30
P.M.; the hearing was held via Go To Meeting due to the health pandemic and declared
emergency in accordance with Minn. Stat. Sec. 13D.021.
Roll Call:
Members Present: Rod Boyer, Judd Fischer, Brent E. Frazier, Richard Gabe, Jack Rosenthal,
Bruce Stone, David Trites, David Wass and Rick Wilson.
Members Absent: None.
Michelle Eldien represented the County Attorney's Office and Chis LeClair represented the Land
& Resource Management Office.

I did take a peek at it yesterday, Amy forwarded it for my review and my comment was to include language confirming
the request is a CIC. This CIC is not proposing a commercial use, they will be privately owned. The impervious surface
on the plan I looked at yesterday was "good". I'm not aware of the SMO addressing density for a CIC / Storage Unit
request? Amy has been working with him and contacted me a couple times. There has been quite a few of these

Dear Mr. Wilson:
We are writing in regard to the conditional use permit request for storage units that are to be built west
of Coleman Trail, off of Little Mo Road and Trail. The survey attached to the application indicates that
these storage buildings (33 total) would be built on both sides of Little Mo Road.
We have concerns about this development. This area has been zoned agriculture for decades and is a
habitat for wildlife and many birds. Bee keepers at one time brought in hives because of the buckwheat
planted on these acres.
Little Mo Road and Trail are not on a township road. We have had to do the maintenance of this road,
to include private plowing, mowing the grass on the sides, and adding and grading gravel as needed over
the years. This road is not wide enough for cars to meet without driving onto the shoulder. This has not
been an issue because of the few cars using this road. This would not be the case if 33 storage units
were built. We would want the developer to construct the entire Little Mo Road to township standards
so that the township would assume maintenance and snow plowing of this road.
We have great concerns about the size of these units. The site plan specifies that the units are 38 feet by
58 feet which is over 2,200 square feet. That is a fairly big house, let alone a storage unit. We are also
concerned that there would be 33 separate units rather than five buildings with the units integrated into
the building. The application states that construction would be done as they are sold. So this
construction could go on for years? We would like to see a time limit on the construction of these units.
There is no mention of what the exterior of these buildings would look like as far as colors and materials
used. They also stated in the application that said no outside storage would be allowed. Who would
monitor that when they are privately owned? We can see lumber, trailers, barrels, all kinds of things
left outside between the buildings.
How will this development be lit? We do not care to have lights on all night. Will people be able to
access this storage unit at all hours of the night? Our enjoyment of Battle Lake includes watching the
stunning sunsets and looking for northern lights. I do not think storage lighting will enhance this quality
of living.
We have seen a significant raise in our property taxes. Part of that is a result of development of the
Coleman Estates. As our property values increase, we can ask, "do 33 storage units in our back yards
increase the value of our homes?". We think not. We preferred the buckwheat and blue bird houses.
We would ask that you give due consideration to our concerns and deny this conditional use permit for
these storage units. Certainly a more appropriate location could be found in the township.

Dear Planning Commission and Land Management Dept.,
We own property along the proposed development and a lake lot and cabin along Little Mo Trail. We would like to
express concerns with the proposed development. We don't feel the Planning Commission is justified in recommending
approval of the permit application as written. The reasons are described below and in the attachment. We suggest
denying the application as proposed. We do suggest alternatives or modifications to the project.
The original Notice of Public Hearing states the project will be "Located to the South of 39523 Coleman Trail, Battle Lake
MN". This was misleading at best, if not deceitful. Just three of the 33 proposed buildings are south of Coleman Trail. I
may not have commented on the project based on the project location listed on the application and was surprised to
learn of the actual proposed locations.
The preliminary plat drawing in the Development Data, Roads: States "Existing roads will be utilized" (Coleman Road and
Little Mo Road). It appears that Coleman Road is not utilized at all and 100% of the use will be on Little Mo Road. This
again appears to mislead.
^1 don't see a definition in the Shoreland Management Ordinance (Ordinance) related to the proposed CIC, which I
assume is 'Common Interest Community'. Because the proposed development is nearly 100 percent within the 1000
foot from West Battle Lake line, I assume specifics of the ordinance shall be adhered to and while there is no specific
- mention of CIC, similar items listed will be used to understand the Purpose and Intent or Spirit of the Ordinance.
In Ordinance Definition 18 Commercial Use: It appeai^that buildings sold for storage suggests a commercial use and
Definition 60 defines a Planned Unit Development (PUD) that I use as a guide for the CIC for this discussion.
Concerns:
The size of the buildings, their close proximity to each other, along with access roads will create a large impervious layer.
To put things in perspective, the footprint of one of the units, is about the size of one of those old fashion red dairy
barns that dotted the landscape in the past. The proposal is for 33 barn footprints with 10 feet of space between each
building. Heavy rainfall on the roofs from adjacent buildings will have a 10-foot alley way to drain away from the
buildings. The developers recognize the issue and propose constructing a berm along our property line. We consider a
berm part of the construction and do not want it located inside the setback. It appears that this will direct the water that
has no time to naturally infiltrate, and would potential flood Little Mo Road and Little Mo Trail or lots to the north.
To put the footprint of the proposed buildings in perspective, I overlaid the area of the proposed (buildings only) on the
footprint of the Walmart in Fergus Falls. The footprint of the proposed buildings is slightly over 'A the footprint of the
local Walmart.

Close proximity of buildings creates a concern that an industrial/commercial look will result. I hope that considering the
aesthetics of a project is included in the spirt of the Ordinance.
As written, the proposal does not satisfy the Ordinance #8, Stormwater Management. 8.B.l. states that impervious
surface coverage must not exceed 25% of the lot area. And 8.B.4. states the Surface area of a lot physically separated
(i.e. public, private road right-of-way or easement) from itself or another, cannot be included for purposes of the
impervious surface calculations. In other words, the area west of Little Mo Road requires a separate calculation of
impervious surface area.
Considering the area west of Little Mo Road is approximately 2.7 acres and the development proposes 13 units, the
proposal is not compliant with the Ordinance.

