Conditional Use Permit - Peterson Family Cabin LLC/Dayid Peterson:
Motion by Lindquist, second by Huebsch, and unanimously carried to deny a Conditional Use Permit for a

Keith O. Holland - Denied:
An After-The-Fact Conditional Use Permit Application (as stated by the Applicant on the
Application): This is an After-The-Fact permit request for topographic alteration for building site
and lake access pathway. Prepare area inside buildable area for storage building site 32’ x 56’
including stump removal, and fill, driveway finish, and prepare for grass seeding and reduce
impervious surface. Due to unique property characteristics, improve lake access pathway approx.
6’-7’ wide x 195’ long, following a previous path & natural terrain features. Taper, prepare & seed
banks, stabilized with log bake checks and natural ground cover. Indent toe of bluff 72 sq/ft at
base of lake access path for possible WOAS. Lake access path is shielded from lake view by
trees and allows handicap & disabled family member safe access to lake shore. Finish driveway
& build access into building up to 1440 sq ft of gravel. Stabilize and seed any disturbed area.
The proposal is located on Lot 1 BIk 1 of Cross Point Addition, Section 5 of Maplewood
Township: Lida Lake (56-747), GD.
Keith O. Holland represented the Application.
Jim Shipp expressed concerns regarding the need for following existing permit requirements and
requested restoration of the area to its original condition. Leslie Tisch expressed concerns
regarding the excavation in the bluff, run-off, erosion, commercial use of a storage building & the
possibility of precedence for after-the-fact permits if this is approved.
Motion: A motion by Trites, second by Wilson to deny the Application, as these alterations
would not have been authorized before the fact; the existing alterations threaten the lake with
erosion & run-off and the Shoreland Management Ordinance states that stairways & lifts are the
preferred alternative to topographic alterations for access through a bluff. Voting: All Members in
favor.
Peterson Family Cabin LLC / David Peterson - Denied:
A Conditional Use Permit Application (as stated by the Applicant on the Application): We are
requesting a Conditional Use Permit for a Residential Planned Unit Development with 2 boat slips
over 5.27+- Acres lying E’ly of and adjoining S.T.H. No. 78 and lying Northerly of and adjoining
South Eagle Lake Road having approximately 71 feet of shoreline on the SW’ly side of Eagle
Lake. Residential PUD density calculations support a total of 12 dwellings units, 1 in Tier 1, 4 in
Tier 2, 5 in Tier 3 and 2 in Tier 4. We are asking for a total of 4 dwelling units. Proposed dwelling
units 1, 2 and 3 are 40 x 40 foot sites lying 228 to 365 feet from the shore of Eagle Lake, 70 to
180 feet from the centerline of South Eagle Lake Trail and entirely within Tier 2. Proposed
dwelling unit 4 is the footprint of the existing Peterson cabin and deck lying entirely within Tier 1.
Immediately upon approval and recording of the CIC Plat, Dwelling Units 1, 2 and 3 will be
occupied by one RV per dwelling unit. No changes within the dwelling unit 4 are planned at this
time. In the future, it is possible one or more of dwelling units 1,2 and 3 may be occupied by one
permanent structure, replacing the one RV, and entirely within the dwelling unit boundaries. Upon
occupation of the new dwelling units, the old camper sites will be returned to their natural state.
No upgrades to the existing sewer and water supply facilities are planned at this time. New
connection lines will be run from the dwelling units to the facilities. The projected impervious
surface over the entire site is estimated to be 7.4%. The open space percentage greatly exceeds
the 50% requirement. A maximum of 680 c.y.+- of soil disturbance with all utilized or disturbed
onsite. In the future, if a permanent structure is planned to replace an RV within a dwelling unit
boundary, an erosion control plan will be provided to the Land and Resource Office ensuring the
erosion control notes shown on the survey drawing will continue to be met. The proposal is
located in Part of Lot 8 and Lot 9, Rosenquist Beach and part of Government Lot 4 and part of
the Southwest Quarter of the Northwest Quarter and Part of the Vacated Road behind lots 8 & 9,
Section 15 of Eagle Lake Township; Eagle Lake (56-253), GD.

I live at 39555 Cross Point Lane, Pelican Rapids, MN. I was notified of an after the fact permit request about 8 lots down from
mine. I cannot be at the meeting tomorrow because I have to be out of town. However, I would appreciate it if you would read
the following at the planning meeting:
Dear Planning Commission,
I have recently discovered to my horror the massive excavation that has been done on a lot on my beach on South Lake Lida. I
didn't realize until this "after the fact permit" meeting notice, that my neighbor has been excavating a road reaching from the
bluff all the way down to the lake. Not only that, but he has constructed a cabin near the water at the base of the bluff. Part of
the bluff was torn off to construct the cabin. The road that was built is, in places, at least 4 feet deep. It is wide enough for a

pickup truck to easily drive on it. There is a deep ravine down the middle of the road that has been washing out with rain. You
can also see that the dirt from the road has been washing into the lake.
I know that the owner has been around long enough to know that you need a building permit to develop a property. This is a
basic rule of civilization. Obviously a permit was not obtained because he knew it would be denied. I will be outraged if this
owner is not required to remove the cabin and restore the bluff to its original state.
The rest of us on this beach also have the bluff. We have followed the rules. He hasn't. He should not be rewarded with a
variance just because it is already done. This would be a horrible example for the county.
South Lida is a beautiful lake with a mostly unspoiled shore line. He should not be allowed to ruin it for the rest of us.

Mr. Holland,
On August 10, 2016 the Otter Tail County Planning Commission denied your earth moving requests.
After reviewing the minutes from the meeting, it was decided that you are to restore the disturbed bluff area
back to its original condition.
Please contact our office on or before September 6, 2016 so the restoration project can get started.
The type of restoration required for your property is as follows:
• Reshape/fill in toe of bluff.
• Remove shedA/VOAS.
• Rip rap toe of lake access pathway.
• Create a small berm at the top of the lake access pathway to help divert water away.
• The use of soil erosion blankets/coconut blankets, sit fences, bale checks, seed (rye) and dormant
seed.
• Use a combination of pit run material, class 5 and black dirt. A good foot of black dirt on top to get the
vegetation established.
Also, it might be best to have an onsite meeting so we can go over the restoration process and try and
answer any question you may have.
