(9:35 p.m.) After discussion and consideration, Randall Mann made a motion, seconded by Paul Larson and unanimously carried with Cecil Femling voting no, to approve a variance of 70’ from the required ordinary high water level setback of 100’ and a variance of 18’ from the required road right-of-way setback of 20’ for the placement of the proposed dwelling as depicted on the Septic System Installation plan 30’ from the ordinary high water level and 2’ from the road right of way and to approve a variance of 8’ from the required back lot line/road right-of-way setback requirement of 10’ and a variance of 25’ from the required ordinary high water level setback of 75’ for the placement of the proposed septic system as depicted on the Septic System Installation plan 2’ from the road right-of-way and 50’ from the ordinary high water level with the copditien-that any existing building or septic systems located within the road right-of-way must be removed. As I have discussed today with Pat Eckert (who also discussed the matter with Wayne), I would like to hereby amend the application because one of the measurements that I included was not correct. Instead of requesting a variance of 70’ for the setback of the proposed structure from OHW, I would like to request a variance of 74’. Therefore, the language of the variance I am seeking is the following: “In connection with the removal of the existing dwelling and the construction of a new cabin on this substandard lot located at the end of a peninsula, we are requesting variances of 74’ from the ordinary high water setback of 100’, and of 18’ from the roadway setback of 20’. In connection with installing an upgraded septic system, we are requesting variances of 25’ from the OHW setback of 75’, and of 18’ from the roadway setback of 20’ for the tank and drainfield.’’ The only change between the language quoted above and what is contained in my application is the change from a variance of 70’ to our revised requested variance of 74’. Also enclosed is an original and six color copies of the revised scaled drawing. The only change from the drawing that I submitted with my application is to change the reference to the distance between OHW and the southwest comer of the cabin from 30’ to 26’. We would like to be placed on the agenda for the August 5* meeting of the Board of Adjustment. The variances we are seeking are in connection with the removal of the existing dwelling and the construction of a new cabin. The property was platted in 1967, is located on the very end of a narrow peninsula, and is now substandard in size. In order to make a reasonable use of the property, consistent with that of others in the area, we are requesting variances of 70’ from the ordinary high water setback of 100’, and 18’ from the roadway setback of 20’ for the structure. In connection with installing an upgraded septic system for the new structure, we are requesting variances of 25’ from the ordinary high water setback of 75’ and of 18’ from the roadway setback of 20’. We would respectfully submit that a hardship clearly exists in this case, and that the proposed variances should be granted. In particular, we would like to highlight the following: 1. The configuration of this property on the end of a narrow peninsula presents practical difficulties and particular hardship unique to the property. The irregular shaped property (which consists of two lots within the plat of Rabe’s Crystal beach but which are now considered one) contains 10,909 square feet and so is now very substandard in size, but is an improved lot that has maintained a dwelling since the early 1970’s. There is no portion of the property on which a structure could now be built without a variance from current standards. 2. As shown on the enclosed drawing, the structure we propose would be at least eight feet further back from the lakeshore to the east than the existing structure. Instead of trying to build at the same lake setback as the current structure, we are / trying to pull back from the lake just as much as possible, but we are then constrained by the roadway and the lake on the south side of the property. 3. We do recognize the fact that all but about 400 square feet of the proposed structure is in the shore impact zone. However, we believe that all of the existing structure totaling approximately 2100 square feet is in the shore impact zone. The new structure, which will total 1930 square feet, will actually have about 570 square feet less area in the shore impact zone than the current structure. In addition, the proposed structure, which includes an attached garage, would allow us to remove the two storage sheds which are currently in the road right of way (as are others in the area), removing another 220 square feet of structures from the shore impact zone. 4. We will be upgrading the septic system, which was installed in 1982, to a larger, 1000 gallon tank with a 375 square foot pressurized drain field. Since this will bring the drainfield within 50’ of the well, we will relocate the well on the property. 5. Since the property is on the end of the peninsula, the neighboring properties’ “lakeside” view is not in the direction of our property, and there should no issues relating to the new structure obstructing anyone’s view. 6. The part of the road right-of-way which abuts our property and for which we are seeking the variance of does not serve property beyond ours. It is a 66’ right-of-way for a road that is only about 10’ wide, has not been constructed to township standards, and has never been maintained by the township. Much of the road right-of-way is used as yard space or parking by us and by others at their properties. We fail to see any negative consequences arising from granting the roadway variance as requested. 7. The removal of the existing structure which consists of a 1970 mobile home with three enclosed additions and a large deck with a new, permanent structure will be a very substantial improvement to the property. It will be of quality construction built by local tradesmen. We appreciate the consideration of this request by the Board of Adjustment, and we would be happy to answer any questions relating to it.