If the same area was proposed for non-riparian Single-Family Residential lots, the area would only accommodate 2 lots
at 40,000 sq. ft. each. Is placing 13 buildings in that small space with the idea that it's ok because this is a CEC in the
spirit of the Ordinance?
If we compare the CEC to the closest definition in the Ordinance, we look to the Planned Unit Development for
guidance. The PUD requires at least 50% of the total project area must be preserved as open space. Considering the
impervious area created gives rise to compliance and runoff issues, and the spirit of the Ordinance (i.e. open space), the
units west of Little Mo Road should be drastically reduced or be eliminated altogether. Also, this area is likely an aquifer
recharge area for existing homes and cabins in the area and the impervious layer may prevent aquifer recharge.
Alternatives?
What are the alternatives to the proposal?
1. Do not construct the project. OR
2. In the spirit of the Ordinance, move the proposed building sites outside the 1000' setback line. Move to a
location south of Coleman Trail (as stated in the application) that utilizes Coleman Road for access (also as
stated in the application).
- The rough sketch below shows there is room for 18-20 units on the proposed parcel.
- Suggest phasing in the project with separate permit applications. If the first phase (~ 20 units) goes
well, the Planning Commission could consider another CUP within the Shoreland Management Zone at a
later date.

Additional Questions and Concerns

Little Mo Road and Little Mo Trail have not been built to County orTow/nship specifications. Taxpayers that
utilize these roads pay all maintenance and improvement cost on these roads
o Coleman Road and Coleman Trail are built to specifications and are more suited for the additional traffic
that this new development will bring
Building units over time will result in an extended construction time.
Many construction details are missing and need to be defined. What is the sidewall height, siding type, windows
or no windows, on concrete? Pole building or stick built or other? Insulated or not? etc.
What will ensure a consistent look to these buildings that will be constructed over an extended period of time?
Who will "police" the requirement "absolutely no residence" or "absolutely no commercial use"?
Who will police the requirement of not storing items outside the buildings or on the driveways?
In drawings, a 10-foot wide driveway is shown. A building of this size is likely going to demand a 16 ft wide door
and a wider driveway (and greater impervious area).
Summary
We respectfully request
1. The Planning Commission Not recommend approval of the proposed development as currently proposed.
2. A new proposal be requested that adheres to the Shoreland Management Ordinance by:
a. Maximizing the use of space on the property outside the 1000-foot line from West Battle Lake.
b. Utilizing the existing roads that have been constructed to township specifications and can handle the
additional traffic.
c. Meets the impervious area requirements to protect surface and subsurface waters and considers open
space requirements in the spirit of the Shoreland Management Ordinance.

My name is Wayne Johnson. I reside at 39361 Little Mo Rd, Clitherall, MN.
The proposed plot has immediate impact on my residence location. In part of my reason for living at this
location was the family oriented residential neighborhood, lake, privacy and satisfaction I am away from
commercial business. This plot changes things.
Revising the zone from agriculture to commercial (or a conditional use permit) is a big change and removes
control of how land use is established. I am confident there is other land in and/or near the city of Battle lake
available for such a development that is for commercial use.
Selection of this property for the defined storage unit development / utilization for reason the cost to acquire
property zoned agricultural and then subsequently getting a conditional use permit is less than property
zoned commercial is not good reason. The narrative of the land use by zone definition is forever changed and
homeowner protection of property land use is diminished or taken away.
Discussion
1. Agriculture to Commercial (Or Conditional use Permit)
This plot must define an ordinance that specifically states the land use utilization can ONLY be for
'Personal' storage units. No business function is to occur in the units. NO Exceptions. Enforcement is a must.
Technically this proposal is a business venture.
2. Access.
The plot identifies retaining the easement defined as Little Mo Rd (North - South off of Hwy 210 trunk)
. Currently we (property owners) along Little Mo Rd and Little Mo Trail use the subject road for access to our
property and residences. We landowners currently pay all expenses for maintenance and access associated
with the easement. The proposed development will result in significant increased utilization of the road and
thus increased maintenance and associated costs.
For reason the proposal will increase road utilization, I propose the road be constructed to township
specifications and be turned over to the township delegation. The owner of the storage unit development is
responsible party for construction expense. This change protects all homeowners from increased costs related
to increased utilization, retains required access to our household and increases confidence the road is
properly and correctly maintained in timely matter. Additionally, a township road will prevent any
obstructions that will result in increased traffic on the current road specification and ensure access remains
unrestricted to all landowners that currently use the road.
3. Buildings
The plot identifies quantity 33 individual units. I understand owners of the units are to build to personal
specification with provision they do not exceed the defined dimension maximum of 36 x 56. The plot does
NOT specify a maximum height limit. This must be defined, established and enforced.
Item of concern: The square footage of each building is relatively huge. Because of the size, it is anticipated
and expected properly owners of each unit will share space to store personal items (boats, cars, trailers, etc).
This sharing will result in increased traffic of which has an immediate impact to road utilization , maintenance,
access. The increase may impede and obstruct property owner access each residence. (See Item 2 for proposal
to construct road to township specification). At minimum the existing easement road is NOT sufficient for
increased traffic flow due to a business consideration sharing residential access and must be designed
accordingly.
Unit construction type and design

The proposal does not define required material type, color limitations or type design. Until there are
ordinances that define and enforce the, the units have zero limits on construction material type or color. This
must be defined and agreed upon with neighboring property owners. It will NOT be acceptable to have units
that are not aesthetically appealing. There must be codes for construction design, material selection, height
limitations.
Due to close proximity of building to building locations - Are there any concern for Fire safety and fire safety to
residential properties adjacent to the site?
Outdoor storage
The proposal identifies there will be NO outdoor storage. The proposal must define on how this is to be
enforced. I recommend an ordinance be on record providing local authority enforcement opportunity.
Hours of Utilization.
The proposal encourages owners access their unit during normal daylight business hours. This is NOT
acceptable. Restrictions of time must be defined, documented and enforced. The integrity of a family oriented
residential neighborhood need be retained. Encouragement must be revised to defined the hours of permitted
access (with probable case by case exception).
Additionally, it is expected that no person (or persons) may establish overnight occupancy. The storage units
need be classified storage units and personal occupancy is not permitted and unlawful. NO
Exceptions. Enforcement of compliance is required and mandatory.
Exterior lighting - the proposal identifies there is to be only motion sensor lighting AND shall only be installed
over the entrance of each unit. Light pollution is an immediate priority, concern and is NOT acceptable. An
ordinance should be on file to limit and control lighting. All lights shall be restricted to be lower than the gable
height and shall be positioned to display a beam path immediate down. No lights shall project a beam up.
No light shall be positioned to display a beam path that interferes with residential properties to the north.
Building Entrance:
No building bordering the North property shall have entrance (service door or access ) adjacent to the north
property line. All building entrance shall be designated to the area immediately adjacent / adjoining the
proposed drive for each unit.
Unit Construction Timeline:
An open timeline for construction of units (Units will be built when sold) is NOT acceptable. Construction
traffic, increased noise pollution, light pollution will be experienced for many lengths of time.
If units are to be built when sold, the proposal shall include an ordinance that requires a window of time when
the construction is initiated and completion date.
Additionally, this private construction concept leaves many undesirable options of building appearance with
lost control of required building aesthetics and coded requirements. Building specification codes must be
defined and enforced (see Unit Construction Type and Design above).
4.Site setback
The plot defines a 5G ft setback from property lines. This must be enforced from the edge of the 'Pad' for the
building.
5. Site elevation / Water shed

