Time:S' ^ MDate of hearing: ____ MOTION AS FOLLOWS: Motion was made by Craig Anderson, seconded by Randall Mann and carried with Leslie Estes abstaining and John Everts voting no, to approve a variance of 8' from the required road right-of-way setback of 20' for the location of a 24' by 32' garage 12' from the road right-of-way with the condition that the runoff from the garage be directed away from the ordinary high water level. It was noted that 4.5' of fill was required, on the lake side, for the placement of the garage in the current location and that moving the garage farther from the road and closer to the lake would increase the possibility of erosion and runoff into the lake. It was also noted that the main door for the garage is located at a right angle to the road. Fergus Falls, Minnesota After consulting with the Shoreland office we thought we understood the correct standards for the placement of our new garage. We misunderstood the road light away standards and the footings are now 8 ft closer to the roadway than the standard. We would like to keep the garage where it is temporarily place for several reasons including; 1) We plan to enlarge and remodel the "A" fi-ame portion of our house in 2-3 years and the only direction we can go to remain in compliance with the coimty standards is towards the garage. We plan to live at the lake beginning in October of'95 as our permanent and only home, but we cannot at this time afford to remodel the house. We must move by October 1. This would create a hardship by limiting how we could remodel our home. 2) If we move the garage 8 feet closer to the lake it will impact the following areas: A) Our well will probably need to be moved, which will create a financial hardship and cause extra excavation in an area which does drain towards the lake. B) The lot is higher at the back and so if we move the garage lakeward 8 feet the slope on the south end of the garage will be much steeper, causing even more intense run off and possible erosion. 3) Several of our immediate neighbors to the west have garages and storage sheds placed within the right away and are actually closer to the road than our garage will be if permitted. 4) The road is a dead end road for local access only. It is not a busy roadway and there will be no more lots developed because all lots are already developed or sold on this road. Because of the way we place the garage, we will not need to back unto the roadway thus helping the safety factor. 5) Our immediate neighbor to the east, Mr. Kroshus, has been informed from the beginning of our plans and has no objections. Approximately 111' of Lot 7, Forest Lodge, would be attached to that portion of Lot £, Forest Lodge, that is currently owned by the applicants. The balance of Lot 7, Forest Lodge, apprc^xiinately 52.5', would remain attached to that portion of Lot S, Forest Lodge, that is currently owned by the applicants. Each parcel would have at least IBB' of frontage and 2B,003 square feet of area. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve the variance as requested. The property is described as Lots 8 and 9, Flemings Subdivision, Wall Lake in Aurdal Township. The audience was polled with no one speaking for or against the request. A note from the Aurdal Town Board stating that they had no objection to the variance request was read for the record. After consideration, motion was made by Randall Kann, seconded by Craig Anderson and unanimously carried, to approve a variance of 9' 8* from the required side lot line setback of 13' for a 13' 4’ by 22' 10" addition to an existing structure 4" from the side lot line. The addition will square off the existing structure. It was noted that when the original structure was constructed it was thought to be 10' from the adjacent property line, but when a recent survey was completed of a neighboring lot within the immediate area the applicant lost approximately IB' on one side of his lot and gained approximately 10' on the other side of of his lot.
