(8:00 p.m.) After discussion and consideration, Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve a variance to subdivide, by metes and bounds description, an existing 1.38 acres parcel as depicted in the drawing submitted with the variance application with the following conditions: 1.) the area in the back lots cannot be used when determining impervious surface coverage for front lot development, 2.) a registered surveyor’s drawing must be provided and 3.) the two metes and bounds back lot parcels created out of the 1.38-acre parcel must be permanently attached to Lots 5, 6 and 7 of Haggstrom Beach Second Addition as described in the variance application dated May 5, 2004. (8:00 p.m.) Russell and Joan Rulon, Et Al, part of Government Lot 6, Section 12 of Maine Township by Pickerel Lake, requested the following: 1.) to sell a substandard parcel of land to Dennis Delzer from Government Lot 6-D containing 1.38 acres (60,298 square feet), 2.) to describe the parcel with a metes and bounds description as 75’ on North, 165’ on East, 62’ on South and 171.8’ on West. This parcel will be attached to Lot 5 and is 11,535 square feet, 3.) to described the remaining Government Lot 6-D to be substandard, but attached to Lots 6 and 7 as it is now. Note; Lots to be used for sewer system drain field and garage. Survey work by David Anderson Land Surveying, Inc., Fergus Falls, MN. Dennis and Sandra Delzer appeared along with the applicants at the public hearing. Chairman Mann polled the audience with no one speaking for or against the variance as requested. An email from Larry A Berget and a letter from Armin Pipho in support of the variance as requested were read for the record. Gregory L and Sharon L Bohnert - Approved the variance as requested. (8:05 p.m.) Gregory L and Sharon L Bohnert, Lot 16 North Point Beach, West Battle Lake in Girard Township, requested the following; We want to remodel our existing lake property. The existing building starts 65-72 feet from the high water mark. The proposed remodel includes a new addition starting 90-95 feet from the high water mark. Per our architect, contractor and lumber company, we need to replace the existing roof to accommodate this remodel and comply with current state building codes. The first 5-10 feet of the existing and proposed new roof is within 65-72 feet of the ordinary high water mark versus the minimum 75-foot requirement. We are requesting a variance from the 75-foot minimum requirement to replace the existing roof in order to accommodate the remodeling. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, seconded by Joe Maske and unanimously earned, to approve the variance as described in the variance application dated May 6, 2004 and as depicted in the drawing submitted with the application. The Board noted that the proposed addition is to the rear of the existing structure and that the change in the roof design will not place the structure any closer to the ordinary high water level than it presently is located. The Board also noted that the granting of the variance as requested does not allow the applicants to cover more than 25% of their total lot area with impervious surfaces. David S Nyhus - Approved as modified with a condition. (8:08 p.m.) David S Nyhus, Lot 9 Linden Park, East Battle Lake in Girard Township, requested a variance of 5' from the required side lot line setback of 10’ for the placement of a 28’ wide structure 5’ from the side lot lines. Chairman Mann polled the audience with no one speaking for or against the variance as requested. Letters from the following in support of the variance as requested were read for the record; David and Barbara Warstler, Linda Nyhus, Ruth Brown, Linda Moore, Herman Wilson, Leonard Jirik, Ranee and Lisa Brendefur, Patricia Saxvik and Douglas Kramer. After discussion and consideration, Cecil Femling made a motion, seconded by Paul Larson and carried with Joe Maske and Steve Schierer voting no, to approve a variance of 2’ from the required side lot line setback of 10’ for the placement of a dwelling 8’ from the side lot lines with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. The Board noted that the variance as approved would provide the applicant with a reasonable use of his property. Hardship is a substandard lot of record. \ o i) \ %
