dwelling on Lot 8, Evander's Beach, Eagle Lake Township, on existing building line,
approximately 59' from high water mark. After discussion, motion was made by John
Everts to approve variance, hardship being a substandard lot, contingent upon
building being no closer to lake than neighbors on either side, 10' from lot line,
also grant variance from road right-of-way, to be able to enjoy same rights and
privileges as neighbors. The motion was seconded by Craig Anderson. Motion was
tiien made by George Walter, to table until the December 2nd meeting, for further
notice relative to the road right-of-way variance, as that portion was not addressed
on the application for variance. The motion was seconded by Craig Anderson and
carried.

I write this letter in my own behalf and in behalf of those who I
mention. I expect it will be presented to you this evening at your
meeting by my partner Stephen F. Rufer who speaks in behalf of all of
us.
Those whose names I mention in this letter join me in opposing the
request of Mr. Berger requesting a variance on property on West Lost
Lake which you will be considering this evening,

written you in her behalf by separate letter,
sheriff's certificate of sale and a Minnesota State tax deed to the
property immediately to the west of that which Mr. Berger is concerned
about.Immediately to the north Harvey Grasshoff owns a substantial
section of lakeshore. Next, I own a similar section. Ray Kovyalski and
Mrs. Kowalski's grandson, Keith Stempfley own the remaining property
to the Waterstreet bridge. Coming around the lake, Vernon Rollag and
his family members own the property to the east and south of the
bridge. Next, Mr. Charles McElevy of Seattle, Washington, with whom
I am in close contact and to whom I spoke with last evening owns
substantial property, I believe nearly down to that owned by
Mrs. Plowman at the inlet of the river into the lake.
As you can see, between us we own most of the lakeshore on the north
body of water. We believe it is very important that West Lost Lake
remain a natural environment lake. That is consistent with the fact of
both the water and the surrounding vegetation. West Lost Lake is a
fragile lake which was well established years ago in a hearing before
the Division of Waters of the Department of Natural Resources of the
State of Minnesota when someone else attempted to do a development on
the very property which Mr. Berger now proposes to develop. For the

preservation of the value of this lake which is an important part of the
Otter Tail River system, natural environment standards should be
rigorously maintained.

Dear Board Members:
This office has reviewed the application of Robert S. Berger for a variance of
100 feet for a building setback for approximately 12 metes and bounds tracts.
It is my understanding that there are no existing lots or tracts of record exist
ing prior to the enactment of the shoreland management ordinance. Thtis, it appears
the applicant is atteii5)ting to create the conditions, by platting, which would re
quire a variance request.
Chapter 394.27 Subd. 7 addresses the issue at hand under the definition of hard
ship . It says:
Hardship as used in connection with granting of a variance means . .
the plight of the landowner is due to circumstances unique to his property
not created by the landowner;

It further states;
Economic considerations alone shall not constitute a hardship if a
reasonable use for the property exists under the terms of the ordinance.
The applicant is proposing to create conditions on his property which would be
necessary to request a variance. He should not be allowed to create those con
ditions, or granted a variance to further substandard conditions. The variance
if granted would alter the essential character of the locality. This is contrary
to the statute also.
Additionally, I would assume he is not proposing to build on each of the 12 metes
and bounds tracts he is proposing. He is apparently requesting a wholesale vari
ance to in^jrove the salability of the lots. This is contrary to the intent of a
variance. Additionally, suitability of this property for development is very
questionable, both for building sites and sewage disposal.

Thus, it is the opinion of this office that granting of this variance is contrary
to the general purposes and intent of the shoreland management ordinance, and
would be in^roper for the reasons as discussed above.

FOR THE RECORD
The purpose? of this letter is to urge denial of the variance request
of Robert S, Berger on West Lost Lake, Lake No. 56-481, Section 32,
Tvjp. 134> Range 41 > Maine Tv/p,, for the follovding reasons:;
The Txnsuitability of this property for development has been
acknowledgedi by previous county decisions.
1.
It is? not practical, reasonable, or aesthetically desirable
to allo\iT a concentration of buildings, roads?, power lines,
sevrage systems, and water supplies in a narrow atrip down the
center of this peninsula.
2.
3.The 200 foot building setback should not be reduced as that,
action would effectively void West Lost Lake’s classification
as? a natural environment, lake'.
There does not appear to be' any suitable locations for on-site?
sewage disposal on this? property due to the? 150 foot setback
requirement, the probable? location of the' water table, and the-
existence of a hard packed road down the- center of the penin
sula.

There is no provision for a public road' in this proposed sub
division and there would not be. space left in viiich to contstruct
one. The toijnship would undoubtedly be petitioned to maintain
the existing private? road at considerable? expense sometime in
the future.

6.This: subdivision by metes and bounds is? essentially a. method of
circumventing the requirements for a platted subdivision.
There is no case for unnecessary hardship in this variance re
quest, as the? property was recently purchased as. one parcel un
der a shoreland management oi^inance the? existence of i^ch has;
been common knowledge? for years.

sheriff's certificate of sale and a state deed to Government
Lots 2, 3 and 4 of Section 32 of Township 134 North, Range 41
West (Maine). We are aware of an application for variance
which has been made by Mr. Robert S. Berger respecting this
property. The Board of Adjustment has noticed a hearing on
this variance application for November 4, 1982 at 7:00 p.m.
We will be present in Mrs. Zimmerman's behalf to oppose this
variance. Mr. Berger is seeking a variance for land which he
does not own and cannot own at this time.
Zimmerman has legal title to the land subject to the right of
Mr. Allen Knutson to redeem from the sheriff's certificate of
sale if he does so according to law. Mrs. Zimmerman opposes
the granting of any variance to this property and, unless and
until she is paid that to which she is entitled respecting
the property, she will be the legal owner of the property.
We do not understand the basis upon which Mr. Berger has
standing to seek a variance without first dealing with Mrs.
Zimmerman. He has made no effort to do so.
