After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and there is a water - oriented accessory structure already located on this property. Arnold Dennis and Margie Kay Mickelson - Denied Arnold Dennis and Margie Kay Mickelson, Bloomington, MN, requested a variance of 5’ from the required side lot line setback of 10’ for the constmction of a 28’ by 32’ garage 5' from the side lot line. The property is described as Lot 18, except a strip on the easterly side 20’ at the lake and 15’ at the road, Birchwood Shores, Pickerel Lake in Maine Township. Pete Pedersen, Contractor, represented the applicants at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann to approve the variance as requested. After additional discussion the motion to approve was withdrawn. After additional consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and other alternatives appear to exist. It was noted that granting this variance request would not improve the current situation. Bryan Wayne Zepper - Approved Bryan Wayne Zepper, Perham, MN, requested a variance of 6’ from the required side lot line setback of 10’ for the placement of a garage 4’ from the side lot line. The property is described as Lot 4 and part of Lot 5, Bunny Beach, Big Pine Lake in Pine Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a 3’ variance from the required side lot line setback of 10’ and a 3’ variance from the required drain field setback of 10’ for the placement of a garage 7’ from the side lot line and 7’ from the drain field. The granting of the variance allows the applicant to enjoy the same rights and privileges as the adjacent neighbor. Bradley A. Latzke and Kathy J. Love - Approved Bradley A. Latzke and Kathy J. Love, Alexandria, MN, requested a variance of 2’ from the required 3’ vertical separation of the lowest floor in the structure from the ordinary high water level for the construction of a dwelling, with a crawl space, having a T vertical separation between the lowest floor of the structure and the ordinary high water level. The property is described as Lot 14, North Point Beach, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Robert Schwartz and carried with John Everts abstaining and with George Walter voting no, to allow the applicants to use a measurement 3’ above the current water table or 3’ above the ordinary high water level which ever is determined to be to the applicants advantage. The measurement is to be determined by the Land and Resource Management Department. It was noted that this method of measurement was used prior to 1992 on this lake and allowing the applicants to use these measurement methods will enable them to enjoy the same rights and privileges as the neighbors in the immediate area.