Per the proposed survey, the pad sites are to be constructed to elevations 1380,1381,1382,1383,
1385 pending location. The topic elevation of neighboring residential properties located to the north are at
1375 and decline as distances proceed north to the lake. Water runoff to neighboring residential properties
and eventually into the lake is not acceptable and will not be permitted and shall be considered unlawful.
It is understood the proposed swales are constructed to promote water flow to the designated water
retention areas. The proposed swales have zero definition of height and width requirements. An insufficient
swale by design or failure results in failed watershed design that has immediate and adverse consequences to
residential property owners. Property devaluation is an immediate concern. The proposal shall define swale
requirements (height, width, earth design, landscape, etc.) This is a must know.
The proposal shows no analysis of water runoff. An analysis must prove the site water runoff (including
volume and rate of flow) accurately sheds water to the designated water retention areas AND 'zero' water is
shed to the residential properties. The analysis must conclude a fail- safe design. Meaning if the swale is not
functioning as designed, corrective action must be immediately implemented to correct thus preventing
undue hardship (including but not limited to property damage) to neighboring property owners.
Water runoff for sites 14,15,16
Sites 14,15,15 are a high density concentration of impervious ground. The overall calculation of impervious
ground for the entire proposal has flaw relative to the 'localized' area f concern.
Logic, reason, and analysis of constructed lots 14,15,16 is suspect. The water runoff from the concentrated
density of the impervious ground in the immediate local area will result in a significant amount of water with
significant high flow rate. This high flow rate can exceed the localized small water retention area capacity
located in the existing wooded area adjacent south of the bend in Little Mo Trail. Overflow to the properties
will result. Additionally, it is 'assumed' the direction of water flow will enter the 'defined' water retention area
and not impede on neighboring properties.
Lots 14', 15,16 need be removed from authorized build.
6.Maintenance of property
The proposal must include a plan of action for property maintenance (including upkeep of the private units)
and responsible party delegation. Non-compliance penalty must be defined and enforced.
Maintenance is required on every development / building/ terrain. Maintenance must be completed on the
parcel.
The proposal shall include required ordinances to be enforced by township delegation for maintenance and
improvements. The proposal must include definition of penalty and consequence if in non-compliance.
Trees- the plot defines planting of trees. There must be definition of tree maintenance; Should a tree die,
replacements must be immediately provisioned.
General
Who by definition is responsible and accountable for all actions in the development?
Is it 'presumed' there is an HOA (or equivalent) for maintenance, and upkeep?
Adjacent landowners require definition and detail of how all is to be implemented and enforced.
It is imperative all current and future issues remain compliant as promised .

Dear Ms. Bowman:
This firm represents Clitherall Township (“Town”) and the Town asked me to provide a letter to
Otter Tail County (“County”) regarding the Lakes N Wood Storage facility (“Storage Facility”)
proposed to be located within the Town. The point of this letter is to make clear to the County the
Storage Facility is not an allowed use under the Town’s zoning ordinance.
As the County is aware, the Town adopted the Clitherall Township Zoning Ordinance (“Ordinance”)
in 2015. The land on which the Storage Facility is proposed to be located is within the Town’s
Agricultural District. The lists of uses identified as being allowed in that district do not include
storage facilities such as the one being proposed. Therefore, under Section III.C of the Ordinance,
the use is not allowed. 1 have enclosed with this letter the sections of the Ordinance identifying the
uses allowed in the Agricultural District and the section pointing out that only those uses expressly
allowed in a district may occur in that district. I understand the property owner has not applied to the
Town to amend its Ordinance to allow the use and has not sought a substantially similar
determination.

The Minnesota Pollution Control Agency (MPCA) Detroit Lakes office recently received the attached notices of public
hearing for the June 10, 2020 Otter Tail County Planning Commission meeting. MPCA staff has no specific comments on
the three proposed projects, other than to ensure that the Applicants obtain and comply with any necessary State
and/or Federal permits, including the National Pollutant Discharge Elimination System (NPDES)/State Disposal System
(SDS) Construction Stormwater permit, if applicable. Information on the MPCA's Construction Stormwater permitting
program, including who needs to obtain the permit prior to construction, can be found on the MPCA's website at

part of a larger "common plan of development or sale" that covers more than one acre.
Also, an additional note: the draft Otter Tail River Watershed Restoration and Protection Strategies (WRAPS) report
includes the three lakes identified for the three proposed projects: East Silent (56-0517-00), Franklin (56-0759-00), and
West Battle (56-0239-00). Each of these lakes are identified in the draft WRAPS as priority lakes for protection, which
means these lakes are among those that are at a high risk of becoming impaired if they were to receive additional
pollutants like phosphorus. Protection strategies identified in the draft WRAPS report for these lakes include protection
and maintenance of forests and lakeshore, stormwater infiltration on developed properties, and improved upland or

