(6:50 p.m.) William and Karen Rohrich, Lots 1 and 112 Nedberg-Nye Survey Lots of Government Lots 1, 2 and 3, Section 1 of Edna Township by Devils Lake, requested the following; Replace west structure on the same footprint being 41’ from building to riprap on the north and 15’ from the road right-of-way on the south. Raise the east/west footing one foot with over all building height of 30’ above the ordinary high water level and 26’ above the foundation. Center building will be removed and not replaced. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Michael Harris made a motion, seconded by Steve Schierer and unanimously carried, to approve the proposed development as described in the variance application dated July 30, 2012 with the understanding that the approval allows the applicants to raise the footings to a height that will meet the 3’ vertical separation requirement as stated in the ordinance. It should be noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. Jeanene L. Oevilbiss - The variance application was approved as requested. (6:58 p.m.) Jeanene L. Devilbiss, part of Government Lot 2, Section 29 of Everts Township by Elbow Lake, requested the following: As the described property is a big hill we would like to put a new structure on top of the hill. So that we will do the least amount of deforestation, maintain the natural watershed to avoid land erosion and do the least grading and filling as possible. The site is 35 to 40’ above ordinary high water level. Plan A: requesting a variance of 43’ from required 200’ setback. Plan B: requesting a variance of 25’ from required 200’ setback. The applicant’s fianc6 was also in attendance. The audience was polled with Steve Morrill speaking for the variance as requested. After discussion and consideration, Randall Mann made a motion, seconded by Thomas Lee and unanimously carried, to approve (Plan A) a variance of 43’ from the required ordinary high water level setback of 200’ for the placement of the proposed new structure 157’ from the ordinary high water level as depicted on the drawing submitted with the application.
