Motion
Jim and Jody Pederson - Tabled/Denied. (8:27 p.m.)
After discussion and consideration, Michael Harris made a motion, seconded by Paul Larson to deny the variance application as
requested as an alternate site does exist which will not impact the road. After additional discussion and consideration, Thomas
Lee, with the verbal agreement of the applicants made a motion, seconded by Paul Larson and carried with Randall Mann and
Steve Schierer voting no, to table the applicants’ request until the next scheduled meeting of the Board of Adjustment, which will
provide the applicants with an opportunity to consider the alternate site and to resubmitted a revised application with
measurements appropriate for the alternate site or if administration determines that it was not appropriate to table this application
because of the significant change from the original request then this application is considered denied. If tabling was appropriate
then the secretary of the Board of Adjustment is directed to provide proper notification of the changes to the impacted properties
within the required notification area with no additional fee being charged.

Joan Mitchell - The variance application was approved as requested. (8:02 p.m.)
Joan Mitchell, part of the Southeast Quarter, Section 19 of Folden Township by an unnamed lake, requested a
variance of 65’ which is 135’ from ordinary high water level for dwelling and non-dwelling structures and a variance of
50’ for the septic system which is 100’ from ordinary high water level. Rob Mitchell appeared with the applicant at the
public hearing. The audience was polled with Paul Halverson and Ruth Hanson speaking for the variance as
requested. After discussion and consideration, Paul Larson made a motion, seconded by Steve Schierer and
unanimously carried, to approve a variance of 65’ which is 135’ from ordinary high water level for dwelling and non
dwelling structures and a variance of 50’ for the septic system which is 100’ from ordinary high water level. The
variance as approved is consistent with past actions of the Board of Adjustment in this immediate area. The practical
difficulty/hardship is the terrain of the applicant’s property.
Steven and Sally Gray - The variance application was approved as requested. (8:05 p.m.)
Steven and Sally Gray, Lots 18 and 19 Lundquist’s Addition to Clitherall, Clitherall Lake in Nidaros Township,
requested the following: Raise cabin in place and put 3 to 4 courses of cement block under cabin then lower cabin
onto the blocks. Existing dwelling is 24’ from lake. Required setback is 100'. Existing decks will be put back against
cabin on completion of project. Also 8’ variance from road right-of-way. Currently at 12’, required is 20’. The
audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Thomas Lee made a motion, seconded by Michael Harris and unanimously carried, to approve the
variances (12’ setback from road right-of-way and 24’ setback from the ordinary high water level) for the proposed
development as requested in the variance application dated August 16, 2012 and as depicted on the drawing
submitted with the variance application. The proposed development is general maintenance/upgrading. The variance
as approved is consistent with past actions of the Board of Adjustment. The practical difficulty/hardship is a very
substandard lot of record.
Break - 8:10 p.m. until 8:30 p.m.■ANN ED
Jim and Jody Pederson - Tabled/Denied. (8:27 p.m.)
Jim and Jody Pederson, part of Government Lots 2 and 3, Section 31 of Maine Township by West Lost Lake,
requested the following: Do to the location of the home and garage, the only way to expand the garage is towards the
“easement” road. Currently enter the garage from the north, with addition, would enter from the west. Minimum road
right-of-way setback is 20’, current home is approximately 25’ to 30’, requesting setback of 5’. Appearing with Jody
Pederson at the public hearing was Dan Zierden. Mr. Zierden spoke in favor of the variance as requested. The
audience was polled with Leona Warholm speaking in opposition to the variance as requested. After discussion and
consideration, Michael Harris made a motion, seconded by Paul Larson to deny the variance application as requested
as an alternate site does exist which will not impact the road. After additional discussion and consideration, Thomas
Lee, with the verbal agreement of the applicants made a motion, seconded by Paul Larson and carried with Randall
Mann and Steve Schierer voting no, to table the applicants’ request until the next scheduled meeting of the Board of
Adjustment, which will provide the applicants with an opportunity to consider the alternate site and to resubmitted a
revised application with measurements appropriate for the alternate site or if administration determines that it was not
appropriate to table this application because of the significant change from the original request then this application is
considered denied. If tabling was appropriate then the secretary of the Board of Adjustment is directed to provide
proper notification of the changes to the impacted properties within the required notification area with no additional fee
being charged.
Garnett and Nancy Eddington - The variance application was approved as requested. (8:45 p.m.)
Garnett and Nancy Eddington, Lots 16 and 28 of Government Lot 5, Section 16 of Dunn Township by Fish Lake,
requested the following: proposed cabin addition to existing cabin (2"'^ story addition with covered deck) is
approximately 41’ from bottom of rip rap. Required setback is 75’ from ordinary high water level. The audience was
polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve
Schierer made a motion, seconded by Thomas Lee and carried with Michael Harris voting no, to approve the variance
for the proposed development as requested in the variance application dated August 15, 2012 and as depicted on the
drawing submitted with the variance application. It was noted that the proposed development will be no closer to the
ordinary high water level than the existing structure and there will be no change to the existing footprint. The variance
as approved does not directly or indirectly grant any other variances for the development as proposed in the
application dated August 15, 2012. The practical difficulty/hardship is a very substandard lot of record.
