County Attorney, David Hauser, referred to the Ditch No. 16 Public Hearing held October 18, 2010.
He reported that the Engineer’s findings that the culverts under Bonnie Beach Road and North
Clitherall Road, as they exist, have insufficient hydraulic capacity to operate as the ditch was originally
designed and constructed. There was general agreement at the Public Hearing that 48” elliptical
culverts would be safer with larger capacity and without an excessive increase in cost. Mr. Hauser
indicated that there is no evidence that the culverts were installed after 1947. Therefore, it has been
determined that these culverts were installed pre-1947, which then makes the ditch system
responsible for the repair.
Motion by Huebsch, second by Lindquist, and unanimously carried to accept the Engineers Report, as
submitted at the public hearing, which finds that the culverts have insufficient hydraulic capacity, order
the culverts to be corrected, and submit bids for the repair and clean out project that was presented at
the public hearing at an approximate cost of $180,000. The bid opening date will be set by the
Engineer between November 19, 2010 and December 3, 2010. The bid opening date flexibility is
needed to obtain the best overall project results. Discussion took place regarding vegetation that
needs to be eliminated. The Ditch Inspector will research this issue and report back to the Board.
Planning Commission Recommendations
Conditional Use Permit - Roger Pinckney XII:
Motion by Erickson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to upgrade an old logging road to a driveway for a possible building site as presented. The
property is described as Pt of GL 2 (18.50 AC) & pt of GL 5 (2.10 AC), Section 31 of Candor
Township; Otter Lake (56-577), NE.
Conditional Use Permit - Lorin L & Anna Mae Remmick:
Motion by Froemming, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to construct two large rip rap boulder retaining walls with conditions as recommended by the
Planning Commission. The property is described as Lot 3 BIk 1 West Shady Nook Beach, Section 15
of Maine Township; Pickerel Lake (56-475), RD.
Conditional Use Permit - Wee Villa Resort LLLP:
Motion by Erickson, second by Rogness, and unanimously carried to approve a Conditional Use
Permit to replace a roof on an existing mobile home as presented. The property is described as Lot 4
ex trs (36.15 AC), Section 14 of Elizabeth Township; Long Lake (56-784), RD.
Conditional Use Permit - Gwen Howe LLC:
Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use
Permit to replace failing timber retaining walls and patio with conditions as recommended by the
Planning Commission. The property is described as EV2 of Lot 8 & WV2 of Lot 9 & vac rd adj Pelican

Conditional Use Permit - John & Susan Martodam:
Motion by Huebsch, second by Rogness, and unanimously carried to approve a Conditional Use
Permit to construct a walkout as part of a house replacement project with conditions as recommended
by the Planning Commission. The property is described as Little Pine Beach Lot 6 & Wly 30 of Lot 7,

address health and safety issues for the property’s owners as well as erosion and
maintenance problems, we propose constructing 2 large rip rap boulder retaining walls with
each wall being approximately 90’ in length and being 4’ or less in height. Total common
excavation will be approximately 42 cubic yards. See attachment #1 (on file at Land &
Resource Management Office) for more detailed justification for this project. The property
is described as Lot 3 BIk 1 West Shady Nook Beach, Section 15 of Maine Township;
Pickerel Lake (56-475), RD.
Lorin & Anna Mae Remmick represented the Application.

Wee Villa Resort LLLP - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Install 5-12
pitched roof on existing mobile home (Lot 35). Impervious surface 15.48%; no change
proposed. The property is described as Lot 4 ex trs (36.15 AC), Section 14 of Elizabeth
Township: Long Lake (56-784), RD.
Cory Heit represented the Application.
Motion: A motion by Boyer, second by Maske to approve as presented. Voting: All
members in favor.
Gwen Howe LLC - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Remove
failing timber retaining walls & patio. Replace with landscape block & proper backfill
material & rip rap. Area excavated - approx. 80 yds. Decrease impervious coverage, add
vegetation. Support structure to maintain existing vegetation currently supporting hillside
with failing structure. Previously approved by Planning Commission. The property is
described as El/2 of Lot 8 & W1/2 of Lot 9 & vac rd adj Pelican Lake Park 1®‘Addition & pt

James Larson (Project Manager) represented the Application.
Motion: A motion by Gill, second by Schwartz to approve as presented, provided the
stairway does not exceed its current width; may do the work this fall provided it is
completed by November 17, 2010. Voting: All members in favor, except Zimmerman.
Break: At 7:54 the Commission took an 8 minute break.
John & Susan Martodam - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Cut out area
in front of existing house & proposed new house to make walkout. Install retaining wall on

We are proposing to terrace the Wllside of this property to address seyefal' lbng-term issues for
both the property and the lake, as well as health and safety issues related to the property’s
owners. Currently, the slope is excessive at a gradient steeper than 2''Hofizontal: r Vertical. With
the proposed terracing, utilizing large rip rap boulder retaining walls we aim to address several
issues. The following points are what we wish to achieve with this project:
- Health and Safety: A slope in excess of 2:1 is imsafe for both children and adults. The
steepness of this hillside poses a hazard and could cause serious injury in the event of
a fall. A set of short retaining walls, less than 4' in height, would allow for a safer
environment to the property’s occupants.r <
Stabilization: As can be seen in the attached photographs, this steep slope does not
allow for vegetation growth and has lead to excessive erosion. With terracing and
plantings, stabilization can be achieved and the excessive erosion issues can be
mitigated.
I.
Maintenance: With a slope of this nature, maintenance is currently difficult and
cannot be kept up and will become more difficult as the property’s owners get older.
This leads to excessive weed growth and overgrowth of any grasses that grow in this
steep hillside. A set of short retaining walls will allow for easier access and .
maintenance to the vegetation that will be planted and maintained on a regular basis.
