Motion was made by Cecil Femling, second by David Holmgren and unanimously carried, to approve the expansion of
the deck to the west subject to the condition that the existing deck cannot go any closer to the lake than its present
location, to approve the 4’ stain/vay on the east side of the present structure, to approve raising the roof of the existing
garage to accommodate the proposed second story addition and to approve the proposed 234 square foot addition to
the east side of the existing dwelling, which will provide a bathroom area, as well as, access to the second story.
Hardship is a substandard lot of record.

Charles and Phyllis Hulet - Denied
Charles and Phyllis Hulet, Fergus Falls, MN, requested a variance of 1’ from the maximum allov/able height of
a non-dwelling structure for the construction of a 30’ by 48’ post frame building having an overall height of 19’
with 14’ side walls to accommodate two 12’ by 12’ overhead doors. The property is described as part of
Government Lot 3, Section 3 of Dane Prairie Township by Wall Lake. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Cecil Femling, second by Frank
Lachowitzer to approve the variance as requested. The motion failed with David Holmgren, Randall Mann and
Mark Steuart voting no. It was noted that it was very difficult to find a legally accepted hardship.

David and Carol Willey, Plymouth, MN, requested a variance to enlarge an existing deck on the east and west
sides of the existing dwelling, a variance to raise the roof of an existing garage to accommodate a second story
for bedrooms and a variance for an addition of 234 square feet to the east side of the existing dwelling to
provide a bathroom area and to provide access to the second story bedrooms. It should be noted that the
closest point of the addition would be 84’ from the ordinary high water level and that the existing garage is
between 99 and 100’ from the ordinary high water level. The property is described as part of Lot 1, Block 1,
Birchwood Shores, Pickerel Lake in Maine Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Cecil Femling, second by David Holmgren and

Robert and Shirely Jensen - Denied as requested/Approved as modified.
Robert and Shirley Jensen, Fergus Falls, MN, requested a variance of 9’ from the required side lot line setback
of 10’ and a variance of 67’ from the required ordinary high water level setback of 100’ for the replacement of
an existing 6’ 9” by 9’ 9” storage shed with an 8’ by 14’ structure, containing a loft, T from the lot line and 33’
from the ordinary high water level. The property is described as Lot 31 of the Survey Lots of Government Lot
4, Section 34 of Tordenskjold Township by Stalker Lake. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Cecil Femling, second by Frank Lachowitzer
and unanimously carried, to deny the variance as requested as the proposed site being is not acceptable and
other alternatives requiring less variance should be considered. After additional consideration and discussion,
motion was made by Randall Mann, second by David Holmgren and unanimously carried, to approve the
placement of an 8’ by 14’ storage shed no closer to the ordinary high water level than the back of the
applicants’ dwelling, at least 6’ from the lot lines, at least 6’ from the drain field and at least 6’ from the holding
tank. Hardship is a substandard lot of record.

Dear Members;
The purpose of this letter is to request your consideration of our Application for Variance. The property
was built in 1971 and does not meet current shoreland requiremaits.
Carol and 1 purchased the property on Pickerel Lake in 1993 with the intention that it would be our family
vacation /retirement home. It has served us well, but after 30 years it does need new roofing, siding and
windows. Also time has passed and our family has grown. Our four children are now married and have
produced three grandchildren with a fourth on the way. We expect to have mwe grandchildren. To
accommodate our family visiting us during the year and on special occasions, we need to add a bathroom
and two bedrooms.
We originally understood that we could not build closer to the lake. We did believe that we could expand
into the space between the house and the garage as long as it did not interfere with the line of sight to the
lake for our neighbors.
We believe that we have two viable alternatives. One is to build a second story on the house. The other is to
put a second story on the garage. Since the garage is largely outside the setback and the house is fully
within the setback, putting the bedrooms above the garage and using the space between the house and
garage for the stairway and bathroom seems to be the best alternative. As well, this approach is agreeable to
our neighbors, George and Faye Hess. We hired an architect, prepared plans, found a builder and applied
for a building permit but have been instructed to gain a variance before the building permit will be granted.
We hope that you will visit the property to see first hand that this approach does not alter the essential
nature of the property, is dictated by the circumstances unique to the property and is in substantially
compliant with The Shweland Management Ordinance of Otter Tail County. We believe that the additional
investment that we are willing to make in this property is of benefit to the area and respectfully ask that you
grant our request.
