Motion
Jack and Diane Strickland - Denied.
Motion was made by Randall Mann, second by Rod Boyer and unanimously carried, to deny the variance as
requested as no adequate hardship unique to the property had been shown that would permit the granting of the
variance as requested. It was noted that this is a larger parcel, which should offer other sites that can meet the
required 10’ side lot line setback. It was also noted that the Board of Adjustment would not have approved the
requested variance even if it had been requested before the structure was constructed. After additional discussion
and consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to grant
the applicants until June 1,2002 for either the removal or placement of the structure in a location which complies with
the setback requirements of the ordinance.

After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and
unanimously carried, to deny the side lot line variance as requested for the garage noting that there is
adequate area to meet the required side lot line setback of 10’, to approve the placement of the proposed
garage on the west side of the existing dwelling so long as it is no closer to the ordinary high water level than
either the north or south sides of the existing dwelling and to approve the placement of the proposed house
addition within the following described area with the condition that existing structure down by the water
frontage will be removed as stated in the variance application:
Dwelling Addition Area - extend the north side (wall) of the house easterly until it intersects with the
northerly extension of the easterly side (wall) of the existing porch.
Hardship is a substandard lot of record and the terrain features of the applicant’s property.
Marilyn R. Froelich and James C. Beckstrom - Approved as requested.
Marilyn R. Froelich and James C. Beckstrom, Fargo, ND, requested a variance to “authorize the usual 10 foot
side setback on the northeasterly lot line, instead of requiring a 20 foot side setback where the street exists
only on the plat created in 1912 and has never been constructed.” The property is described as Lots 1 and
15, Block 2, the northeasterly 14 of Lot 2, Block 2, and the northeasterly 14 of Lot 14, Block 2, Pelican Beach,
Big Pelican Lake in Scambler Township. The audience was polled with no one speaking for or against the
request. After discussion and consideration, motion was made by Cecil Femling, second by Steve Schierer
and unanimously carried, to approve a 10’ road right-of-way setback, instead of the required 20’ setback, from
a road which has never been constructed and exist only on a plat created in 1912. Hardship is a substandard
lot of record. The granting of the variance will allow the applicants the ability to enjoy the same rights and
privileges as other in the immediate area who are either closer or perhaps even in the dedicated road area.
Jack and Diane Strickland - Denied.
Jack and Diane Strickland, Frazee, MN, requested a variance of 10’ from the required side lot line setback of
10’ for the placement of pole barn 0’ from the property line. The property is described as part of Government
Lot 6, Section 26 of Maplewood Township by Bracket Lake. The audience was polled with no one speaking for
or against the request. After discussion and consideration, motion was made by Randall Mann, second by
Rod Boyer and unanimously carried, to deny the variance as requested as no adequate hardship unique to
the property had been shown that would permit the granting of the variance as requested. It was noted that
this is a larger parcel, which should offer other sites that can meet the required 10’ side lot line setback. It was
also noted that the Board of Adjustment would not have approved the requested variance even if it had been
requested before the structure was constructed. After additional discussion and consideration, motion was
made by Randall Mann, second by David Holmgren and unanimously carried, to grant the applicants until
June 1, 2002 for either the removal or placement of the structure in a location which complies with the setback
requirements of the ordinance.
Royces Resort - Approved with condition.
Royces Resort, Richard and Priscilla Stegman, Frazee, MN, requested a variance of 12’ from the required
side lot line setback of 50’ for the placement of an attached garage 38’ from the side lot line. It should be
noted that an existing boathouse located 8’ from the lot line would be removed. The property is described as
Lots 1, 2, and 3, Birch Dale Resort, Wymer Lake in Hobart.Township. The audience was polled with no one
speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer,
second by Cecil Femling and unanimously carried, to approve a variance of 12’ from the required side lot line
setback of 50’ for the placement of an attached garage 38’ from the side lot line with the condition that an
existing 12’ by 32’ structure must be removed by September 1,2002. It was noted that the granting of this
variance in exchange for the removal of thel 2’ by 32’ structure located 8’ from the lot line is a good
improvement. Hardship is the terrain of the applicant’s property.

Attached is various info for consideration of our variance request.
Due to the recent notice froim the Assessor’s Qflice regarding GreerL Acres
and the fact we havn sold oiir lake property, dosing date 11-15-01, our
neighbor to the North decided herwants to instah a:fence on our
adjoining property^ hne. In trying^ to establish the boundarjrhe dtseoyered
our pole barn is encroaching onto his property by about 4’ 6”. I hired the
services of Lake Region-Surveying who confirmed the encroachment The
survey was completed on 1L-9-01.
