Minneosta Planning Commission September 4, 1996 Page 6 No Formal Actiont Bill Kalar discussed with the Commission, the County Board's concerns regarding the reason(s) topographical alterations were being approved (safety). During this discussion the Commission was asked if Roger Shelstad (Pickerel Lake) was to reapply (the CB denied his request), would they again consider recommending approval up to what they had previously approved. The general consensus was that they would approve the project as they had previously recommended. Bill Kaleur also discussed with the Commission the possibility of their accepting a scaled drawing, instead of the required surveyor's drawing (estimated cost $1100.00), for an addition to to the residence on a cluster development of Jane Kunkel, Prairie Lake (56-915). The Commission decided that in this case, they would accept the scaled drawing. A motion by Trites, second by Lachowitzer to adjourn at 11:15 P.M., the next meeting is scheduled for October 2, 1996. Approval of Agenda Motion by Lee, seconded Stone, and unanimously earned to approve the August 13, 1996 agenda amended as follows: Cancel Addressing Coordinator Update Building Committee and Budget Process Report Closure of Roads for Events Correction to Plat and Repurchase Resolution Approval of Minutes Motion by Windels, seconded Lindquist, and unanimously carried to approve the August 6,1996 minutes as submitted. Letter of Intent - Building Space Motion by Windels, seconded Stone, and unanimously carried to authorize the Building Committee to execute the “Letter of Intent” proposed by First Bank for the rental of office space. Budget Report Budget Committee members, Lindquist and Portmann, .updated the board on the current budget process. New reittnues and new financing requests were discussed. The Building Committee requested direction fromJjti^Doard regarding % of increase. ^ ^ : Planning Commission Recommendations After review of Planning Commission minutes of August 7, 1996, Chair Portmann questioned the process for review the Planning Commission uses before approving a CUP similar to the one requested by Jay Harris & Mark Johnson. The Land & Resource Administrator stressed that stabilization, creating a funnel to the lake, etc should be considered more than what the property looks like. There are 13 items in the ordinance that the Planning Commission should consider before approving a CUP. Virginia Portmann, Chairperson Attest; Larry Krohn, Clerk Case Aid Position Compensation Motion by Windels, seconded Lee and unanimously carried to approve an adjustment for the Case Aid position of the Support Specialists Unit to a salary range of $1,492 - $2,214 per month as negotiated and recommended by the Personnel Committee. Data Acquisition Position County Coordinator, Larry Krohn, reported that the job description for the Data Acquisition position has been reviewed by DMG. Motion by Lindquist, seconded Lee, and unanimously carried to approve a salary of $6.86 per hour for the part-time, temporary Data Acquisition position. Informational Commissioner Lee reported on a recent meeting regarding the Minnesota River. Mr. Lee reported that he had received a phone call regarding the Conditional Use Permit of Roger Shelstad on Pickeral Lake which was denied at the July 23, 1996 board meeting. Several commissioners agreed to look at the property as requested by Mr. Shelstad. Commissioner Lindquist reported on a recent Land Planning meeting. Discussion took place regarding feedlot ordinance(s). Recess At 1;40 p.m.. Chair Portmann declared the meeting of the Otter Tail County Board of Commissioners recessed until the 7;30 p.m. Ditch No. 63 Informational Meeting. Informational Meeting - County Drainage System No. 63 Chair, reconvened the Otter Tail County Board of Commissioners at 7;30 p.m. for the l^^urpoM^J^iscussing with interested individuals the need and/or interest in proceeding with a petition for the repair of County Drainage System No. 63 and to provide the interested individuals with an opportunity to gain an understanding of the procedures which must be followed to accomplish a repair of a drainage system. It was noted that this meeting was not a public hearing in response to a petition for repair, but was intended to be an informational meeting, facilitated by the County Board of Commissioners, to assist interested individuals in deciding how they should proceed. The following county personnel were in attendance; > •Commissioners; Virginia Portmann, Chair, Malcolm Lee and Harley Windels Ditch Inspector Tiny Holm County Attorney; Wally Senyk County Auditor Wayne Stein It should be noted that sixteen individuals were in attendance. Fifteen of these individuals represented property owners and one represented the U.S. Fish and Wildlife Service. Virginia Portmann, Chair, called upon Tiny Holm, Ditch Inspector, for his comments concerning County Drainage System No. 63. Tiny Holm provided information regarding the location of the drainage system. otter Tail County Board of Commissioners July 23,1996 Page 4 Rural Coalition of Minnesota Counties After some discussion with Tiny Holm, Ag/Ditch Inspector, regarding the Rural Coalition of Minnesota Counties and