Approval of Agenda Motion by Froemming, second by Lee, and unanimously carried to approve the County Board agenda of September 6, 2005, with the following additions: 9:35 a.m. - Add GIS Coordinator, Brian Armstrong 11:30 a.m. - Canceled Personnel Committee with Public Health Director 11 ;30 a.m. - Add Court Services Director - Budget Committee Meeting 11:45 a.m. - Add Safety Director, Tiny Holm Approval of Minutes Motion by Nelson, second by Mosher, and unanimously carried to approve the County Board minutes of August 23, 2005, as presented. Approval to Pay Bills Motion by Froemming, second by Lee, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Approval of Sentence-to-Service Crew Leader Position Motion by Lee, second by Mosher, and unanimously carried to replace an STS Crew Leader Position through the hiring process in the Coordinator’s office due to a retirement that is effective October 3, 2005. Sentence-to-Service Crew Leader Vehicle Motion by Mosher, second by Lee, and unanimously carried to authorize purchase of a new vehicle for the STS program. GIS Equipment for Hurricane Katrina Disaster GIS Coordinator, Brian Armstrong, reported that there is a call for help for GIS positions for a twenty-man team to assist with the search and rescue in New Orleans and one of his employees is interested. Motion by Froemming, second by Lee, and unanimously carried to authorize use of equipment such as laptop computer, GPS equipment, and digital camera for use with the search and rescue for the Hurricane Katrina disaster. Conditional Use Permit Extension Requests Motion by Lee, second by Nelson, and unanimously carried to authorize an extension, until October 1, 2005, for Mark Erikkson, Conditional Use Permit #6211, for property on Jewett Lake (56-877). Request for Refund of Variance Fee Land & Resource Director, Bill Kalar, presented a letter from Gene E. Stephens regarding property located in Section 17 of Leaf Mountain Township on Spitzer Lake (56-160). A variance for this property was requested from the Board of Adjustment, and subsequently, the request was denied. Mr. Kalar stated that Mr. Stephens is requesting a refund of the Variance Application Fee. Discussion followed. Motion by Lee, second by Nelson, and unanimously carried to deny Mr. Stephens' request for a refund of the Variance Fee. By policy, the Variance Fee is a non-refundable fee. Proposed Scope for Environmental Impact Statement for Blue Heron Bay Development Otter Tail County Resolution No. 2005 - 53 Commissioner Nelson offered the following and moved its adoption: WHEREAS, On November 20, 2002, R. Murray Partnership submitted to Otter Tail County an application for a Conditional Use Permit for a project known as the Blue Heron Bay project (the “project"): and WHEREAS, On April 1, 2003, the Board of Commissioners declared that an Environmental Impact Statement (“EIS”) was not required for the project; and WHEREAS on April 22, 2003, the Board of Commissioners granted a Conditional Use Permit for the project; and WHEREAS, on February 1, 2005, the Minnesota Court of Appeals reversed the decision not to require an Environmental Impact Statement for the project and remanded the issue to Otter Tail County for Preparation of an EIS; and WHEREAS, the Board of Commissioners desires to initiate the process to prepare an EIS by establishing a proposed scope for the EIS based on the decision of the Court of Appeals and documents that were submitted to the court stating the grounds for the appeal of the Board of Commissioners decision; and WHEREAS, the Board of Commissioners will issue its final decision on the scope of the EIS upon completion of the EIS Scoping Process provided in Minnesota Rules Chapter 4410. Field Abstract Co., Inc. to 8:00 a.m. on May 21, 2004, pertaining to that property described on Exhibit A attached hereto and incorporated herein by reference. The proposed Plat of The Palms of Lida is located within said property. From such examination I conclude that good record title in fee simple absolute is in Darrel V. Forsgren (married to Kathryn H. Forsgren), subject to the purchaser’s rights of the subdivider, Q-5 Investments, LLLP, so as to vest in the public those right-of-way rights and easement rights as designated in the plat, subject to the following: 1. CAVEAT: As can be seen fi-om the Exhibit A description, the subject property is subject to 11 specifically excepted tracts and also excepting the Plat of Outlet Beach and the First, Second and Third Additions to said Outlet Beach, and also excepting certain easements and Parcels 23 and 25 of the Otter Tail County Right of Way Plat #8. The Plat of Outlet Beach was created in 1945, the plat of Outlet Beach First Addition was recorded in 1946, the plat of Outlet Beach Second Addition was created in 1958 and the plat of Outlet Beach Third Addition was created in 1963. The easements which are generally described as exceptions to the title to the subject property ean be found at entries 96, 101, 102, 103, and 109. There is also a conveyance at entry 80 of a part of Government Lot 7 of Section 9- 136-42 consisting of all that part of the west 90 ft. of said Government Lot 7 located north of County Road #4. At entry 80 there is a conveyance to the County of Otter Tail for highway purposes of a tract of land consisting of 2.69 acres consisting of a strip of land 100 feet in width, 50 ft. on either side of the centerline as described in said entry 88, said highway being located within Sections 9 and 17. 2. At entry 114 there is a Right-of-Way Easement in favor of Lake Region Coop Electrical Association recorded June 16, 1989, as Document #688162 for the construction, operation, repair and maintenance of an electric transmission line over a strip of land 30 ft. in width, over and across Government Lots 5, 6 and 7 of Section 9-136-42. The exact location and width of this easement could not be determined fi’om the abstract entry. 3. At entry 118 there is a Mortgage executed by the current record owner and his spouse in favor of Pelican Valley State Bank dated July 1, 1992 and recorded July 7, 1992 as Document #731127 in the original principal sum of $181,500, constituting a first mortgage lien upon the subject property. At entry 119 there is a Corrective Mortgage executed by the current record owner and his spouse in favor of Pelican Valley State Bank dated July 1, 1992 and recorded December 23, 1992 as Document #738723 to correct the legal description for the property subject to the mortgage. 4. At entry 123 there is a Mortgage executed by the current record owner and his spouse in favor of Lake Country State Bank dated January 15, 1999 and recorded January 27, 1999 as Document #839403 in the original principal sum of $75,000 constituting a second mortgage lien upon the subject property. 5. At entry 135 there is a Right-of-Way Easement in favor of Lake Region Coop Electrical Association recorded May 8, 2000 as Document #863177 for the construction, operation, repair and maintenance of and electric transmission line or system consisting of a strip of land 40 ft. in width over and across part of the Northwest Quarter of the Northwest Quarter of Section 16 as more specifically described in said entry 135. 8.
