Foss - Tabled Earl E. Foss, Ottertail, MN, requested the variances necessary for the following: 1. To allow units 7 and 8 to remain in their present location, 2. To allow the addition of an 8’ by 12’ screened in porch to unit 7, 3. To remodel an existing tool shed and fish cleaning house into a single structure, 4. To construct a 24’ by 50’ dwelling, and 5. To allow the addition of 10 new campsites. It should be noted that unit 7 already has an existing 8’ by 12’ deck and that the new dwelling would contain a stomn shelter for resort patrons. The applicant would require a variance to increase the density of the existing resort, a variance to place units within the 50’ buffer zone and a variance for the location of the tool shed and fish cleaning house. The property is described as part of Sub Lots 5 and 6 of Government Lots 3 and 4, Section 23 of Rush Lake Township by Rush Lake. The audience was polled with no one speaking for or against the request. Letters from the following in favor of the applicant’s request were read for the record: Marlyn Hennen, Tim and Heidi Lanbertson and Mel Johnson, President of the Rush Lake Association, Inc. After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve the remodeling of the existing tool shed and fish cleaning house into a single structure with the condition that it be located at least 20’ from the side lot line. After additional consideration, motion was made by Randall Mann seconded by Cecil Femling and unanimously carried, to table action on request #’s 1, 2, 4 and 5 until the August 1st, 1996, meeting for additional information, guidance and for recommendations/suggestions from the Land and Resource Department. James Patrick Donahue - Approved James Patrick Donahue, Fergus Falls, MN, requested a variance of 36.5’ from the required ordinary high water level setback of 100’ for the construction of a dwelling 63.5’ from the ordinary high water level. If the variance is granted the applicant’s proposed dwelling would be in line with the dwelling located on Lot 9 and with the dwelling located on Lot 12. The property is described as Lot 11, Shaffer’s Beach, Pickeral Lake in Maine Township. The audience was polled with no one speaking for or against the request. A letter from Noell and MerrII Reinhiller opposing the granting of the variance request was read for the record. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and carried with George Walter voting no, to approve construction of a dwelling up to the string line as detemined by using the existing dwelling on Lot 9 and Lot 12. It was noted that this will place the applicant’s proposed dwelling in line with the dwellings on Lot 9 and Lot 12. William Jacque - Withdrawn William Jacque, Moorhead, MN, requested a variance of 30’ from the required side lot line setback of 40’ and a variance of 2’ from the required maximum height of 10’ for the construction of a 12’ by 14’ screened porch 10’ from the side lot line, approximately 30 to 40’ from the ordinary high water level and having a height of 12’. The property is described as Lot 2, Hughes Addition, Star Lake in Star Lake Township. Prior to the scheduled public hearing the applicant had stated that he wanted to withdraw his variance application. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to accept the applicant’s request and to refund a portion of the application fee. Kenneth Strandberg - Approved Kenneth Strandberg, Fargo, ND, requested a variance of 18’ from the required ordinary high water level setback of 100’ for the placement of an existing double wide mobile home 82’ from the ordinary high water level. The property is described as Lot 14, Cousin’s Beach, Big McDonald Lake in Dora Township. The audience was polled with no one speaking for or against the request. Letters from the following individuals in favor of the applicant’s request were read for the record: Dave and JoAnn Satter, John and Diane Rogne, Kent and Carol Meader, Darrell and Patricia Warne and Duane Noraker. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance of 18’ from the required ordinary high water level setback of 100’ for the placement of an existing double wide mobile home 82’ from the ordinary high water level with the condition that the Land and Resource Department must agree with Mr. Strandberg that a previously placed structure in this same location was setback 100’, as stated on that site permit, from the ordinary high water level and that the loss of distance from the ordinary high water level, as stated on that site permit, has resulted from erosion and high water.
