Page 3 ' Larry Krohn, provided information regarding current rental fees and he stated that the rent paid by the City of Fergus Falls for Police Department space would need to increase by about $53,000 to be at a fair market rate. Commissioners discussed charging the City $125,000 per year for dispatch (reduction of $127,000) and $102,000 per year for rental fees (increase of $53,000). Commissioners requested that the CJPA Steering Committee negotiate this with the City of Fergus Falls for the 2007 Budget and formalize changes as a percentage rather than dollar amount and incorporate a corresponding annual COLA. Site Evaluation Motion by Lee, second by Block, and unanimously carried to approve a preliminary site evaluation, to be completed by Architect, David Shultz, at an approximate cost of $2,500, for property (about 20 acres) owned by the State of Minnesota at the Regional Treatment Center which could be transferred to the County. This permit authorized 1) the excavation of building sites and driveway and 2) the filling of low area. The excavation of the building site has been completed and the home is currently under construction (walls are constructed and roof rafters and sheathing will be in place by the end of August, however not shingled). Also, the filling of the low area has been largely completed. However, the construction of the driveway, final grading and spreading of black dirt will not be totally completed prior to the permit’s earthmoving deadline of September 1, 2006. Due to the continued construction of the home after this date which will require the use of various types of heavy equipment (boom lifts, ready mix trucks, etc.) any driveway construction and final grading would be not be advisable because of potential adverse effects this equipment could have on these actions. As a result, I am requeuing that this permit be extended until September 1,2007, to allow adequate time to complete these next year. However, if the existing Site Permit will allow us to complete these items instead of extending the Conditional Use Permit, please so advise. Motion passed 3-2. otter Tail County Board of Commissioners' Meeting October 18, 2005 Page 7 Environmental Assessment Worksheet (EAW). “The Preserve at Echo Bay” Mr. Kalar stated that last Wednesday was the end of the public comment period for the EAW for the Preserve at Echo Bay. The County will now need to make a decision by November 14, 2005, as to whether or not an Environmental Impact Statement is needed for this particular project. He recommended that the Planning Commission review the EAW, comments that have been received, and put together findings for the County Board to consider. The decision the County Board would need to make is either a positive declaration for an EIS if there is a potential for significant environmental impact or a negative declaration for an EIS if there is not a potential for significant environmental impact. Motion by Nelson, second by Lee, and unanimously carried to refer the review of the EAW and public comments for “The Preserve at Echo Bay” to the Planning Commission to complete findings and recommendations to submit to the County Board. The representative fi-om your office that I discussed this issue with told me that I would have to make a written request to have the permit extended. The reason that I are respectfiilly requesting an extension of Conditional Use Permit #6171 is that the work authorized was not completed as originally planned due to recovery from the damage sustained as a result of the windstorm earlier in the summer. Prior to the windstorm, the garage building site had been excavated and concrete poured by local contractors and walls, support beams, sheathing and most rafters set in place by my wife and myself during many weekends prior to the storm. However, the structure was extensively damaged during the windstorm and had to be largely dismantled and rebuilt, significantly delaying our building project. Also cleanup of damage done to some trees on the property further delayed this project. It was our intention that the garage would be essentially completed and serve as project headquarters before excavation of the home building site commenced. We estimate that the damage done by the storm cost my wife and I approximately two to three months work between the original construction of the garage, dismantling afterward and reconstructing the garage and we felt after discussions with our excavation company that there would not be adequate time to have the home building site excavated and basement constructed and capped as well as other authorized earthmoving completed prior to September 1 earthmoving cutoff date. Remmick (Applicants), submitted an Application for Conditional Use (Application). This application requested a topographical alteration to the property Applicants own on Pickeral Lake. On October 13, 2004, this Application was addressed at the Planning Commission’s meeting. The purpose of my letter is to seek clarification of item 2 of the Planning Commission’s motion which states “Fill low area 60’ from the lake being a minimum of 2’ lower than the neighbor (to the North) at a point 40’from neighbor (to the North)”. The Applicant’s intent when submitting its Application was to raise the low area, beginning behind the secondary ice ridge, or approximately 30’ more or less fi'om the lake (as shown on scaled drawing submitted with Application), or the beginning of the low area, and ending at a point approximately 100’ from the lake. The fill area’s finished elevation would remain lower than the secondary ice ridge elevation. When hearing the Planning Commission’s motion at their October 13, 2004 meeting, it was my understanding and belief at that time that the Applicants proposal to fill the low area was acceptable as long the lowest point of the area to be filled remained at least 60’ from the lake (approximately the midpoint distance fi'om the lake of the area proposed (30’ + 100’)/ 2)) and at least 40’ from the neighbor’s property to the North and, therefore, did not question the Planning Commission’s motion when made and voted upon. On October 29, 2004, when I received the Conditional Use Permit in the mail, I contacted your office to further discuss the Planning Commission’s motion before discussing this excavation work with my excavation contractors, Dan and Laremie Barry of Barry Excavation. Based on our discussion you stated that your understanding of the language contained in the Planning Commission’s motion was that the fill area would begin 60’ from the lake, not immediately behind the secondary ice ridge, or the beginning of the low area as I had understood. However, I stated that I did not believe that this was the Planning Commission’s intent in issuing its motion addressing this matter because instead of raising the elevation of this entire low area as was proposed by the Applicants and substantially retaining a somewhat natural contour of the area (see Exhibit 1X if we were to fill this area beginning 60’ from the lake we would create a 30’ wide ditch or valley between the secondary ice ridge and the beginning of the filled area (see Exhibit 2), doing nothing to enhance the look or usefulness of the Applicants’ property or neighboring properties. In addition, when I asked you if it made sense to fill this low area based on your interpretation of the Planning Commission’s motion versus the Applicants interpretation of the motion, you stated that the Applicants interpretation made more sense but that you needed to seek clarification of the motion’s language addressing this issue with the Planning Commission. I am respectfully requesting that at the Planning Commission’s next meeting, you request clarification of the Planning Commission’s motion addressing this matter. If needed, please feel free to provide my letter to the Planning Commission members. If yourself or the Planning Commission members require additional information, please feel free to contact me. After some discussion, the direction of the Planning Commission was that the motion matches Exhibit #1 (see file). Herb’s Ridge / Herbert & Arlene Wilschewski, Long Lake (56-388): Bill Kalar discussed with the Commission the motion for the dedicated road requiring the right-of-way extend to the property line. He indicated that the surveyors have requested that the road not be dedicated to the lotline. After some discussion, the consensus of the Commission was to follow the original motion.
