Calculations based on the requirements of the shoreland ordinance would allow for 6 units in the first tier. The applicant is proposing the construction of a new dwelling in the first tier. At the present time the applicant has 9 rental cabins, 4 camp sites and a farm house. The applicant has a total of 14.02 acres and 585’ of lake shore which would support a total of 15 units in all tiers. The property is described as part of Government Lots 2, 7 and 8, Section 15 of Maine Township by Pickerel Lake. The audience was polled with Jean Dahl speaking in favor of the request. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and unanimously carried, to approve the variance as requested vrith the condition that the existing bam must be removed within three months. It was noted that the request is reasonable and that the applicant is maintaining the proper setback from both the ordinary high water level and the side iot line. Gerald E. Lowe - Approved Gerald E. Lowe, Dent, MN, requested a variance to subdivide two parcels of less than 5 acres from an existing 21 acre parcel without a registered surveyor’s drawing. Parcel 1 would be approximately 160’ by 160’ by 230’ (Triangular). This parcel would be permanently attached to Lot 10, Kozelnik’s Beach 2nd Addition. Parcel 2 would be approximately 25’ by 80’. This parcel would be pemianently attached to the existing backlot of Lot 7 Kozelnik’s Beach 2nd Addition. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance to subdivide two parcels of less than 5 acres from an existing 21 acre parcel with the condition that a registered surveyor’s drawing and a letter stating that there are no boundary line disputes must be presented at the time of recording. It was noted that Parcel 1 would be approximately 160’ by 160’ by 230’ (Triangular) and would be permanently attached to Lot 10, Kozelnik’s Beach 2nd Addition. It was also noted that Parcel 2 would be approximately 25’ by 80’ and would be permanently attached to the existing backlot of Lot 7 Kozelnik’s Beach 2nd Addition. Valent Bernat - Tabled Valent Bemat, Rochert, MN, requested a variance to subdivide two tracts of less than 5 acres from an existing 28 acre parcel and a variance of 90’ from the required ordinary high water level setback of 200’ for the construction of a dwelling and a garage 110’ from the ordinary high water level on each parcel. Each lot would have a minimum of 80,000 square feet of area and 200’ feet of water frontage. The property is described as part of Government Lot 2 and part of the Southeast Quarter of the Northwest Quarter, Section 34 of Dead Lake Township by Dead Lake. The audience was polled with Mike Harris, Dead Lake Association Vice-President speaking against the request. A letter from the Dead Lake Association opposing the granting of this request was read for the record. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to either table this request subject to the receipt of a letter from the applicant requesting that the application be tabled or to deny the variance as requested if a letter is not received by November 10, 1996. Robert Geston - Approved Robert Geston, West Fargo, ND, requested a variance of 8’ from the 30’ maximum allowable height of a dwelling for the construction of a dwelling having a 10’ by 10’ third story observation tower and an overall height of 38’. The property is described as the east 50’ of Lot 6 and all of Lot 7, Block 1, Haugen’s Knollwood First Addition, Pelican Lake in Dunn Township. Frank Hanson, Contractor, represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously earned, to approve a variance of 2.5’ from the 30’ maximum allowable height of a dwelling for the construction of a dwelling having a 10’ by 10’ third story observation tower and an overall height of 32.5’. Hardship being the terrain. It was noted that the applicant’s lot is considerably lower than the adjacent lots and the view of the adjacent properties will not be affected by this staicture.
