Rogness, Chair Phelps Mill Park Fishing Pier Public Works Director, Rick West presented a proposal from the Lake Country Sportsmen Club of Otter Tail Lake/Amor to donate and install a fishing pier at the Phelps Mill County Park. Mr. West provided a photo of the proposed pier and two potential locations. Commissioners discussed responsibility for putting the pier in and out (spring and fall) and questioned whether or not the pier was on wheels. Motion by Froemming, second by Johnson, and unanimously carried to support the concept and authorize the Public Works Director to continue discussions with the Sportsmen’s Club regarding long term service requirements for the donation. Mr. West will return to thp Board for formal acceptance of the gift. Motion by Lindquist, second by Huebsch, and urtanimously carried to authorize the appropriate County Officials’ signatures to execute a Contract for Seasqnal Supply of Salt between the County of Otter Tail and L & O Acres Transport, Inc. of Westport, SD, contingent upon the approval of the County Attorney. Limited Area Star Lake Corriorehensive Plan Mr. West discussed the need for an addendum to the SRF Lirhi^ed Area Star Lake Comprehensive Plan to increase the contract amount about $18,0b0 due to an expandedecope of work involving design as well as short and long term solutions. Chairman Rogness declared the County Board meeting open for public comments regarding a permit application for expansion of Tollerud Farms,' LLC located at 37541 150*’ Ave, Rothsay, MN. The public meeting is being held according to M.S. 116.07, Subd. 7(1). The MN Pollution Control Agency (PCA) is responsible for issuing a permit for the dairy operation? Jhe County provides a local forum for the public to express their opinions regarding the project. Travis Tollerud explained the specifics of the expansion. No one from the public was present for this agenda item and no written comments were received on the proposed project. Commissioners expressed their support for this expansion of dairy agriculture which is a core component of Otter Tail County’s economy. The public meeting was closed at 9:11 a.m. V Developmental Disabilities Service Report Human Services Director, Deb Sjostrom and DD Staff submitted a document titled “Developmental Disabilities Annual Report - 2015 Overview”. Discussion took place regarding case load, services, and funding. , Human Services Fiscal Quarteriv Report Deb Sjostrom presented the Human Service Financial Report for January 1, 2016 through June 30, 2016. Total expenses were reported at 53% of budget and revenues at 49% of budget. The VCAA grant and Child Protection allocation will be received in July. Ms. Sjostrom discussed Out of Home placement and Mental Health State Operated Services as a concern for increasing expense for the County. This permit is permissive only and shall not release the permittee from any liability or obligation imposed by Minnesota Statutes, Federal Law or local ordinances relating thereto and shall remain in force subject to all conditions and limitations now or hereafter imposed by law. 2. This permit is not assignable except with the written consent of the Commissioner of Natural Resources. 3. The Regional Hydrologist shall be notified at least five days in advance of the commencement of the work authorized hereunder and shall be notified of its completion within five days thereafter. The Notice of Permit issued by the Commissioner shall be kept securely posted in a conspicuous place at the site of operations. 4. No change shall be made, without written permission previously obtained from the Commissioner of Natural Resources, in the dimensions, capacity or location of any items of work authorized hereunder. 5. The permittee shall grant access to the site at all reasonable times during and after construction to authorized representatives of the Commissioner of Natural Resources for inspection of the work authorized hereunder. 6. This Permit may be terminated by the Commissioner of Natural Resources at any time he deems it necessary for the conservation of water resources of the state, or in the interest of public health and welfare, or for violation of any of the provisions of this permit, unless otherwise provided in the Special Provisions. 7. Construction work authorized under this permit shall be completed on or before date specified above. Upon written request to the Commissioner by the Permittee, stating the reason therefore, an extension of time may be obtained. 8. The excavation of soil authorized herein shail not be construed to include the removal of organic matter (as indicated above) unless the area from which such organic matter is removed, is impervious, or is sealed by the application of bentonite after excavation. 9. In all cases where the doing by the permittee of anything authorized by this permit shall involve the taking, using, or damaging of any property rights or interests of any other person or persons, or of any publicly owned lands or improvements thereon or interests therein, the permittee, before proceeding therewith, shall obtain the written consent of all persons, agencies, or authorities concerned, and shall acquire all property, rights and interests necessary therefore. 