Dear Dr. Bjerke:
Your letter of September 14th addressed to the Department of Land Resource ''ananement
has been turned over to this office for reply.
There is a provision in the Statutes that allows for an appeal procedure, but the appeal
is not to the Board of Adjustment. An appeal must be filed in District Court within
thirty days of the denial, so if if is your desire to apoeal the decision of the Board
of adjustment, your attorney should file the appeal by October 7, I'^SR.

appeal and if so, if I could have a copy of transcript of my
portion of the hearing and also a list of, the applicants that have been turned down on North Shore Qttf^rlflil to determine whether
this was on a pre-existing structure that they applied for a
variance or whether this was a new structure.

Dale L. Schneider, Dent, MN, requested permission to build garage,
including overhang, within 3' of access road lot line, on the S 281'
of SL F, and the S 281' of West 25’ of S.L E of G.L. 5, Section 28,
Edna Township.
consideration, motion was made by Carl Johnson, seconded by Craig
Anderson and unanimously carried, to grant permission, hardship
being substandard lot of record, and the most logical spot on
property to place garage due tq terrain of land.
Erwin Beilke, Fargo, ND, requested permission to construct addition
to existing garage, 2' from side lot line, 2'. from road right-of-way,
on Lot #5, of Matson Survey Lots of G.L. 2 & 3, Section 28, Maple
wood and Lida Townships on Lake Lida.
After consideration, motion was made by Cecil Femling, seconded by
Carl Johnson and unanimously carried, to grant approval, hardship
being least disturbance to lot, vfith no snow removal problems.
Kenneth Yanke, Frazee, MN, reqiaested permission to build with corner
of garage within 28' of road right-of-way, on Pt. Lots 5 & 6, Section
19, Hobart Township on Long Lake. After consideration, motion was
made by Craig Anderson, seconded by Cecil Femling and unanimously
carried, to grant approval, hardship being low terrain at the required
set-back.

porch on top of existing boathouse, 30' from water's edge of Pickeral
Lake, on Lots 7 i 8, Moore's Beach, Maine Township. After considera
tion, motion was made by Craig Anderson, seconded by Cecil Femling
and unanimously carried, to deny, no adequate hardship shown for
further encroachment onto lake.

Dean Johnson, West Faroo, ND, requested permission to construct
dwelling approximately 10' in front of building line, about 110'
from ordinary high water mark of Dead Lake, in G.L. 3, Section 34,
Dead Lake Township.
Anderson, seconded by Carl JOhnson and unanimously carried, to approve
utilization of the "string line" test, a line run between the adjacent
cabin, to the approved building set-back of the property on the oppo
site side, and no closer, on the condition the 16' x 20' cabin be
removed.

After consideration, motion was made by Craig
Marvin R. Wagner, Maple Grove, MN, requestes permission to construct
building 10' from road and 2' from neighbor's line, on Lot 1, of
Arbor Lane, on West Leaf Lake, Section 21 of Leaf Lake Township.
Letters received were read. After consideration, motion was. iMde by
Cecil Femling, seconded by Craig Anderson and unanimously carried,
to approve, hardship being substandard lot of record.
Jacquelyn Johanson, request tabled from the August meeting was again
tabled upon motion made by Craig Anderson, seconded by Carl Johnson
and unanimously carried.

John D. Fredrickson, Lino Lakes, MN, request tabled from the August
meeting was brought up for final action. Motion was made by John
Everts, seconded by Cecil Femling and unanimously carried, to deny,
no adequate hardship shown, allowing until January 1 , 1990 to remove
building in question.
Larry D. Nielson, Lakeview Resort, Pelican Rapids, MN, request tabled
from the August meeting was brought up for final action. Motion was
made by Craig Anderson, seconded by Cecil Femling and unanimously
carried, to approve the side lot variance on the west property line,
with the garage being placed 24' from CSAH #4, hardship being best
spot on property for garage.