I am writing to express some concerns about this type of business being built in this location.
Runoff. This is an immense project, acres and acres of buildings and driveways. I question whether the
proposed swales would contain the runoff during heavy rains, particularly in the western section which,
I believe, drains to the north.
Lights. Your management ordinance states motion sensor lights will be above each unit's entry. There is
no mention or prohibition of adding other lighting (dusk to dawn). This would definitely be an intrusion
on the surrounding neighborhoods. Please clarify.
Adverse effects on quality of life. People have chosen to live here because of the woods and quiet
country setting, enjoyment of wildlife, starry nights void of city lights, and, yes, fields of buckwheat and
sunflowers. The proposed project would greatly diminish what people came here to find.
Adverse effects on property values. Property values would most certainly be impacted by this
development. I am astounded that the Colemans, after charging enormous prices for these lake lots,
would then turn around and sell to such an enterprise as this which will surely lower those property
values.
Location. Your management ordinance #5 states that because of the close proximity to Hwy 210, "the
project site is ideal for commercial purposes." We beg to differ! Surely Battle Lake, Underwood,
Clitherall and other surrounding towns have in their long-range planning, zoning for such businesses as
this. Let's keep commercial enterprises in the city, and country in the country.
Questions for the Commissioners. Have each of you visited the site of this proposed construction?
Have you acquainted yourselves with the neighborhood in Little MO and the Coleman Estates? Have you
asked yourselves if you would want this project in your back yards?
Who am I? My family has been in this location (39359 Little MO Road) for over sixty years. My father
was one of the first to purchase land in 1956 from John Murdock when he divided some of his farm into
lake lots. My father built a summer cabin there for his family to enjoy—which we certainly have. After
his death, with rising taxes and maintenance issues, his widow and children formed The Tucker Family
Company LLC (1998); its purpose being to share the cost of taxes, maintenance, improvements and use
of the cabin, and to hold the property in trust for future generations of the family. I am currently
president of our little six member company and I can say we are all in agreement that this Land n Lakes
commercial enterprise is inappropriate for this location. We urge that your recommendations to the
County Board of Commissioners will be to deny this permit.

RESPONSE TO CONDITIONAL USE PERMIT APPLICATION REQUEST
Dear Commission Members,
I am Clay Dietrich, the owner of the property located at 39523 Coleman Trail, Clitherall, MN 56524
legally known as Lot 12, Block 1, Coleman Estates. My wife Suzy and I have owned this property since
April of 2017. We have made many improvements over the last three years including a finished storage
and game room structure. We have plans to build our new home this year. We have resided in
Moorhead, MN since 1983 and hope to make this property our residence within two years if plans work
out as currently designed.
I want to share with your commission information of who I am and my work and knowledge as related
to this project.
I own Dietrich Homes, Inc. and have been a licensed contractor within the state of Minnesota since
1992.1 have been in the construction industry since 1975 building residential and commercial
properties. I have developed many multi-family and commercial sites ranging from 5 to 12 acres in size.
These larger properties all require site and building design prior to permitting and I have managed the
team designing these properties.
I have also designed and constructed many lake homes in Otter Tail County including the lakes of West
Battle, Otter Tail, Blanche, Little McDonald, Big McDonald, West Silent, and am currently finishing a
home on Trowbridge Lake by Vergas.
Our company is a full design / build firm that has CAD design, interior design, site design, sub-contractor
management, and construction all under one roof and managed by our employees.
I was also a professional firefighter for the City of Moorhead for 27 years. I served from 1983 until 2009.
I was trained at the National Fire Academy in Emmitsburg, Maryland with an emphasis on Command and
Control of Fire Department Operations and Building Construction for the Fire Service. I was also a
Regional Haz-Mat Director for the MN State Haz-Mat Team covering the NW twenty counties of MN.
This did include Otter Tail County. I retired in 2009 as an Assistant Fire Chief for Moorhead Fire Dept.
I have reviewed the proposed 33-unit storage development as proposed by Lakes n Woods Storage, LLC.
I have also talked with one of the Owner's, Matt Hoen, and expressed my concerns for the project. He
has said that he would be open to suggestions for improving the proposed project. I will attempt to
show the design deficiencies in the proposed project and recommend improvements that would need to
happen to resolve the issues identified. I will also point out the fire hazards that exist with the design
and layout of the structures and talk about the local fire departments abilities to control a multi building
fire.
Drives, driveways, and traffic flow-
The proposed typical units, driveways, and gravel drives are not laid out with enough space to back
trailers into the structures or to even park vehicles in front of the structures on their individual
driveways. The site plan shows 10' wide by 16' deep driveways. This does not meet the minimum 12'
wide driveway that must be included in the impervious surface calculations as per Section IV, Paragraph
8, B5. This also does not meet the definition of a parking stall listed in definitions item 57 that states an
off-street area for motor vehicles not less than 10' by 20' having access to the private drive needs to be
provided. I would suggest the area needed in front of each storage structure to park pickups and back
boats and pontoons into these structures through a 16' wide overhead door will need to be 16' wide by
24' deep to make the swing off of a 20' drive road into these structures. These dimensions will leave a
44' distance from the edge of the drive road to the building. Even at this dimension there may be people
unable to make this transition work without driving on the areas intended to be pervious rendering
them impervious.
The distance from the front of opposing structures to one on the other side of the drive is now 52' on
the site plan. The suggested distances above will require an increase to 68' for the off-street parking and
back in distances to work. This may cause some of the structure to become shorter but is needed to
make the traffic flow functional.
Also, the proposed drives on this site plan do not show turn arounds at the ends or cul-de-sacs for
vehicles to change directions without using a driveway to a structure or backing out. The site needs
better traffic flow incorporated into the design.
Structure Setbacks and Spacing-
The proposed plan shows the required 50' setback to property line and the 20' to road right of ways but
does not take into consideration distance between structures for fire spread and control. The structures
are placed 10' to 12' apart creating a situation where fire can spread from structure to structure from
convection forces alone without wind being taken into consideration. These structures are typically
unprotected wood pole barn structures with truss roof systems covered with steel roof panels and steel
siding. Unprotected wood structures, without sheetrock to protect the roof trusses from fire exposure,
usually have roof failures within 7 minutes of fire impingement on the truss metal gussets. The roof
systems also typically have 2' overhangs which would put the roofs from structure to structure within 6'
to 8' of each other. Fire spread from structure to structure is highly likely even without any wind pushing
the heat.
Our area receives strong winds out of the SE quite often which would push the fire from structure to
structure quickly and could possibly jump the distance from the structures to the trees surrounding the
site. If the fire was to get into the trees it would race through the heavily wooded residential lots to the
north of the storage structures. Many homes and possibly lives could be lost if this scenario were to play
out. The owners of these residential properties may have their escape out of the area blocked by the fire
and would have to abandon vehicles and homes.
Time of response and water supply is a big issue for rural fire departments. These structures are to be
unoccupied privately owned storage structures that are not be used for living purposes. The area will
not have people around to report a fire quickly if it happens at night. The residential homes in the area
are several hundred feet away from the structures and the sight lines are blocked by trees. This will
probably result in the first report of a fire being called in when the fire is coming through the roof
already. This delayed reporting and the normal time of response for the Battle Lake Fire Department
could result in first arriving fire engines not arriving until 20 minutes after the initial start of the fire.
The area is also without a water supply as there is no public water supply and no way to get to the lake
for water drafting operations. The water supply would have to come from tanker trucks and a shuttle
system set up by the surrounding mutual aid fire departments which uses up more precious time. Fire
science has proven that fires double in size every minute and can grow much faster than that if wind is
fueling the fire.
The scenario I have described is hypothetical but extremely likely if a fire was to occur. Building and fire
codes have been developed to protect lives and property. Many areas have codes that define building
spacing to help control fire spread. In this area the code for residential dwellings is 10' from the property,
line which results in a minimum of 20' between structures. Residential dwellings are by state building
code protected structures which means the structural members have to be covered with fire rated
materials which is typically sheetrock. With this being said the fire spread from home to home would be
much slower than the fire spread from proposed storage structure to storage structure.
I would like to see the storage structures be at least 20' apart as the surrounding homes are required to
be. This spacing would also create a fall out zone around each structure. This means if the structure was
to collapse because of fire the walls of the 14' to 16' tall structures would not land against the walls of
the nearby structure causing damage and fire spread. This spacing would also give the firefighters
enough space to create a water curtain wall to protect the next structure from becoming involved in the
fire.
Outside Storage-
The application says there will be no outside storage but does not define what outside storage items
are. I would want to see this defined as no outside storage of any items to also include all vehicles,
trailers, garbage receptacles, portable toilets, and above ground propane tanks. Portable toilets are
permissible during construction but must be removed when construction is complete or there are
lengthy time periods between construction phases. There should be nothing left outside the storage
units when complete.
Landscape Buffers-
The site plan shows landscape buffers along Little Mo Road but there are not buffers along the north
portion of Little Mo or along Highway 210. A 20' wide buffer along these areas, along with the existing
trees remaining, would help screen the structures from all four sides.
Maintenance & Replacement of Landscape-
Trees, shrubs, and other landscape features should be maintained in good condition that presents a
healthy and neat appearance. The maintenance would include mowing of the entire property including
vacant lots, ditches and water retention areas when dry. This should be part of a HOA that each owner
of the storage structures contributes to. The HOA should also manage road and drive maintenance for
the properties including Little Mo Road for their portion. The developer is responsible for managing the
HOA until such time as 80% of the units are sold and a HOA Board is elected.
Signage-
A temporary sign during construction for sale of the properties would be perhnissible. Signage to be
removed within 30 days of the sale of the last property. No permanent signage should be necessary for
privately owned units.
Odors-
There should be no use allowed that would cause odors that could be detected after the air has been
diluted with 4 or more volumes of odor free air within the residential lot areas.
Building Materials-
Structures should have a finished appearance and architectural treatment that is consistent with the
style of the surrounding residential structures. Structures should be compatible with the scale of the
nearby residences. The project should have a consistent style and color pallet acceptable to residential
areas so as not to appear to be a commercial zone.
My suggestion would be for darker earth tone colors that blend with the surroundings and minimize the
size of the structures; I would also suggest two colors of siding with a 3' bottom band and a second color
above. The roofs should be a darker color to not reflect brightly in the sunlight.
Type of Project by Zoning-
I would feel most comfortable with this project being a PUD project with all of the details worked out
prior to construction. I think this type of project being governed by a PUD that has neighborhood input
could alleviate the fears of an existing residential neighborhood, that has a vested interest in keeping the
neighborhood as a great place to live and enjoy with their families. The families that are already here
have invested their heart and soul into making this neighborhood and their homes a valuable part of the
West Battle Lake environment. We all want to ensure the area continues to uphold the high family
values and neighborhood investments that have been made here for generations.

