Compatibility with the surrounding area; both on land and water. The immediate use of the Rocholl Family Trust property is material production for the Otter Tail County CSAH 35, between CSAH 1 and CSAH 41, construction project (S.P. 056-635-035). Within 1000 feet of this property is the Unnamed Lake (56047400) of Maine Township. The underlying earth contains aggregates favorable for local construction projects. 2. Environmental impact, including soils, topography, vegetation (land and water), fish, and wildlife. The Contractor anticipates minimal environmental impact to the existing land and inhabitants. Topsoil will be preserved from areas where initially stripped, topography only modified as necessary, and returned to fannland upon reaching the termination of the lease agreement with the landowner. Given the proximity to Unnamed Lake (56047400), soil berms and other erosion control best management practices (BMP’s) will be constructed around the perimeter of the mining operation to prohibit sediment from leaving the property; hence, the meandered water body will not be affected by the proposed land use. 3. Any hazards that may be created; both on land and water. Foreseen hazards on the property include equipment and trucks moving regularly on site. As mentioned, there are no foreseen hazards to the Unnamed Lake (56047400). 4. Density and location of development. The property in consideration, with parcel number 38000080054001, is located at the northeast comer of the intersection of Otter Tail CSAH 22 and Berkey Road. This location offers convenience and safety to the Contractor and the general public. Suitability of the area, in its existing state, for the proposed use. This parcel of land, in the current state, is very suitable for the proposed use. The relatively consistent grade and minimal surrounding or overhead obstructions provides for little site preparation. As previously mentioned, the existing farmland topsoil must be stripped prior to the commencement of aggregate mining operations. 6. \ear shore water depth. The near shore water depth has not been explored due to the fact that no development activity will occur near the Unnamed Lake (56047400). The Ervin & C Rocholl Family Trust parcel in consideration does not lie directly adjacent to the beforementioned body of water. 7. Sensitive Areas may he protected through the use of Natural Environment Standards. The Contractor will comply with National Pollution Discharge Elimination System (NPDES). 8. Adequate parking and traffic control. The parcel of land in consideration will be prepared with ample space for the safe parking of vehicles. In addition, the Contractor proposes to install appropriate signage on CSAH 22 to alert motorists of material-hauling trucks entering the highway. 9. Amount of noise generated. Noise will be generated within the property by equipment and trucks relative to the production and placement of aggregate and hot-mix asphalt. 10. Hours of proposed use. The operational hours of the proposed use are, at most, sunrise to sundown. The days of use per week will not exceed six (6), Monday through Saturday. 11. Lighting When operation is occurring in the early morning or late evening hours, and adequate sunlight is not available, the Contractor will provide mobile light towers to ensure the safety of all individuals. 12. Signage (number, size, lighting, and location). In addition to the trucking warning signage, please see the enclosed typical RJ Zavoral & Sons Pit Signage photo. 13. Time frame and/or phasing. The Contractor proposes to commence mining activity immediately for the production of aggregates. The lease agreement between the Contractor and landowner has a duration of five (5) years, and could experience intennittent use over that time frame. 14. Adequate lot area and water frontage for the proposed use. An appropriate area will be stripped to allow for safe and efficient aggregate mining activity. C.3 Spall Materials and Lumps Spall is defined as shale, iron oxide, unsound cherts, pyrite, highly weathered and/or soft phyllite and argillite (may be scratched with a brass pencil), and other materials having similar characteristics. MnDOT Laboratory Procedure 1219 Lumps are defined as loosely bonded aggregations and clayey masses. If the percent of lumps measured in the stockpile or cold feed exceed the specification limits, stop asphalt production and determine compliance by dry batching. This procedure may be repeated at any time at the discretion of the Engineer. Maximum limits for Spall and lumps, expressed as percentages by mass, are listed in Table 3139-3. C.4 Insoluble Residue Test........ Use Statewide (except for District 6) MnOOT Laboratory Procedure 1221 If using Class B carbonate materials ensure the portion of the insoluble residue passing the No. 200 [75 pm] sieve is no greater than 10 percent. Use for District 6 ONL Y. If crushed carbonate quarry rock (limestone or dolostone) is used, the minus #200 [75 pm] sized portion of the rock insoluble residue shall not exceed 10% by weight. My concerns are listed below; 1. The mining and digging began approximately a month ago, before the Rocholl family submitted their permit application, According to Land and Resources Ordinance (page 27, #3 Conditional Use Permits) this violation is inexcusable as well as subject to criminal charges, (page 32, #10 Enforcements and Penalties). 2. The site was not inspected before the permit application. 3. No surrounding neighbors were contacted for their input before the operation began.( page 31, #8 notification Procedures: A) 4. Currently, pile of soil and gravel are less than 500 ft. from our property line.( page 31, # 8 Notification Procedures: B) 5. Environmental Air Pollution, heavy machinery exhaust fumes, future batch plant exhaust as well as gravel dust. 1 have asthma, and this will affect my breathing and my general health. Air pollution will also affect the wildlife living in the area. 6. Environmental Noise Pollution daily and constant noise from 6AM to 7-8PM, six to seven days a week. 7. I listed nine concerns, none of which were addressed by the planning commission. We are now experiencing toxic environmental air pollution from the batch plant, heavy machinery exhaust fumes as well as gravel dust, so heavy we have to keep all our windows closed. The environmental noise pollution is constant, from SAM to till dark. This not only affects us but our neighbors, something has to be done! I also want to mention, we as a neighborhood, were not given an opportunity to voice our concerns about this operation Before it was started. I will expect something to be done as the planning commission approved the "after the fact" application by Ervin Rocholl Family Trust. A Do not use graded aggregate containing objectionable materials including: (1)Metal, Glass, Wood, Plastic, Brick, or Rubber. Provide coarse aggregate free of coatings of clay and silt. Feed each material or size of material from an individual storage unit at a uniform rate. B.1 Class BB.2 Provide crushed rock from other bedrock sources such as carbonate and metamorphic rocks (Schist). Waste MaterialsB.8.D Do not allow extraneous materials including metals, glass, rubber, nails, soil, brick, tars, paper, wood, and plastics greater than 0.5 percent by weight of the graded aggregate as determined by material retained on the No. 4 [4.75 mm] sieve as specified in MnDOT Laboratory Procedure 1801. B.8.E Stockpile Do not blend an RAS stockpile with other salvage material. Do not blend MWSS and TOSS. The Contractor may blend virgin sand material with RAS to minimize agglomeration if the Contractor accounts for the blended sand in the final mixture gradation. Spall is defined as shale, iron oxide, unsound cherts, pyrite, highly weathered and/or soft phyllite and argillite (may be scratched with a brass pencil), and other materials having similar characteristics. C.3 Lumps are defined as loosely bonded aggregations and clayey masses. If the percent of lumps measured in the stockpile or cold feed exceed the specification limits, stop asphalt production and determine compliance by dry batching.
