45° slope) about 12' vertical and because many lake recreation activities
require equipment v;hlch requires storage, v/e Desired to develop a closed
storage area at lake level, v.'e decided a pre-built 8' square v;ooden building
would satisfy our purpose. In order to provide better access to this area,
a new stairviay, On or about the 25th of Ipril, before any materials v/ere purchased, and before any v;ork on this project was begun, I phoned the Shore
line J^anagement office and talked to an employee named Brian,
is a verbatim account of that conversation as well as I remember it:
J.P. Hello, this is ^ohn Peterson, I own property on Pickerel Lake and have
planned a project which I would like to know if I need perralV^r variance.
What kind of project is it?
J.P. I want to build a new stairway down to the lake with a 12'x24' patio/deck
at the bottom and a storage building on the deck.
How large is the building?
J.P. 8 feet square - 64 square feet.
No permit is required as long as the building is less than ICO square Ft.
J.P. So I need no permit or Variance for any of this planned work?
You are not planning to bring in any heavy equipment or anything?

Based on what I believed was clear assurance that this project was fully legal,.
I purchased materials and proceeded with the work. On or about May 29, 1985,
a shoreland management Inspector, Doug, came to our property and informed me
we were in violation of the ordinance because the building is less than 100 feet
from the lake. He would not inform me of the source of his knowledge of my project but stated work had been "reported" to his office. In a phone conversa-
tlonon May 31, 1985, he informed me that Brian remembered my call but because
"he mentioned set-back", the rule of his office was that I must apply for a
variance after the fact of building.We v/idK to present photographs of the finished project at the variance hearing.

Dear Committee Wembev's ;
This Letter is written in suppov't of John and Mary
Peterson’s request to have a storage shed on the shore line
of Pickerel Lake.
My wife and I own a cabin on Pickerel Lake one hundred fifty
feet from the Peterson lot. We are proud of our property and
in no way do we want anything done that would adversely
affect the quality of the water or the natural beauty of the
lake and it’s shoreline. Because of this strong feeling we
have inspected the building and came to the following
conclusions: <1) The building is not visible from any point
on our property, and (£) the building blends in nicely with
the surrounding landscape and is almost completely hidden by
a high bank and the surrounding trees.
We undev'stand the necessity of the need to protect our lakes
and appreciate the tough decisions that your committE^e? must
make. We strongly believe that each decision should be made
on its own merits and that you consider the uniqueness of
the pv-oblerns of people living on top of a high bank as
opposed to those living on property level withi the
shoreline. Hopefully you will take into cons idev'at ion the
feelings of Peterson’s neighbors and the fact that all the
property in this area is on top of rather steep bank and in
no case is the building visibls? from any adjacent pr'oper'ty
on top of the bank and is barely visible from the lake.
