Duane E. Johnson - Approved the variance as requested with conditions. (7:38 p.m.)
After discussion and consideration, Michael Harris made a motion, second by Steve Schierer and unanimously
carried, to approve a variance to split four substandard contiguous back lots for the purpose of permanently attaching
these lots to adjacent lake lots as stated in the variance application and as depicted on the drawing submitted with the
variance application with the following conditions: 1) the area contained within the back lots cannot be used when
calculating impervious surface coverage for front lot development and 2) the back lots can only be used for
nonresidential purposes (no dwellings).

Duane E. Johnson, Lots 3, 4, 5 and 6 Block 2 Haggstrom’s Beach Addition, Pickeral Lake in Maine
Township, requested a variance to split four substandard contiguous back lots for the purpose of
permanently attaching these lots to adjacent lake lots. Lots 3 and 4 Block 2 would be attached to Parcel
No. 38-000-99-0385-000 and Lots 5 and 6 Block 2 would be attached to Parcel No. 38-000-99-0312-000.
DeLair Weller appeared with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Michael Harris
made a motion, second by Steve Schierer and unanimously carried, to approve a variance to split four
substandard contiguous back lots for the purpose of permanently attaching these lots to adjacent lake lots
as stated in the variance application and as depicted on the drawing submitted with the variance
application with the following conditions: 1) the area contained within the back lots cannot be used when
calculating impervious surface coverage for front lot development and 2) the back lots can only be used for
nonresidential purposes (no dwellings).
Richard E. and Nancy K. Christenson - Denied. (7:44 p.m.)
Richard E. and Nancy K. Christenson, Lot 7 Silver View Park, First Silver Lake in Everts Township
requested the following; a variance of 18’ from the required 20’ setback from the N. Silver Lake Road right-
of-way and a variance to permit the placement of a 14’ by 24’ garage 8’ from the regularly traveled portion
of Silver Lake Trail. The audience was polled with no one speaking for or against the variance as
requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris and
unanimously carried, to deny the variance as requested as no adequate hardship unique to the property
had been shown that would allow for the granting of the variance as requested. Members of the Board of
Adjustment also noted the two road right-of-ways and terrain features has reasons for denying the variance
as requested.
Martin L. Toso - Denied the variance as requested and then a motion to table was offered to grant
the applicant an opportunity to consider other alternatives. (7:50 p.m.)
Martin L. Toso, part of Government Lot 1, Section 14 of Pelican Township by Prairie Lake, requested the
following: to replace a portion of existing dwelling that is 22’ from the ordinary high water level with new,
construct a 26’ by 7’ addition to dwelling at 52’ from the ordinary high water level and construct a new roof
over all of the new construction and the remainder of the original dwelling. Dennis Ouren, Contractor,
appeared with the applicant at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Michael Harris made a motion,
second by Carl Zick to approve the variance as requested. This motion failed with Paul Larson, Randall
Mann and Steve Schierer voting no. The motion to approve failed; therefore, the variance request was
denied. Those voting in favor of this motion noted that the proposed development would be no closer to
the ordinary high water level then the existing development. After additional discussion and consideration,
Steve Schierer made a motion, second by Randall Mann to approve a variance of 60’ from the required
ordinary high water level setback of 100’ for the replacement of the mobile home at least 40’ from the
ordinary high water level and any new addition to equal the 17’ by 18’ area must go to the back of this area.
After further discussion and consideration this motion was withdrawn. At this time a motion was made by
Randall Mann, second by Steve Schierer and unanimously carried, to table this discussion until the May 3,
2007 Board of Adjustment meeting to allow the applicant an opportunity to consider other alternatives. It is
important to note that the Board of Adjustment did consider the applicant’s original request and did act
upon that request in a timely manner and that the action to table is not an action affecting the original
request, but rather an opportunity for the applicant to submit another proposal for consideration.
