After discussion, motion was made by John Everts, to approve, hardship being a small, pre-ordinance lot of record, no better place on lot to build structure, appro val given by town board, no fire hazard being created because there is adequate space between proposed structure and neighbor's building, by Tom Stringer and carried. The motion was seconded -Russell Rulon, Decorah, lA, requested permission to build a garage between 11'3" and 15' from the road right-of-way, on Lot 7, 2nd Add'n to Haggstrom Beach, Maine Township.After discussion motion was made by Tom Stringer, to approve, hardship being no other practical location on lot, respecting the road authority of the town board who gave their approval, the terrain factor of the lot, cannot build any closer to the lake shore and septic system, would interfer with placing the garage at any other location on the lot. The motion was seconded by John Everts and carried with Craig Anderson voting "no". Leland Latham, Wetmore, KS, re-appeared after being granted permission to place a ’ from house, on the E^.vf Lot 5, Block 3, Crystal AFter placing the holding tank, Mr. Latham was in formed by the Land & Resource Management office the holding tank was 36 feet from holding tank 5' from lot line, 3 Lida Beaches, on June 2, 1983. his well, 14' closer than the required separation, and requested a variance for said 14' feet.After considerable discussion, motion was made by Tom Stringer to deny variance.no record to justify a variance and granting such a variance would subject the county to law suits.The motion was seconded by Craig Anderson and carried. Norman G. Wheeler, Dent, MN, requested permission to sell approximately seven or eight acres in G.L. 7, Section 29, Edna Township, retaining approximately 1% acres, without platting. After discussion, motion was made by George Halter, seconded by Frank Lachowitzer and carried, to table. Upon motion made by Hub Nordgren, seconded by Andy Leitch and carried. the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, some townships within Otter Tail County haveadopted and are enforcing zoning ordinance which may be, in some cases, more restrictive than requirements set forth in the Otter Tail County Shoreland Management Ordinance or the Subdivision Controls Ordinance; and WHEREAS, the Otter Tail County Board of Adjustment is obligated to send notices and conduct hearings regarding applications for variances and thereby incurs expenditures of time and money; and WHEREAS, applications for variance are subject to action by the appropriate Town Board; and' WHEREAS, the applicants themeselves have certain expenditures re sulting from the variance procedures, , 'NOW, THEREFORE, BE IT RESOLVED, that approval by the Town Board of Supervisors in the appropriate Township'must be obtained on all applications for variance before such applications are submitted to the Otter Tail County Board of Adjustment. it Fergus Falls, Minnesota this 6th day of April, 1SB3.Dat Chairman ATTEST: df . •/e Cl erk