10. This permit is permissive only. No liability shall be imposed by the State of Minnesota or any of its officers, agents or employees, officially or personally, on account of the granting hereof or on account of any damage to any person or property resulting from any act or omission of the permittee or any of its agents, employees, or contractors relating to any matter hereunder. This permit shall not be construed as estopping or limiting any legal claims or right of action of any person other than the state against the perrhittee, its agents,employees, or contractors, for any damage or injury resulting from any such act or omission, or as estopping or limiting any legal claim or right of action of the state against the permittee, its agents, employees, or contractors for violation of or failure to comply with the permit or applicable provisions of law. 11. No material excavated by authority of this permit nor material from any other source, except as specified herein, shall be placed on any portion of the bed of said waters which lies below (as indicated above). 12. Any extension of the surface of said waters resulting from work authorized by this permit shall become protected waters and left open and unobstructed for use by the public. 13. This permit does not obviate any requirement for federal assent from the U.S. Army Corps of Engineers, 1421 U.S. Post Office and Custom House, St. Paul, Minnesota 55101-9808. P.A. 89-1219 Page 2 of 4 SPECIAL PROVISIONS 1.COMPLIANCE WITH OTHER LAWS: The permittee shall comply with all rules, regulations, requirements, or standards of any applicable federal, state, or local agencies, including, but not limited to the U.S. Army Corps of Engineers, Board of Water and Soil Resources, MN Pollution Control Agency, watershed districts, water management organizations, county, city, and township zoning. 2.SPOIL MATERIALS: Spoil material shall not be placed on the beds of protected waters, within wetland areas, or in areas subject to flooding or runoff into protected waters. Spoil deposition may also require approval from other units of government. 3.EROSION PROTECTION: The Permittee shall cover or protect all exposed soU resulting from the authorized construction by placing riprap, sod, and/or seed on banks and slopes of said construction area to prevent erosion and siltation of the water basin/watercourse. The use of a sUt fence, bales, and/or mulch is required to control temporary erosion problems. No trees or brush shall be allowed to grow on the dam. 4.RESTORING BED: Upon completion of construction, the bed of the protected water shall be restored as nearly as practical to the original cross-section. 5.QUALITY CONTROL: The Permittee, in cooperation with the designer, shall be responsible for inspection and quality control to ensure the work is completed according to the approved plans and specifications. 6.OPERATION AND MAINTENANCE: Maintenance and operation of the dam in a safe and sound condition shall be the responsibility of the Permittee. Stoplogs shall be installed to maintain a crest elevation of 1316.3. In the event Otter Tail County desires a change in this runout elevation, they shall maintain a written record of changes made in the crest elevation. The written record shall be submitted to the Area Hydrologist in Fergus Falls at the end of each March, June, September and December. 7.BENCHMARK: A permanent bench mark shall be established and maintained in the natural ground adjacent to the dam. The bench mark must be based upon USGS datum. The Permittee shall, within 60 days of completion of construction, submit to the Division of Waters the bench mark information, plotted on a project site map. A permanent staff gage shall be installed on the face of the dam and tied into the bench mark. P.A. 89-1219 Page 3 of 4 8.HAZARD CLASSIFICATION: Based on the information submitted, the dam is classified by the Minnesota Department of Natural Resources as a Class 3 (low hazardl dam and the design was reviewed with respect to that classification. 9.CONSTRUCTION REPORT: Within 60 days following the completion of construction, the Permittee shall submit a Construction Report to the Division of Waters, including a statement of the professional engineer in charge of construction inspection that the dam was completed in accordance with the approved designs, plans and specifications. The report shall also include a construction summary, quality control tests and summary, as-built drawings with changes clearly marked, final cost summary, listing of contractors, bench mark infonnation and descriptive photographic record of major construction stages. 10.CONSTRUCTION IMPACTS: The Permittee shall take necessary precautions to minimize adverse environmental impacts resulting from construction activities. Details of diversions, dewatering, water level and streamflow manipulations, cofferdams, fills, and construction scheduling shall be submitted to the Division of Waters for approval before the start of construction. All debris and scrap materials resulting from the construction shall be completely removed from the construction area. 11.COORDINATION: The Permittee shall ensure that the contractor has received and thoroughly understands all provisions of this permit. Permittee shall inform the Division of Waters of preconstruction meetings with contractors. 12.EFFECTIVE DATE: This permit shall become effective on the date it is signed by the Director of the Division of Waters, Minnesota Department of Natural Resources. Enclosed with this permit is a Notice of Permit Card. The work authorized herein shall not be commenced until the Notice of Permit Card and a copy of this permit have been clearly posted at or near the construction site. SEEDING: In the event the site cannot be stabilized with vegetation before September 15, aU exposed soil shall be adequately mulched at a rate of not less than 3500 lbs./acre leaving no more than 20% visible soil surface and maintained until seeding/sodding can be achieved. 13.
