In consideration of this agreement and the execution thereof by each of the undersigned, each of said owners and each of the undersigned do hereby contract, covenant and agree each with the other that from and after the date hereof each of the undersigned will thereafter and hereafter ov;n. hold, use and enjoy his or her respective property or properties and each and every interest therein as hereinabove set forth subject to the follovjing covenants, agreements and restrictions, to-wit, that each of the owners of said property for himself or herself and their respective heirs, administra­ tors, representatives, successors and assigns will at all times hereafter refrain from using the property herein described, directly or indirectly. as a public gathering place, public resort, public beach, boat livery, place where bait is sold or fiornished to the public, store or other commercial enterprise, hotel, tourist home, tourist camp, camping grounds, and will refrain from using said property for any purpose where entertainment or services are furnished to the public whether or not any monetary consider­ ation is paid therefor and no structure vjill ever be placed upon said premises for use other than as a private dwelling or habitation save and except for the usual private garage, boat house or similar out buildings constnicted to be used in connection with a private dwelling. III. In the event of a breach of this covenant or agreement any of the other property owners who are parties to this agreement or their heirs. administrators, representatives, successors or assigns may severally or jointly forthvjith apply to any court of appropriate jxirisdiction for appropriate injunctive, restraining or other relief including a mandatory injunction for the removal, correction or alteration of the violation in question and such relief shall not preclude the bringing of an action for damages and the parties mutually agree that all parties mutually recognize that the breach of this covenant by any of the parties or their successors in interest herein shall give rise to an action for damages and damages are agreed to be liquidated in favor of any agrieved party thereto in the sum of -Five hundred and No/100 Dollars IV. The parties further mutually agree that the covenants and restrictions herein contained shall be construed to be covenants running with the land encumbering and retricting the vise of the specific tracts of land herein­ above described and shall be binding upon the heirs, administrators. representatives, successors and assigns of the respective parties hereto and their successive owners of said tracts.