I am writing to speak against the proposed Conditional Use Permit for Lake n Woods Storage, since I
am currently out of town and will not be able to attend the JunelO, 2020 meeting. Please make this
letter part of the official record.
The purpose of zoning regulations is to protect adjoining landowners from devaluation of their property.
It is designed to keep similar uses in the same areas, and to create buffers between different zoning
classes. While I understand that a Conditional Use Permit doesn't technically change the zoning, it has
the same effect.
An industrial use is at the opposite end of the spectrum from our adjacent wooded lakefront property.
To put storage units next to such property would certainly decrease its value.
My grandfather, who was born in Clitherall, built our cabin at 39359 Little MO Rd. hriore than 60 years
ago, and since that time six generations of my family have been coming to these northern woods to
enjoy the peace and tranquility we find here. There are several things about this proposed development
that would detract from our enjoyment of our property.
Lighting is of primary concern. We enjoy the darkness at night, being able to see the stars, and viewing
the occasional aurora borealis. Flood lighting and motion detection lights coming pn and off would
certainly detract.
A variety of wildlife currently makes its home in the fields and woods. Added noise, traffic, people, and
lights would be an encroachment on their natural habitat.
While I understand there would be provisions to handle stormwater runoff, these never quite take care
of it all. There is a high potential for the runoff from units like these to contain contaminates such as
antifreeze, oil, or gasoline. Not everyone who stores boats or other recreational vehicles in these units
will care about the water quality in the lake or in our wells, the latter of which we use for drinking and
bathing.
There are plenty of areas near towns in Ottertail County that are already zoned for industrial use. There
is no need to build storage units in a rural area right next to lakefront properties, some with quite
extravagant homes.
I would ask you to please deny this Conditional Use Permit and let this out-of-town investor find a more
suitable location for storage units.

Dear Mr. Wilson:
I have been a resident living on Little Mo Trail for over 20 years. In that time 1 have seen many changes
to this area. These cabins were owned by descendants of some of the earliest settlers to this area. Over
the years that has changed but all owners had a deep appreciation for the land and the beautiful lakes.
It can be observed in that the land has not been clear cut. The owners loved their little quiet places in
the woods, even as these little places grew larger.
Somehow building huge storage units does not quite fit with this environment. This would just create
more traffic and disturbances at all hours of the day and night.
I live alone but I am not afraid of the dark. I do not need lights shining in my woods at night.
My late husband David spent much time mowing the sides of the road coming into our place. He did it
not because anyone paid him to do it, but because he took pride in our environment. I do not think he
would be proud of storage units.
I would ask that you consider the feelings of the people who call Little Mo their home. The majority of
the homeowners here would agree that this is not the type of development they want. Please vote no
on this permit application to build storage units.

