I ' I ciit ouuiliy DUcJiu ui Mlic;i<9August 19,1997 Page 4 Planning Commission Recommendations Conditional Use Permit - Walt Schmidt/Beatrice Richardson: Land & Resource Director, Bill Kalar, reported that this Conditional Use Permit request is an after- the-fact request for a tubing business. Mr. Kalar noted that the permit request was approved by the Planning Commission with the condition that private access to the river is obtained for the tubers. A letter received from Delores and Larry Johnson was presented. The letter stated concern about this business and concern regarding the fact that Johnson’s CUP allows only one 4x4 sign while Mr. Schmidt has large signs all over his property. Motion by Portmann, second by Lee, and unanimously carried to approve the Conditional Use Permit for Walt Schmidt/Beatrice Richardson (Section 1, Twp. 133, R. 41, Otter Tail River) with conditions as recommended by the Planning Commission and subject to the same restrictions regarding signage that Mr. Larry Johnson’s (neighboring tubing business) CUP allows. Conditional Use Permit - Eric Canfield: Motion by Nelson, second by Stone, and unanimously carried to approve the Conditional Use Permit of Eric Canfield (Section 29 & 30, Twp. 136, R. 40, McDonald Lake) with conditions as recommended by the Planning Commission. Preliminan/ Plat - “West Otter Shores”: Mr. Kalar presented a preliminary plat of “West Otter Shores’’. Mr. Kalar recommended the following clarification: The Preliminary Plat indicates Lot 3, Block 1, is not intended for building purposes, however, this should read Lot 1, Block 1, since Lot 1, Block 1, does not have sufficient size for building purposes. Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat of “West Otter Shores” (Section 31, of Candor Township, Otter Lake) as presented with the above clarification. Conditional Use Permit - Glon'a Bates/Russell Thompson: Motion by Stone, second by Portmann, and unanimously carried to deny the Conditional Use Permit of Gloria Bates/Richard Thompson (Section 33, Twp. 133, R. 40, Unnamed Lake) as recommended by the Planning Commission. Motion by Lee, second by Portmann, and unanimously carried to authorize the Land & Resource Director to request that the DNR review this lake for possible reclassification of this body of water. Conditional Use Permit - Shorma Family Trust: Motion by Stone, second by Nelson, and unanimously carried to approve the Conditional Use Permit of Shorma Family Trust (Section 10, Twp. 134, R. 41, Pickerel Lake) with conditions as recommended by the Planning Commission. The area is currently zoned residential/agricultural. 2. The land is unsuitable for construction. 3. The availability of commercially zoned land within one mile of this site. 4. The designation of Hwy 78 as a State Scenic Highway. 5. The land lies too close to residential properties for the construction and operation of such a facility. (It should be noted that items 2-4 were reasons cited by the Everts Townboard.) Also, the Commission recommends that the DNR review the classification this Unnamed Lake (56-305) and reclassify it as NE. Voting: All members in favor. Voting: All members in favor. Break: The Commission took a break from 8:30 - 8:40. Earl Trosvik/Dean Bentz -Approved As Presented: A Conditional Use Permit Application to drain off standing water in the back lot to the existing culvert that runs through Cecil Poss's lot. This culvert was installed in the 1 920's and does work. Cecil has repaired parts of it from the road to the lake lately. Development of this lot depends on solving this standing water problem. This water would be spring run-off and heavy rain water only. The property is described as Poss Survey Lot of Gov. Lot 7, 75 on Lake (Called Lot E), Section 31 of Dunn Township; Lake Lizzie (56-760), RD. Dean & Emily Benz represented the Application.
