When we had our property surveyed last year we found out that the Northwest corner of our house was inadvertantly built 6.15 feet from the western lot line instead of the required 10 foot setback. The previous owners of our property are our neighbors to the east. This was a very well-groomed vacant lot. These previous owners and prior owners had maintained and mo'A'ed this vacant lot using the west lilac hedge as the west property line. Prior to building, we obtained a copy of the survey from the property owners to the west This survey indicated property markers at the north and south ends of the lilac hedge. The lilac hedge was about 12 high and about 230' lonc and appeared to run in a straight line. At the time we built our cottage, we positioned the NW corner 15 feet from the middle of the hedge. However, we have since found out that the lilac hedge has somewhat of a curve about in the middle (same place as our house is situated). The end result of the survey is that the property lines (both west and east property lines) shifted approximately tO' to the east from where our neighbors thought they were. Upon getting the survey results we were in contact with Tim Griep of the Shoreland Management Office and he suggested we bring this request to the Board forthe appropriate approval. We have attached copies of the following for your reference: 1) Copy of the survey 2) Copy of the survey with lilac hedge drawn in 3) Copy of the survey we obtained from neighbors to our west In order to properly evaluate the situation, please provide as much supplementary information as possible, such as: maps, plans, information about surrounding property, etc. APPLICANT SHALL BE PRESENT AT THE SCHEDULED HEARING. The property is described as part of Government Lot 4, Section 31 of Everts Township on South Turtle Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson, and unanimously carried, to approve a variance of 14' from the required ordinary high water level setback of 100' for the construction of a 14' by 22' screen porch 8&' from the ordinary high water level with the condition that there be no further development towards the ordinary high water level, the unique relationship of the lot to the lake the addition would be no closer to the lake than the structure to the east. It was noted that due to Hardships being a substandard lot of record, the unique shape of the lot and its relationship to the lake (diagonal). George tf. Hathison - Approved George W. After consideration, motion was made by John Everts, seconded by Leslie Estes, and unanimously carried, to approve the variance as requested with the following conditions: 1.) that the three parcels must be permanently attached to the lake lots, 2.) that these three newly subdivided lots cannot be used for residential dwellings, and 3. ) that a registered surveyor 's drawing must be provided at the time of recording.! It was noted that the variance became necessary after a survey was completed that indicated that the previously assumed lot line was not the actual lot line location.