an upcoming meeting in September, concern was expressed about the potential loss of ag land for development and land use issues. Information about the upcoming meeting will be requested. Conditional Use Applications Bill Kaiar, Land & Resources Administrator, presented two previously tabled Land Use Applications for board action: Upon a motion by Windels, seconded Lindquist, and unanimously carried to approve the Conditional Use , ^ Application of Ervin Wegscheid, Paul Lake, subject to the following conditions: Approve only the two foot retaining wall as presented (see drawing submitted to Land & Resources on 5/9/96). The steeper position of the slope may be vegetated with low-growing shrubbery such as juniper or honeysuckle. Owner is to notify the Land & Resource office when the project will begin so necessary inspections can be made. ' ^ Final Plats Motion by Lindquist, seconded Windels, and unanimously carried to approve the final plat of Eagles Nest Shores (Stalker Lake). Motion by Stone, seconded Lee, and unanimously carried to approve the final plat of Sugar Creek Acres (Middle Leaf Lake). West Central Initiative Fund Lowell Larson and Wes Binner of the WCIF provided an update of their programs and services. Reappointment - Assessor Motion by Lindquist, seconded Windels, and unanimously carried to reappoint Robert Moe as County Assessor to a four year term commencing January 1, 1997. Political Disclaimer Motion by Lindquist, seconded Lee, and unanimously carried to accept the following Certificate of Disclaimer between the County of Otter Tail and Leon T. Hunt who has filed as a candidate for the office of State Representative, Minnesota House District 10A: Certificate of Disclaimer between The County of Otter Tail, Minnesota and Leon T. Hunt, an employee As a government entity, the County of Otter Tail is obligated to remain neutral in any contest for public elective office. Accordingly, the County of Otter Tail hereby disclaims any endorsement or the provision of any material or remunerative support to the candidacy or campaign for elective political office of the above named employee, a candidate for the office of State Representative, Minnesota House District 10A. Approval of Minutes Motion by Windels, seconded Lee, and unanimously carried to approve the minutes of July 2, 1996, as submitted. Approval of Waterfowl Easement Motion by Lee, seconded Lindquist, and unanimously carried to certify the acquisition of lands by the U.S. Fish & Wildlife Service for a waterfowl easement which has been secured from Franklin T. Melby on the following described lands; T. 133 N.. R. 42 W.. 5th P.M. Section 35, W 1/2 SE 1/4 General consensus of the board was to table the purchase request of the U. S. Fish & Wildlife Service until the next regular board meeting. Approval of Contract - 56-635-21 & Etc. Motion by Lindquist, seconded Lee, and unanimously carried to authorize the Chair's signature to execute the contract for S A P. 56-635-21 & Etc. (overlay projects). Performance Evaluation Summary Motion by Windels, seconded Lindquist, and unanimously earned to accept the performance evaluation summary as submitted for Tom Fawcett, Social Services Director, and to maintain the summary in his personnel file. Forgiveness of Penalty Steve Andrews, Treasurer, appeared relative to a request for forgiveness of penalty for Magnar Tenold (parcel # 18-000-99-0386-000). The postmark date for the tax payment was May 18, 1996, and the penalty was $22.80. The board directed Mr. Andrews to write a letter to Mr. Tenold explaining that Otter Tail County’s policy requires payment of penalty if the tax payment is late. Payment is considered late if postmarked after the tax deadline date. . Ditch No. 23 Wally Senyk, County Attorney, presented the Otter Tail County Ditch No. 23 Findings and Order Denying Petition for Repair for the Chair’s signature. Motion by Windels, seconded Lee, and unanimously carried to collect $1,500 plus interest from the individuals who petitioned for the repair of Ditch No. 23. Planning Commission Recommendations Bill Kalar, Land & Resource Administrator, presented the July 2, 1996, Planning Commission minutes. Several questions regarding the Conditional Use Application of Roger & Eunice Shelstad were discussed, j The Chair directed Mr. Kalar and Commissioner Stone to view the property and return to the board in two # weeks. General consensus of the board is that there are very few non-residential backlots that are not tied together with a residual lakeshore parcel. Motion by Lindquist, seconded Lee, and unanimously carried to keep the language of the Shoreland Management Ordinance ‘as is’ relative to non-residential backlots. Erosion will be controlled with sod and immediate grass seeding. The excavation will be 60' long x 40' wide (at center), cut being 6' at the deepest part tapering to 0' at all points. The property is described as Pt. of Government Lot 7 (Parcel C) of Section 12 of Maine Township, Pickerel Lake (56-475), RD. Roger Shelstad represented the Application; Rick Olson spoke to the Commission indicating that he was denied to remove a 3' ridge and now it appears that you are going to grant approval to remove 6' of a ridge.
