Richard and Patricia Hoganson - Denied the road right-of-way and impervious surface variances as requested and approved with a
condition the work completed within the bluff impact'ione (7:42 p.m.)
After consideration and discussion, Randall Mann made a motion, seconded by Steve Schierer and unanimously carried to deny the impervious surface variance
as requested by the applicants as no adequate practical difficulty/hardship had been shown that would allow for the granting of the variance as requested and the
applicants were aware of the ordinance requirement that limits impervious surface coverage to 25% of the total eligible lot area. After additional discussion and
consideration, Randall Mann made a motion, seconded by Michael Harris and unanimously carried, to deny the road right-of-way variance as requested for the
^/ision obstructing fence as the granting of this request would establish precedence as no other properties within this immediate area have structures within the
required 20’ setback area from the road right-of-way. After additional discussion and consideration, Steve Schierer made a motion, seconded by Michael Harris
and unanimously carried, to allow that portion of the fence/retaining wall and that portion of the stone steps located within the bluff impact zone to remain within the
bluff impact zone with the condition that the applicants must obtain a conditional use permit from the Planning Commission. The variance allowing the
fence/retaining wall and the stone steps to remain in the bluff impact zone is only granted if the applicants can successfully obtain a conditional use permit.
Concern regarding the work that had already been done within the bluff impact zone was expressed; however, concern was also expressed regarding the damage
that might occur if the applicants were required to remove the stone steps. The Board noted that a reasonable use of the applicants’ property could have been
.cljtained by complying with the requirements of the ordinance.

RE: Step Project
At your request we have reviewed the detailed pictures and sketches for your step project at your
lake home. We understand the old unsafe wood steps will be replaced by the stone steps with the
desired rise and run as shown. The purpose of our review is to provide a professional opinion on
how the project might affect slope stability and drainage.
The careful hand excavation disturbed much less soil that we normally see for this type of project
when excavation equipment is used. The weight of the soil removed for the steps is more than
the stone placed, so therefore you have unloaded the slope. This has actually increased your
global slope stability factor of safety.
Drainage is the second key to maintain slope stability and to reduce erosion. You have indicated
you plan on placing boulders in strategic locations to stop any runoff of water along the edge of
the stone. As the stone steps have been placed level, we expect most of any rain water to be
absorbed back into the slope along the edges of the steps, as it did when covered with vegetation.
You also plan to place vegetation at the edge of the steps all the way to the lake. At the base of
the steps, we recommend that you place a rainwater collector bed with aggregate and or
vegetation to collect any surface water that might make its way to that elevation.
Based on my experience with numerous slope projects in the lake area, it is my opinion that your
plans which include our recommendations should maintain the slope in a natural condition.

Minutes of April 11, 2012: A motion by Wilson, second by Kinzier to approve the April 11,

A Preliminary Plat of “Hukommelse Beach” consisting of 2 Single Family Residential Lots, 1

Motion by Lindquist, second by Johnson, and unanimously carried to approve filling a Highway
Maintenance Worker position July 1, 2012, due to a recent retirement and as recommended by the
Personnel Committee.
Conditional Use Permit Application
Richard & Patricia Hoaanson:
Bill Kalar, Land & Resource Administrator, reported on the continuation of the Conditional Use Permit
(CUP) application request from Richard and Patricia Hoganson. On May 9, 2012, the Planning
Commission recommended denial of this after-the-fact CUP request. On May 15, 2012, the Board of
Commissioners tabled the CUP request for thirty (30) days for an opportunity to develop a restoration plan
for work completed on Hoganson's property in Crystal Hills. Mr. Kalar referred to a letter he received from
a civil engineer who indicated that it would be better if the rock stairway stayed in place as removal could
cause additional environmental damage. The rock stairway was installed to replace a rotted, wood
staircase; however, this would not have been approved because it is in a bluff impact zone. Mr. Kalar
reviewed Mr. Hoganson’s proposed restorative grading plan. Lengthy discussion followed. Motion by
Johnson, second by Lindquist, and unanimously carried to deny an after-the-fact Conditional Use Permit to
replace retaining walls and work in the shore impact zone with conditions as documented in the May 9,
2012 Planning Commission minutes. Mr. Hoganson will work with the Land & Resource Management
Office for corrective and restorative action. The project is located on Lot 68 BIk 3 Crystal Hills, Section 11
of Lida Township; Crystai Lake (56-749).