I am writing to voice my objections to the proposed conditional use permit for Lake n Woods Storage.
This property is currently zoned for agricultural use, and is located directly adjacent to several
lakefront homes and cabins, in a wooded setting.
I have been enjoying the cabin that my grandfather built at 39359 Little MO Rd. my whole life, along
with many members of my family. Storage units directly next to our lot will decrease our property's
value, as well as that of many others in the area. I ask the commissioners to consider why it is
necessary or desirable to place an industrial area directly next to residential lakefront property. Surely
there are many other suitable sites in the county that are not next to developed lakefront.
One of my concerns with the proposal is the potential for bright outdoor lighting that is common for
this type of business. We value the tranquility of our cabin and viewing the night sky. Around the
clock security lighting would definitely detract from the enjoyment of our woods. The additional noise
and traffic that this would bring to the area would also have a negative impact on the character of the
community. Additional concerns include wear and tear to our privately maintained roads, and
potential for erosion due to storm water runoff.
I will not be able to attend the meeting where this proposal is reviewed, so please make this letter
part of the official record. I ask you to deny this conditional use permit. This business would be a
much better fit in an industrial area, not directly adjacent to residential lakefront properties.

We are writing in regard to the conditional use permit request for storage units that are to be built west
of Coleman Trail, off of Little Mo Road and Trail. The survey attached to the application indicates that
these storage buildings (33 total) would be built on both sides of Little Mo Road.
We have concerns about this development. This area has been zoned agriculture for decades and is a
habitat for wildlife and many birds. Bee keepers at one time brought in hives because of the buckwheat
planted on these acres.
Little Mo Road and Trail are not on a township road. We have had to do the maintenance of this road,
to include private plowing, mowing the grass on the sides, and adding and grading gravel as needed over
the years. This road is not wide enough for cars to meet without driving onto the shoulder. This has not
been an issue because of the few cars using this road. This would not be the case if 33 storage units
were built. We would want the developer to construct the entire Little Mo Road to township standards
so that the township would assume maintenance and snow plowing of this road.
We have great concerns about the size of these units. The site plan specifies that the units are 38 feet by
58 feet which is over 2,200 square feet. That is a fairly big house, let alone a storage unit. We are also
concerned that there would be 33 separate units rather than five buildings with the units integrated into
the building. The application states that construction would be done as they are sold. So this
construction could go on for years? We would like to see a time limit on the construction of these units.
There is no mention of what the exterior of these buildings would look like as far as colors and materials
used. They also stated in the application that said no outside storage would be allowed. Who would
monitor that when they are privately owned? We can see lumber, trailers, barrels, all kinds of things
left outside between the buildings.
How will this development be lit? We do not care to have lights on all night. Will people be able to
access this storage unit at all hours of the night? Our enjoyment of Battle Lake includes watching the

stunning sunsets and looking for northern lights. I do not think storage lighting will enhance this quality
of living.
We have seen a significant raise in our property taxes. Part of that is a result of development of the
Coleman Estates. As our property values increase, we can ask, "do 33 storage units in our back yards
increase the value of our homes?". We think not. We preferred the buckwheat and blue bird houses.
We would ask that you give due consideration to our concerns and deny this conditional use permit for
these storage units. Certainly a more appropriate location could be found in the township.

On May 20, 2020, an application for a Conditional Use Permit was submitted to the Otter Tail County Land & Resource Management
office. The application proposed a Storage Unit PUD located at parcels 10000020014000 and 10000010011002 in Clitherall
Township south of West Battle Lake. A public hearing was held on June 10, 2020, which resulted in the Planning Commission tabling
the application until the August 12, 2020 Planning Commission as the applicant considers changes to the proposed layout.
Since the June 10, 2020 Planning Commission meeting. Otter Tail County has had several internal discussions with the County
Attorney and the County Board Public Works Committee regarding this application. An extensive review of ordinance and statutory
language occurred. As a result, the County has made the following determination:
A planned unit development is defined as a type of development characterized by a unified site design for a number of
dwelling units or dwelling sites on a parcel.
A storage unit does not meet the definition of a dwelling unit in the Otter Tail County Shoreland Management Ordinance
and would be classified as a non-dwelling.
The Shoreland Management Ordinance does not limit how many non-dwelling units can be on a parcel. The only limiting
factor would be impervious surface requirements.
A non-dwelling planned unit development is not a use that requires a Conditional Use Permit in the Shoreland Management
Ordinance.
The County has no legal standing to require Planning Commission approval of the proposed storage units.
In regards to the need for platting, as long as the provisions in Minnesota Statute 515B.2-1101 (c) are met, the Common
Interest Community that is proposed does not need to be platted in accordance with The Otter Tail County Subdivisions
Control Ordinance and/or Minnesota Statute 505.
Therefore, it has been determined that the County was erroneous and a Conditional Use Permit for the proposed storage units at
parcels 10000020014000 and 10000010011002 in Clitherall Township is not required from Otter Tail County. A site permit from the
office would be adequate as the storage units are erected.
This correspondence in no way alleviates the need for the applicant to meet any other federal, state or local requirements. If you

Continued discussion on the Lakes N Wood LLC conditional use permit is to resume as previously discussed at
the June 2020 meeting.

In addition to the previously submitted comments I highlight the below items.
NOTE: Section V.3.1 of the Shoreland and Management Ordinance of Otter Tail County highlights 16
items that need consideration upon review of a CUP. These items are self explanatory.
1. Compatibility in the surrounding neighborhood
As stated per item 3.5 on the application. Lakes N woods clearly defines the proposal is for commercial
purpose. Permitting a CUP for commercial purpose in the immediate vicinity of a residential area is an
adversarial change. The narrative of land use by zone definition is changed forever and homeowner
protection of property land use is diminished or taken away. A commercial storage unit facility in the

defined location does not 'fit' in the current residential environment within a shoreland management
zone. This proposal is non-compatible.
2. Public Safety
Access to the proposal is via State Highway 210 to Little Mo Rd.
State Hwy 210 speed limit is 60MPH, westbound has no right turn lane and eastbound has no lane
bypass.
Little Mo Rd is an easement. This easement facilitates one-lane traffic. For reason the proposal is for
commercial purpose and traffic volume will significantly increase on the one-lane traffic easement road,
safety is a concern.
The Little Mo Rd single lane traffic easement established and designed for residential access is an
insufficiently designed road for commercial purpose. The road width does not permit passing of traffic.
Current residents who use the road for dwelling access combined with storage unit users are put in risk
of potential incidents attributable to traffic congestion on single lane easement.
3 Site Alteration
As stated per item 3.15 on the application. Lakes N Woods states the proposed construction area has
been designed to minimize topographic impacts from site grading and storage unit and driveway
placements.
For reason / logic the building density is very high and site elevations are significantly higher than
elevations to the residential properties north, site alteration of this magnitude is a significant
topographical change.

