Gerald Miller, Underwood, MN, requested a variance of 9’ from the required road right-of-way setback
of 20’ for the location of a 24’ by 30’ garage 11’ from the road right-of-way. The property is described
as all of Sublot 6 and part of Sublot 1, Section 35 of Maine Township by Leon Lake. A letter from the
Otter Tail County Highway Department noting no problems with the applicant’s request was read for the
record. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Cecil Femling, second by Robert Schwartz and unanimously carried, to approve a
variance of 9’ from the required road right-of-way setback of 20’ for the location of a 24’ by 30’ garage
11 ’ from the road right-of-way. Hardship is the terrain of the applicant’s property.
Gerald Peterson - Approved
Gerald Peterson, Fergus Falls, MN, requested a variance of 1.4’ from the 18’ maximum allowable
height of a non-dwelling structure for the construction of 36’ by 48’ pole shed having an overall height of
19.4’. The property is described as the East 716.65’ of the North 508.2’ of the Northeast Quarter North
of Highway 210, Section 5 of Dane Prairie Township by the Otter Tail River. The audience was polled
with.no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, second by Roberts Schwartz and unanimously carried, to approve a variance of 1.4’ from the
18’ maximum allowable height of a non-dwelling structure for the construction of a 36’ by 48’ pole shed
having an overall height of 19.4’. It was noted that only a small part of the structure is within the
County’s jurisdiction and the added height does not restrict the view from the adjacent properties due to
the terrain features in the immediate area. The Chair also directed that a letter should be sent to the
contractor advising them of the height requirements.
Glen and Keith Freeland - Approved
Glen and Keith Freeland, Cummings, ND, requested a variance to subdivide a 5.6-acre parcel into two
metes and bounds parcel of less than 5 acres. One parcel would be approximately 2.74 acres and the
other parcel would be approximately 2.86 acres. The applicants request that you allow the sale of the
■following tracts without platting, to the following parties who will be building new homes. Lot L
approximately 2.74 acres to Mark and Julie Argali. Lot K approximately 2.86 acres along with platted
Lot 9, which has 1.67 acres, to Scott and Roxie Malmstrom. It should be noted that Lots K and L were
surveyed 15 years ago, but were not platted nor recorded, a dedicated public road was built into the
area when the river lots were platted, the wetland on Parcel L is not significant in size allowing
adequate room for building a home and septic system and Parcel K will be added to Lot 9, Block 1 of
Ridgewood Estates providing adequate area for a dwelling and septic system. The property is
described as part of the West Half of the Southeast Quarter, Section 32 of Aurdal Township by the
QtterTail River. The audience was polled with Verlyn Menze to speaking the request. After
consideration, motion was made by Randall Mann, seconded by Roberts Schwartz and unanimously
carried, to approve the variance was requested noting that each parcel has access to a public road and
each parcel has room for two on-site septic systems with the condition that a registered surveyor’s
drawing must be provided at the time of recording. It was noted that the granting of the variance meets
the intent of the ordinance.

Dear Mr. Miller,
After our onsite discussion of December 8, 1998,1 checked with the Highway
Department to verify the road right-of-way in front of your lot.
According to the Highway Department’s records, it is a 50 foot right-of-way. This
would place your garage only 11 feet from the right-of-way, 9 feet short of the
required 20 foot setback.
Please contact me by December 17, 1998 regarding this matter.
