(7:04 p.m.) After consideration and discussion, Steve Schierer made a motion, second by Carl Zick and unanimously carried, to deny the variance as requested as no adequate practical difficulties/hardships had been shown that would allow for the granting of the variance as requested, the granting of the variance as requested would establish precedence; would substantially change the character of the neighborhood and would over populate an already crowded area. It was noted that the applicant's request is a substantial variation from the requirement. (6:39 p.m.) Trites Properties LLC, Lot 6 Plainview Sandy Beach Second Addition, Little McDonald Lake in Edna Township, requested the following: Would like to add a loft above main portion of existing house. Two pillars would need to be added on the lake side and one on the non-lakeside. The two needed on the lakeside will be 40’ from the lake which is the same distance as existing house (See Variance Dated 08/09/1974) The roof now needs to be replaced and since the house was built in a shape of a hexagon the pillars are needed to square off the roof line. Pillars would be 6 by 6 and will need to be stuccoed. Remaining roofline will be changed to a 6-12 pitch. The audience was polled with no one speaking for or against the variance as requested. Darren Trites represented the applicants at the public hearing. Chris Rutten, Contractor appeared with the applicant at the public hearing. A letter from Roger Neitzke, Secretary of the Little McDonald, Kerbs and Paul Lakes Improvement District in support of the variance as requested was read for the record. After consideration and discussion, Paul Larson made a motion, second by Carl Zick and unanimously carried, to approve the proposed development as described in the variance application dated September 2, 2008 and as depicted on the drawing submitted with the variance application. The practical difficulties/hardships are the terrain and position/shape of the existing structure. James and Marian Fortwengler - Approved the variance application as modified with a condition. (6:45 p.m.) James and Marian Fortwengler, Lot 5 and part of Lot 6 Block 1, Dahike Addition, Dead Lake in Star Lake Township, requested the following: I wish to take out old trailer house and replace with new trailer house. Setback from lake is now 75’. Set new house where old one is. New House is T 4" wider and 6’ longer. Lot is not big enough to do a 200’ setback. Replace existing decks with new decks the same size. To build a new garage. Remove old sheds as they are not safe anymore. New garage will be at setback of 115’. Old shed is at 80’ setback. Garage size is 24’ by 26’. A letter from Twyla Nore existing concern with drainage onto her property was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve the development as proposed with the condition that the backside of new 15’ 4” by 76’ structure must be located 10’ from the septic tank. The backside of the new 15’ 4” by 76’ structure must start at a point which is no less or no more than 10’ from the septic tank. Richard and Susan Roesler- Denied. (6:55 p.m.) Richard and Susan Roesler, Lots 3 and 4, Deerparth at Crystal, Lake Crystal in Lida Township, requested the following: Bluff encroachment. To construct a new dwelling with walkout basement in the bluff. Bob Engelstad represented the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate practical difficulties/hardships had been shown that would allow for the granting of the variance as requested, there is adequate room to place a dwelling in an area that does not require a variance from the bluff impact zone, and disturbing the soil in the bluff area and runoff from the bluff can potentially impact the quality of the water. Patricia Ellerbush - Denied. (7:04 p.m.) Patricia Ellerbush, part of Government Lots 8 and 9, Section 12 of Maine Township by Pickerel Lake, requested the following: Requests the property to be declared buildable for residential use. Property in question is greater than 80,000 square feet and adjacent to both County Highway 32 and North Pickerel Dr. Future plans would include basement and home located per plat, to be year round home occupied by Patricia Ellerbush. Richard Bratlien appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. An email from Erwin and Marilyn Wahlgren in opposition to the variance as requested was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Carl Zick and unanimously carried, to deny the variance as requested as no adequate practical difficulties/hardships had been shown that would allow for the granting of the variance as requested, the granting of the variance as requested would establish precedence; would substantially change the character of the neighborhood and would over populate an already crowded area. We are not in favor of granting this request and are concerned that it could be the first of many such requests. At the time those back lots were approved we attended the hearing and were assured that there would not be any residential units built on these lots at any time in the future. Because of the assurances given at that time we do not feel approving this variance would be the best course of action. The back lots do not have a common access to the lake in that area and this could lead to trespass problems. Thank you for passing our concerns on to the Board of Adjustment.