I understand this proposal is a modification of the plan presented in June. I have included the
letter I sent to the Board in June outlining problems with this proposed development, and it
certainly isn't an exhaustive list. I understand the plan to be presented at this meeting is to
address some of those issues, and make the development more acceptable to the county and
to the neighboring land owners.
I doubt these concerns can all be allayed. But no matter how many fixes are made, they won't
address the main concern that this is the wrong location for such an enterprise. A community of
lake front homes is not the place to insert a sea of storage units.
I strongly urge that you recommend that the County Commissioners deny this conditional use
permit.

I am writing to express some concerns about this type of business being built in this location.
Runoff. This is an immense project, acres and acres of buildings and driveways. I question whether the
proposed swales would contain the runoff during heavy rains, particularly in the western section which,
I believe, drains to the north.
Lights. Your management ordinance states motion sensor lights will be above each unit's entry. There is
no mention or prohibition of adding other lighting (dusk to dawn). This would definitely be an intrusion
on the surrounding neighborhoods. Please clarify.
Adverse effects on quality of life. People have chosen to live here because of the woods and quiet
country setting, enjoyment of wildlife, starry nights void of city lights, and, yes, fields of buckwheat and
sunflowers. The proposed project would greatly diminish what people came here to find.
Adverse effects on property values. Property values would most certainly be impacted by this
development. I am astounded that the Colemans, after charging enormous prices for these lake lots,
would then turn around and sell to such an enterprise as this which will surely lower those property
values.
Location. Your management ordinance #5 states that because of the close proximity to Hwy 210, "the
project site is ideal for commercial purposes." We beg to differ! Surely Battle Lake, Underwood,
Clitherall and other surrounding towns have in their long-range planning, zoning for such businesses as
this. Let's keep commercial enterprises in the city, and country in the country.
Questions for the Commissioners. Have each of you visited the site of this proposed construction?
Have you acquainted yourselves with the neighborhood in Little MO and the Coleman Estates? Have you
asked yourselves if you would want this project in your back yards?
Who am I? My family has been in this location (39359 Little MO Road) for over sixty years. My father
was one of the first to purchase land in 1956 from John Murdock when he divided some of his farm into
lake lots. My father built a summer cabin there for his family to enjoy—which we certainly have. After
his death, with rising taxes and maintenance issues, his widow and children formed The Tucker Family
Company LLC (1998); its purpose being to share the cost of taxes, maintenance, improvements and use
of the cabin, and to hold the property in trust for future generations of the family. I am currently
president of our little six member company and I can say we are all in agreement that this Land n Lakes
commercial enterprise is inappropriate for this location. We urge that your recommendations to the
County Board of Commissioners will be to deny this permit.

it has the same effect. An industrial use is at the opposite end of the spectrum from our adjacent
wooded lakefront property. To put storage units next to such property would certainly decrease its
value.
Additionally, if approved, this Conditional Use Permit would serve as a warning to others considering a
land/home purchase in Ottertail County, that could be devalued just as easily. This would not promote
the construction of beautiful lakefront homes that bring in lots of tax dollars each year, or the annual
arrival of an ever-increasing number of summer vacationers who spend lots of money in Ottertail
County businesses and add greatly to the economy of the area.
My grandfather, who was born in Clitherall, built our cabin at 39359 Little MO Rd. more than 60 years
ago, and since that time six generations of my family have been coming to these northern woods to
enjoy the peace and tranquility we find here. There are several things about this proposed development
that would detract from our enjoyment of our property.
Lighting is of primary concern. We enjoy the darkness at night, being able to see the stars, and viewing
the occasional aurora borealis. Flood lighting and motion detection lights coming on and off would
certainly detract.
While I understand there would be provisions to handle stormwater runoff, these never quite take care
of it all. There is a high potential for the runoff from units like these to contain contaminates such as
antifreeze, oil, or gasoline. Not everyone who stores boats or other recreational vehicles in these units
will care about the water quality in the lake or in our wells, the latter of which we use for drinking and
bathing.
I understand there are rules stating that people would not be able to spend the night in these units.
They shouldn't attempt to cut through out properties to get to the lake. And they should not cause
pollution to the groundwater and lake. However, there are no real teeth in these rules, and people will
do as they want, regardless of the cost to others.
There are plenty of areas near towns in Ottertail County that are already zoned for industrial use. There
is no need to build storage units in a rural area right next to lakefront properties, some with very high-
end homes.
I would ask you to please deny this Conditional Use Permit and let this out-of-town investor find a
more suitable location for storage units.

We have been told that a conditional use permit does require the agreement of the adjoining
landowners. To that end, we have surveyed our neighbors for their opinion on this project. The results
were a petition to the Clitherall township board, requesting that they deny the request from Lakes N
Woods Storage LLC to change the affected land from agricultural to a commercial use. 100% of the
landowners on Little Mo Road and Little Mo Trail signed the petition and are in opposition to this
project. Some landowners on Coleman Estates also signed the petition. As you are aware, the Clitherall
Township board voted not to change zoning. Enclosed you will find copies of that petition.
Since this project in within 1000' of West Battle Lake, why are the developers not required to submit an
environmental impact statement? We are downhill from the project and already have experienced run
off issues in the spring. With a holding pond being proposed at the top of our driveway, it causes us
grave concerns. What if the holding pond does not contain the water when the ground is frozen? Will it
be the counties problem or more likely, our problem?
Many other concerns have been voiced about this project: traffic safety, maintenance of roads,
enforcement of rules, fire suppression problems, run-off, lights, timely snow removal, quality of the
buildings, time frame for building and so many problems that may spring up. We urge the Planning
Commission to listen to the area homeowners and deny this conditional use permit.

the privately owned driveways to access the storage units. There will be no outdoor storage. The

Motion - June 10. 2020: A motion by Wass, second by Trites to accept the request of the

