A 56,000 square foot warehouse, housing 12 10,000-gallon storage tanks and up to 18 10,000-gallon storage tanks with 5,600 square feet of attached office will be constructed. He has put in as many lots as allowed--every 200 feet, with no regard to the lay of the land. In fact, I have some friends who were interested until they saw how the developer chopped up the property. The road he proposed to put in was obviously done as cheaply as possible. It makes me sick to see how little he cares about the land and the lake, and how this may turn out. Please don't let this developer destroy this lake! It is a small lake, and I don't think it can withstand additional home development on its shores. The lake is home to a pair of loons, and I recently read that Otter Tail County has a lower population of loons among the Minnesota counties where loons are monitored by DNR. There have also been bald eagles in the area, which hadn't been seen until a few years ago. While there are laws designed to protect a natural environment lake, such as Anderson Lake, I'm concerned that new property owners might not abide by those laws. And once the damage is done, it could have a major impact. The lake is enjoyed by many area residents who fish and canoe on the lake. I'd like to see strong efforts to preserve the quality of it's shores and wildlife. The requirements for environmental review, including the preparation of an EAW, can be found in the Minnesota Rules, chapter 4410. The procedures to be followed in making the EAW decision are set forth in part 4410.1100. Smestad Law Office Building 110 N Mill Street Fergus Falls MN 56537 Dear Ms. Smestad: Your letter dated May 23,2000, requesting information for Anderson Lake 56-716 has been referred to me.■ \ ■_ The Minnesota Department of Natural Resources, Section of Fisheries, maintains an extensive fisheries lake survey file for Anderson Lake dating back to 1967. Access to this file can be made via the Internet at www.dnr.state.mn.us using lake finder, or hard copies of surveys can be made at this office for a small charge ($3/survey). The proposed development on Anderson Lake (56-716), Otter Tail County would impact the aquatic plant community. The magnitude of impact would be dependent on the individuals purchasing the property. As Anderson Lake is small, 83 acres, and as it is narrow, there is potential for nunaerous lots which could meet county zoning requirements. The possibility exists for forty plus homes on the lake resulting in approximately 2 acres of surface water per riparian property owner. Assuming some direct vegetation control by property owners, and some indirect destruction by boating activities, there could be substantial changes to the aquatic plant community. Without a permit, Minnesota Rules, Chapter 6280, the rules which govern aquatic plant management in public water, allows ripariain property owners to cut or pull submerged vegetation in order to maintain a site for swimming and boat docking not to extend along more than 50 feet of the owner’s shoreline or one-half the length of the owner’s total shoreline, whichever is less, and does not exceed 2500 square feet in area. 4 . Permits are required to destroy any emergent vegetation including but not limited to cattail, bulmsh, and wild rice. Permits will be issued to allow access to the lake, only when no other access is available. State law prohibits the use of herbicides in natural environment lakes, therefore no permits would be issued for chemical control of aquatic vegetation in Anderson Lake. Weedroller permits will be issued based on submerged vegetation density and bottom substrate composition. Further development of the lake area, specifically4 . including additional boat traffic and development of the lake shore area for docks, beaches, etc..will cause increased degradation of the aquatic life and vegetation.The drainage of these additional lots and how such sedimentation will affect the lake and the species that rely on it also greatly concerns me. The wetland that is located on Lot A of the proposed3 . development catches the runoff from the gravel road and it seems to have deteriorated the wetlands over the years.There is another wetland on Lot F and one next to County Road 3.I am concerned about the impact the development will have on those wetland areas as well. There is a pair of loons that nests in the area every I am concerned about their habitat as well, given the 4 . year. More homes mean more docks and boatsprospects of development. and that will make the continued health of the wildlife on and near the lake subject to many destructive elements.
