The Board of Adjustment considered the following applications for variance: Michael J. and Debra S. Tenuis - Denied (6:32 p.m.) Michael J. and Debra S. Ternus, Lot 1 Arts North Shore, Lot 7 Block 1 Arts North Shore Second Addition and part of Government Lot 1, Section 5 of Rush Lake Township by Marion Lake, requested the following: Total height is 39’ 6” on structure. We are lequesting a variance of 4’ 6”. Maximum height is 35’ on structure for this lot. The applicants’ site contractor appeared at the public hearing with the applicant (Michael Tenuis). The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion, seconded by Chris McConn and unanimously can ied, to deny the variance as requested as no adequate hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as requested, the applicants can obtain a reasonable use and enjoyment of their property without the granting of the requested variance, the granting of the requested variance would establish precedence as the requested variance is not something the Board has approved in the past, and the applicant has a large lot, which provides adequate room for structures (living space) without the need to exceed the maximum height permitted by the ordinance.
