Fergus Falls, Minnesota 5i July 14th, 1994 Page 4 Doris Janecky - Approved/Denied Doris Janecky, Battle Lake, MN, requested a variance of 14" from the maximum height requirement of 36" for the construction of a ramp with railing having a height of 50" and a variance of 2' from the required side lot line setback of 1 O'for the enclosure of a 4'by 12'area. The property is described as Lot 10, Dursch Silver Bay, Silver Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 14" from the maximum height requirement of 36" for the construction of a ramp with a railing having a height of 50". Hardship being the terrain and topography of the applicant's property. The applicant has a narrow lot, It should be noted that the railing will not obstruct the vision of the neighboring property owners. After additional consideration, motion was made by Carl Johnson, seconded by Cecil Femling and unanimously carried, to deny the variance of 8' from the required side lot line setback of 10' for the 4' by 12' storage area as other alternative locations do exist where the storage area could be located, After additional discussion, motion was made by Carl Jonnson, seconded by Craig Anderson and unanimously carried, to allow the applicant to attach a storage area on the north side of the dwelling extending no more than 5’ towards the lake and being no greater in size than 5’ by 12'. It should be noted that the applicant does not have any other water-oriented accessory structure on the property. The hardship being a substandard lot of record. Robert Jokumsen - Denied Robert Jokumsen, Wahpeton, ND, requested a variance of 50' from the required ordinary high water level setback of 100’ for the location of a 26' camper 50' from the ordinary high water level and a variance of 15' from the required ordinary high water level setback of 75' for the location of a holding tank 60' from the ordinary high water level. After consideration, motion was made by Georgs Walter, seconded by Craig Anderson and carried with John Everts abstaining, to deny the variance as requested as no adequate hardship had been shown. Joseph and Beverly M. Elliott - Tabled Joseph and Beverly M. Elliott, Omaha, NE, requested a variance of 7' from the required side lot line setback of 10' and a variance of 5' from the required ordinary high water level setback of 75' for the enlargement and enclosure of an existing deck 3' from the side lot line and 70' from the ordinary high water level. The property is described as part of Lot 6, Block 3, Midway Park, Otter Tail Lake in Otter Tail Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Carl Johnson end unanimously carried, to table the request until the August 11th. 1994, meeting, July 14th, 1994 Page 3 i 6 James J. Radcllffe, Vergas, MN, requested a variance of 3' from the required road right-of-way setback of 20' for the construction of a 24' by 32' garage 17' from the road right-of-way. The property is described as part of Government Lot 1, Section 16 of Candor Township on Leek Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling. seconded by Carl Johnson and unanimously carried, to approve a variance of 3' from the required road right-of-way setback of 20' for the construction of a 24’ by 32' garage 17' from the road right-of-way. Hardship being a substandard lot of record. The Board noted the location of the applicant's property is uniquely situated between two dedicated public roads that are at right angles to each other and the Board noted that the entrance to the garage is setback approximately 60' from the public road. k IIS f! s!. Stoebe, Burnsville, MN. requested a variance of 1 1' from the required ordinary high water level setback of 75' and a variance of 25' from the required ordinary high water level setback of 100' for the construction of a proposed dwelling 64' from West Battle Lake and 75' from the creek. The audience'was polled with Jack Donelan speaking to the variance request. After consideration, motion was made by Craig Anderson, seconded ■ by Cecil Femling and carried with John Everts abstaining, to approve a variance of 1 1' from the required ordinary high water level setback on West Battle Lake of 75' for the construction of a proposed dwelling 64' from the ordinary high water level on West Battle Lake and 100' from the ordinary high water level of the creek. No variance was granted from the setback requirements for the creek. The granting of the variance will maintain the building line. The new structure will be farther Pack from the ordinary high water level than the existing structure. Barbara C. Bopp - Approved Barbara C. Bopp, Fergus Falls, MN. requested a variance of 6i' from the required ordinary high water level setback of 100' and a variance of 11' from the required shore impact zone setback of 50' for an addition to an existing dwelling 39' from the ordinary high water level. The applicant also requested a possible variance of approximately 6 to 8" from the required 3' structure height above the ordinary high water level. The property is described as the west 1 /2 of Lot 47 and all of Lots 48 and 49, Deer Lake Beach, Deer Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was mace by Carl Johnson, seconded by Cecil Femling end unanimously carried, to approve a variance of 61' from the required ordinary high water level setback of 100' and a variance of 1 1' from the required shore impact zone seioack of 50' for an addition to an existing dwelling 39' from the ordinary high water level with the condition that the floor level of the addition be the same as the present structure. Hardship being the pre­ existing building in the shore impact zone. The addition will be farther back than the original structure.
