The^motion was.withdrawn after a ' discussion regarding possible excavation that might require Planning Commission approval. It was noted that the Board of Adjustment does not address excavation/dirt work and that grade'and fill decisions can be handled by ■ the^, office or, if necessary, the applicant may need to request a conditional use permit from the Planning Commission. After the additional discussion, motion was made by John Everts, seconded by Leslie Estes and carried with Craig Anderson and Cecil Femiing voting no, to approve a variance of 12' from the required west side lot line setback of 65' and a variance of 29' from the required east side lot line setback of 65' for the construction of an 8' by 8' changing room (water - oriented accessory structure), with a 12' by 12' roof, that will be used,.as a landing, with the condition that the structure cannot exceed 10' in height at the top of the 12' by 12' roof and with the condition that the structure will be at least 20' from the ordinary high water level. the placement of the structure in this location will not obstruct the view of the adjacent properties as it is below the sight line and this is the best locationion the property for a water - oriented accessory structure. Hardship being the terrain and topography of the applicant's property and the granting of the variance will allow the. applicant the ability to enjoy the same rights and privileges as his neighbors. The property is described as Lot 2, Birchwood Shores, Pickerel Lake in Maine Township. The audience was polled with no one speaking for or against the request. A letter in favor of the applicant’s request, from John and Joy Bach, was read for the record. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling, to approve a variance of 12' from the required west side lot line setback of 65’ and a variance of 29’ from the required east side lot line setback of 65’ for the construction of a 12’ by 12' landing, with an 8’ by 8’ changing room under the 12' by 12’ landing. After consideration, motion was made by Craig Anderson, seconded by Randall Mann, to approve the variance as requested by the applicant. After additional discussion, motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to table the variance request until the August 3rd, 1995, Board of Adjustment meeting, to allow an opportunity for all of the board members to veiw the applicant’s property.
