Per usual, the Applicants should obtain and comply with any necessary permits as applicable, including the National Pollutant Discharge Elimination System (NPDES)/State Disposal System (SDS) Construction Stormwater permit. Information on the MPCA's Construction Stormwater permitting program, including who needs to obtain the permit prior to construction, can be found on the MPCA's website at https://www.pca.state.mn.us/water/construction-stormwater. In general, permit coverage is needed by the owner or operator of any construction activity disturbing one acre or more of soil, or less than one acre of soil if that activity is part of a larger "common plan of development or sale" that covers more than one acre. An example of a larger common plan of development or sale might be a housing subdivision. If required, permit coverage should be obtained prior to starting construction work. Questions can be directed to the contacts at the bottom of that webpage. If the proposed Kerbs-Little McDonald navigation channel project does not require MPCA construction stormwater permit coverage, I would request or recommend that the project proposers ensure that any soil or material placed along the shoreline is immediately and permanently stabilized so that it does not end up back in the lake.
