To Whom It May Concern: Tim Mieczkowski 857 S Main St Sauk Centre, MN 56378 has made application to the Otter Tail County Board of Adjustment for a variance as per requirements of the Otter Tail County Shoreland Management Ordinance and/or the Subdivision Controls Ordinance. The Otter Tail County Board of Adjustment will assemble for this hearing on Thursday, October 9, 2003, at 6:30 p.m.. in the Commissioners’ Room of the Otter Tail County Courthouse, Fergus Falls, MN. (Please use the public entrance located on the northeasterly side of the Government Services Center. Second left off Fir Ave.) Individuals requiring special accommodations should contact the County Auditor’s office prior to the date of the public hearing. The property concerned in the application is legally described as Lot 1, Walleye Beach, E911 Address - 32781 Walleye Dr. Section 14, Township 134, Range 41 - Township Name - Maine Lake No. 56-475, Lake Name - Pickerel, Class - RD The variance requested is: a variance to have Lot 1, Walleye Beach, declared a buildable lot for residential development. (6:45 p.m.) Duane and Winnie Ulschmid, Sub Lot F of Government Lot 3, Section 10 of Dunn Township by Pelican Lake, requested a variance of 8’ from the required holding tank setback of 10’ for the placement of a 1500- gallon holding tank 2’ from the garage. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and unanimously carried, to approve a 5’ variance from the required side lot line setback of 10’ and a variance 3' from the required structure setback of 10’ for the placement of a 1500 gallon holding tank 5’ from the side lot line and 7’ from the existing garage with the condition that the applicants must obtain a letter from the neighbor granting approval for a 5’ setback from the shared lot line. This variance approval does not authorize impervious surface coverage greater than 25%. It was noted that the variance as granted does not directly or indirectly granted any other variances. (7:00 p.m.) Tim Mieczkowski, Lot 1, Walleye Beach, Pickerel Lake in Maine Township, requested a variance to have Lot 1, Walleye Beach, declared a buildable lot for residential development. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, motion was made by Steve Schierer, second by Leona Zimmerman and unanimously carried, to declare Lot 1, Walleye Beach a buildable lot for residential development. It was noted that this variance approval is consistent with past actions of the Board of Adjustment and will provide the applicant with the same rights and privileges as others in this development. Ronald Jr. and Margaret Shebeck - Denied. (7:02 p.m.) Ronald Jr. and Margaret Shebeck, part of Government Lot 6, Section 9 of Sverdrup Township by Anna Lake, requested a variance of 75’ from the required ordinary high water level setback of 200’ for the location of a garage 125’ from the ordinary high water level. Dan Stenoien, Contractor, appeared with the applicants at the public hearing. The applicant stated that the proposed structure would have a size of 28’ by 52’. A letter from Lee Bakken in support of the variance as requested was read for the record. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, motion was made by Cecil Femling to approve the variance as requested. This motion died for lack of a second. After additional discussion, motion was made by Mark Steuart to deny the variance as requested as there is no adequate hardship and the applicant’s does have adequate room to meet the required setback. This motion also died for lack of a second. After additional consideration and discussion, motion was made Leona Zimmerman, second by Mark Steuart and carried with Cecil Femling voting no and with Steve Schierer abstaining, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. It was also noted that this is a large structure for the proposed location. The distance from the dwelling to the proposed garage and the removal of some trees is not sufficient reasons to grant a variance from the required setback. It was noted that the proposed structure is not within the shore impact zone and that drainage from the proposed structure would be away from the lake. Kevin and Kate Riley - Approved as requested. (7:12 p.m.) Kevin and Kate Riley, Lots 8 and 9, Newport Beach, Pelican Lake in Dunn Township, requested a variance of 19' from the required ordinary high water level setback of 75’ for two additions being 56’ from the ordinary high water level at the closest point. One addition will be 25’ by 4’ and is located on the side of the existing dwelling. The other addition will be 35’ by 8’ and is located on the roadside of the existing dwelling. Jon Anderson, Contractor, represented the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, motion was made by Steve Schierer, second by Paul Larson and unanimously carried, to approve a variance of 19’ fromlhe required ordinary high water level setback of 75’ for the two proposed additions as depicted on the applicants’ drawing, which was submitted with the variance application.
