I understand that I have applied for a variance from the requirements of the Shoreland Management Ordinance of Otter Tail
County. I understand I must contact my township in order to determine whether or not any additional variance and/or permits
are required by the township for my proposed project.

MOTION AS FOLLOWS:
Motion was made by Cecil Femling, seconded by Dan Oehler to approve a 50' variance from the
required ordinary high water level setback of 200' for a building site on a 2.65 acre parcel
with the condition that this parcel of property have access to a public road and that all other
setback requirements will be met. The granting of this motion would allow the applicant to
enjoy the same rights and privileges as the neighbor. The motion failed to carry with Bert
Olson, John Everts, Craig Anderson and George Watler voting no. No adequate hardship had been
shown and other alternatives do exist.

required ordinary high water level setback of 100' and a variance of 10' from the required
shore Impact zone setback of 50' for a 6' by 6' addition to an existing 18' by 22' structure and
for the raising of the roof line to add a 6' by 8' loft, The purpose of these additions to cottage
number 3 is to make this cottage handicapped accessible. This cottage will be in line with the
other existing cottages. The property is described as the SE1 /4 of Government Lot 5, Section 6
of Girard Township on Blanche Lake, The audience was polled with no one speaking for or against
the request, After consideration, motion was made by Cecil Femling, seconded by Craig Anderson
and unanimously carried, to approve a variance of 60' from the required ordinary high water
level setback of 1 GO' and a variance of 10' from the required shore impact zone setback of 50'
for a 6' by 6' addition to an existing 18' by 22' structure and for the raising of the roof line to
add a 6'by 8'loft.

Keith Stempfley, San Francisco, CA, requested a variance of 50' from the required ordinary
high water level setback of 200' for a building site on a 2,65 acre parcel with at least 200' of
shoreline. The 2,65 acre parcel will be split off from an existing parcel of 62,65 acres. The
property is described as part of Sublot B, Section 30 of Maine Township on West Lost Lake, The
applicant was represented by John Stempfley at this hearing, A letter from Richard Pemberton
concerning this variance request was read for the record. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Cecil Femling,
seconded by Dan Oehler to approve a 50' variance from the required ordinary high water level
setback of 200' for a building site on a 2,65 acre parcel with the condition that this parcel of

one speaking for or against the request. After consideration, motion was made by Dan Oehler,
seconded by Craig Anderson and carried with Cecil Femling voting no, to approve a variance of
■TO' from the required ordinary high water level setback of 200' for the placement of a mobile
home. Hardship being the terrain and topography of the lot.

impact zone. The property is described as part of Government Lot 8, Sections 15 and 16 of
Candor Township on Leek Lake, The audience was polled with no one speaking for or against the
request. After consideration, motion was made by John Everts, seconded by Craig Anderson and
carried with Cecil Femling voting no, to approve the variance as requested due to the unique and
gradual slope of the bluff area and a review of this property by shoreland management staff in
which they Indicate that they find no problems with the granting of this request.

RE: Stempfley Application
I have received the Notice of Hearing for Variance concerning
the application of Keith Stempfley and John Stempfley. I am
the immediately adjoining land owner. My property lies
immediately to the east of the Stempfley property and I also
own fee title to a 2 rod wide strip of land abutting the
Stempfley property on the south. This 2 rod strip is the
roadway to my property which, at the eastern end of the
roadway, lies to the east and south of the Stempfley
property. To the north of the Stempfley property lies West
Lost Lake and to the west of the Stempfley property lies the
township road which crosses the Otter Tail River at the
Waterstreet Bridge.
I do not wish to make life difficult for my neighbors, but in
order to be consistent with what I said to the Board of
Adjustment when I appeared to oppose the Berger variance
application just recently, I must continue to ask Otter Tail
County to administer shoreland and subdivision controls
ordinances strictly with respect to this very sensitive body
of water and adjoining shoreland.
I have not spoken with the Stempfleys and I have not seen a
certified surveyor plat of the development which they plan.
However, from my roadway to the south of the development
area, I have observed a series of stakes which would suggest
a series of lots which may be eventually planned, although
the variance request makes reference to a 2.65 acre parcel to
be split off from a 62.65 acre tract.
Since I will be out of town and cannot attend the hearing on
September 3, I would ask the Board of Adjustment to attempt
to determine what sort of development is planned and to

examine a plat to show how it lies upon the land, including
what access will be provided.
I mention access because I am told that it has been said that
access would be provided on my road. I have not agreed to
any such access. I wish to maintain the privacy of my road
as it runs from the township road approximately one-half mile
easterly to my property. I have maintained the privacy of
this roadway for approximately 30 years maintaining a locked
gate at its junction with the township road. This gate has
been kept locked constantly whether my family and I are at
our premises or not and our roadway has been used only by our
family and invited guests. It is not now and never has been
a public roadway and I do not intend it to become such.
There is adequate access to the Stempfley property from the
township road to the north of my road which will require only
the grading up of a roadway into this property across land
now owned by the applicants for the variance.
I enclose a map which may be of assistance to the Board of
Adjustme in—understanding the geography involved.
