Conditional Use Permit - Middle Leaf Resort/Red Barn Investments. LLC:
Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use
Permit to add a screen porch to Cabin #7 as presented. The property is described as Trs in
GL 3, 4 & 5 being Pt of Middle Leaf Resort & Lots 6, 7, 8 & 9 BIk 5, Leaf Lake Pleasure
Grounds in Section 22 of Leaf Lake Township: East Leaf Lake (56-116).
Conditional Use Permit - William & Karen Boediaheimer:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit to level Lot 4 and part of Lot 3 (similar to a neighbor’s project) as presented. The
property is described as Lots 3 & 4 BIk 1, Pine Lake Shores, Section 35 of Gorman
Township; Little Pine Lake (56-142).
Conditional Use Permit - Cold Spring Realty Inc./Thomas & Brenda Masloski:
Motion by Block, second by Nelson, and unanimously carried to accept the withdrawal of this
Conditional Use Permit application to relocate a road based on the Applicant’s request to
withdraw. The property is described as Pt GLs 1 & 2 E of Rd AKA Parcels C & E and Pt GL 2
AKA Parcel D, Section 31 of Maine Township: West Lost Lake (56-481).
Conditional Use Permit - Darvll & Diane Anderson:
Land & Resource Director, Bill Kalar, stated that this is a CUP request to replace a failed
retaining wall and the Planning Commission’s recommendation was denial. Rob Goral of
Shoreland Solutions spoke on behalf of the applicants. He stated that this is a retaining wall
built in the 1940’s or 1950’s and it has failed. The property owner wants to keep the soil from
sliding into the lake and feels that this project is needed for the good of the lake. He referred
to the credentials of the Landscape Architect, who developed the plan and provided pictures
of the area. Planning Commission member, Joe Maske, referred to a project on Eagle Lake,
compared the projects, and stated that this plan shows no tie back. Mr. Goral stated that this
is a much smaller project than the one on Eagle Lake and that there is no tie backs
necessary in a 3’ high wall in sandy soil. Commissioner Lee stated that this problem needs
to be corrected and offered a motion, seconded by Nelson, and unanimously carried to
approve a Conditional Use Permit to correct the problem with the failed retaining wall as
presented by the applicant. The property is described as Broadwater Beach W 25’ of Lot 44
& Lot 45, Section 7 of Dunn Township: Pelican Lake (56-786).

Reconvene
At 11:45 a.m.. Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of GIS
Database Coordinator, Sherry Leabo, pursuant to M.S. Chapter 13D.05 Subd. 3. All five
seated commissioners were present for the evaluation. A summary of performance
conclusions will be provided at the next regular County Board meeting. Upon conclusion of
the performance evaluation, at 11:57 a.m.. Chairman Froemming reconvened the Board
meeting for a round table discussion regarding the proposed tobacco ordinance.
Proposed Tobacco Ordinance Discussion
Beltrami County Commissioner, Ron Otterstad, spoke to the commissioners regarding some
lessons learned in his County when developing the Reduction of Second Hand Smoke
Ordinance. He suggested that the commissioners first need to decide whether or not they
want an ordinance to regulate exposure to second hand smoke. If the Otter Tail County

Motion: A motion by Wiison, second by Maske to table, at the Applicants’ request, to
table to August 16, 2006. Voting: All Members in favor.
Cold Spring Realty Inc. / Thomas & Brenda Masloski - Withdrawn:
A Conditional Use Permit Application (as stated by the Applicant): We are requesting
permission to relocate the road running through the middle of our property so that we
can build homes on 3 different lots. This road would not impact any other lake owners
and would not impact the lake. This road would enable the parcel of land to have one
unit built on each of the three lots in the future. See attached for current and proposed
road placement (on file at Land & Resource Management). We would not look at doing
this work until fall of 2007 or 2008. To be completed by October 31 of the year we work
on it. Build the road on existing terrain and then top dress with a maximum of 6 inches
of gravel. May need to remove some existing trees to get the road in the proper place.
The property is described as R GLs 1 & 2 E of Rd AKA Parcels C & E and Pt GL 2 AKA
Parcel D, Section 31 of Maine Township; West Lost Lake (56-481), NE.
Tom Masloski represented the Application.
Leona Warholm had questions regarding road requirements.
After some discussion, the Applicant requested withdrawal of his request.
Motion: A motion by Estes, second by Wilson to accept the Applicant’s request to
withdraw his Application. Voting: All Members in favor.
Darvll & Diane Anderson - Denied:
A Conditional Use Permit Application (as stated by the Applicant): A 22’ section of an
existing 56’ long by 51” high rock and mortar wall that retains a 12’ high severe slope at
the shoreline has failed. Approximately the top of the wall has toppled into the water
and a additional 15’ leans severely and could fail. A 200 sq. ft area behind the wall has
slumped slightly but has not entered the water. Applicant proposes to stabilize the
slope with a two-tier terrace incorporating three keystone block walls each 3.5’ high as
per the drawing on file with Land & Resource Mgt. Office. Total excavation: 60 cy.
Riprap: 57.5 cy. The property is described as Broadwater Beach W 25’ of Lot 44 & Lot
45, Section 7 of Dunn Township: Pelican Lake (56-786), GD.
Rob Goral (Shoreland Solutions) represented the Application.
Motion - Failed: A motion by Schwartz, second by Wilson, to approve as presented,
provided the project is completed in a two week time period (if there are extenuating
circumstances. Land & Resource Management should be contacted for an extension)
and that the Licensed Landscape Architect oversees the project; reason being the failed
retaining wall needs repair. Voting Yes: Olson, Schwartz and Wilson. Voting No:
Boyer, Estes, Maske, and Zimmerman.
Motion - Failed: A motion by Wilson, second by Schwartz to approve provided a
licensed civil engineer reviews the plan and concurs (in writing) with the licensed
landscape architect. Voting Yes: Olson, Schwartz and Wilson. Voting No: Boyer,
Estes, Maske, and Zimmerman.

Maine Township received a Notice of Public Hearing from your office regarding Cold Spring
Realty Inc. conditional use permit application request. Their request to relocate the road running
through the middle of their property (Legal description: Pt GLs 1 & 2 E of Rd AKA Parcels C &
E and PT GL 2 AKA Parcel D, Section 31 of Maine Township) is so that they could locate 3
different lots in the future. Granting this conditional use permit will require a variance to build
on lots that have been turned down in the past because of no set backs. Our concern is that this
applicant has been lead to believe this is a possibility for future development when that may not
be the case. Please advise us as to why this conditional use permit application request was even
accepted.