On May 20, 2020, an application for a Conditional Use Permit was submitted to the Otter Tail County Land & Resource
Management office. The application proposed a Storage Unit PUD located at parcels 10000020014000 and 10000010011002
in Clitherall
Township south of West Battle Lake. A public hearing was held on June 10. 2020, which resulted in the Planning Commission
tabling the application until the August 12, 2020 Planning Commission as the applicant considers changes to the proposed layout.
Since the June 10, 2020 Planning Commission meeting. Otter Tail County has had several internal discussions with the
County Attorney and the County Board Public Works Committee regarding this application. An extensive review of ordinance
and statutory language occurred. As a result, the County has made the following determination:
A planned unit development is defined as a type of development characterized by a unified site design for a number
of dwelling units or dwelling sites on a parcel
A storage unit does not meet the definition of a dwelling unit in the Otter Tail County Shoreland Management
Ordinance and would be classified as a non-dwelling.
The Shoreland Management Ordinance does not limit how many non-dweling units can be on a parcel. The only
limiting factor would be impervious surface requirements.
A non-dwelling planned unit development is not a use that requires a Conditional Use Permit in the Shoreland
Management Ordinance.
The County has no legal standing to require Planning Commission approval of the proposed storage units
In regards to the need for platting, as long as the provisions in Minnesota Statute 515B.2-1101 (c) are met, the
Common Interest Community that is proposed does not need to be platted in accordance with The Otter Tail County
Subdivisions Control Ordinance and/or Minnesota Statute 505.
Therefore, it has been determined that the County was erroneous and a Conditional Use Permit for the proposed storage units
at parcels 10000020014000 and 10000010011002 in Clitherall Township is not required from Otter Tail County. A site permit
from the office would be adequate as the storage units are erected.
This correspondence in no way alleviates the need for the applicant to meet any other federal, state or local requirements. If

Section I:
1. The proposed project will be located on parcels of land that adjoin the State Hwy 210
frontage and contain well-drained soil composed of tall grasses and some small planted
trees. There is an existing stand of deciduous trees that will not be impacted by the
construction plans.
2. The construction plan is designed to minimally impact soil through grading activity. The
vegetative impact will be contained to tall grasses and weeds throughout the project area.
The minimal runoff generated from grading activities will be contained onsite by utilizing the
existing low elevations areas to keep ali runoff on the project site.
3. The proposed location of storage unit properties and access driveways have been designed
to minimize soil disturbance and reduce impacts to the surrounding areas/properties. All
storage unit construction activities will be contained within the property boundaries.
4. The individual storage properties will be ten feet (lO”) apart from another. All applicable
setbacks have been followed in the proposed site design.
5. Because of the close proximity and frontage to Trunk Hwy 210, the project site is ideal for
commercial purposes.

7. There are no environmentally sensitive areas within the proposed construction site.
8. Soil grading activities will be conducted with a small crew and minimal earth moving
machinery to reduce traffic, noise, and area impact. Construction of storage property units
will only occur as units are sold, thereby reducing construction activities that commonly
generate noise and excessive traffic.
9. Noise generation will be minimized by utilizing small crews for soil grading activities and
intermittent storage unit construction that will only occur during daylight business hours.
10. Construction activities will only be allowed during normal daytime business hours.
Individual storage unit owners will be encouraged to access the storage units during
daytime hours.
11. Motion sensor lighting will be placed over the garage door, or entry point, for each
individual storage unit. Motion sensing lighting will provide adequate lighting for storage
unit owners to safely access their property while reducing unnecessary light pollution when
not needed.
12. One free standing sign will not exceed thirty-two (32) square feet.
13. Site grading and driveway placement will be completed quickly. Storage unit construction
will take place after individual units area sold over time.
14. The proposed project area is located on 10.1 acres of land and the storage unit placement
has been designed to minimally impact the surrounding area environment.
15. The proposed construction area has been designed to minimize topographic impacts from
site grading and storage unit and driveway placement.
16. The site plan illustrates where native, coniferous trees will be planted to reduce visual site
pollution for nearby area residents.

On May 20, 2020, an application for a Conditional Use Permit was submitted to the Otter Tail County Land & Resource
Management office. The application proposed a Storage Unit PUD located at parcels 10000020014000 and 10000010011002
in Clitherall
Township south of West Battle Lake. A public hearing was held on June 10, 2020, which resulted in the Planning Commission
tabling the application until the August 12, 2020 Planning Commission as the applicant considers changes to the proposed
layout.
Since the June 10, 2020 Planning Commission meeting, Otter Tail County has had several internal discussions with the
County Attorney and the County Board Public Works Committee regarding this application. An extensive review of ordinance
and statutory language occurred. As a result, the County has made the following determination:
A planned unit development is defined as a type of development characterized by a unified site design for a number
of dwelling units or dwelling sites on a parcel.
A storage unit does not meet the definition of a dwelling unit in the Otter Tail County Shoreland Management
Ordinance and would be classified as a non-dwelling.
The Shoreland Management Ordinance does not limit how many non-dwelling units can be on a parcel. The only
limiting factor would be impervious surface requirements.
A non-dwelling planned unit development is not a use that requires a Conditional Use Permit in the Shoreland
Management Ordinance.
The County has no legal standing to require Planning Commission approval of the proposed storage units.
In regards to the need for platting, as long as the provisions in Minnesota Statute 515B.2-1101 (c) are met, the
Common Interest Community that is proposed does not need to be platted in accordance with The Otter Tail County
Subdivisions Control Ordinance and/or Minnesota Statute 505.
Therefore, it has been determined that the County was erroneous and a Conditional Use Permit for the proposed storage units
at parcels 10000020014000 and 10000010011002 in Clitherall Township is not required from Otter Tail County. A site permit
from the office would be adequate as the storage units are erected.
This correspondence in no way alleviates the need for the applicant to meet any other federal, state or local requirements. If

intermittent storage unit construction that will only occur during daylight business hours.
10. Construction activities will only be allowed during normal daytime business hours.
Individual storage unit owners will be encouraged to access the storage units during
daytime hours.
11. Motion sensor lighting will be placed over the garage door, or entry point, for each
individual storage unit. Motion sensing lighting will provide adequate lighting for storage
unit owners to safely access their property while reducing unnecessary light pollution when
not needed.
12. One free standing sign will not exceed thirty-two (32) square feet.
13. Site grading and driveway placement will be completed quickly. Storage unit construction
will take place after individual units area sold over time.
14. The proposed project area is located on 10.1 acres of land and the storage unit placement
has been designed to minimally impact the surrounding area environment.
15. The proposed construction area has been designed to minimize topographic impacts from
site grading and storage unit and driveway placement.
16. The site plan illustrates where native, coniferous trees will be planted to reduce visual site
pollution for nearby area residents.
