The Edvalis presented a ietter outiining their objections, as weli as copies of a letter dated May 8, 2011, which was provided to them by Mr. Bauck prior to the June, 2, 2011 Board of Adjustment meeting, a copy of the June 2, 2011 meeting notice, an email from Fred Bauck to Bill Kalar dated August 18, 2012 and five pictures of the property in support of their opposition. Mr. Bauck presented a five page handout explaining his proposed project. Mr. Bauck also described the reasons why he was requesting a variance. T 43593 inlet Beach Rd., Pelican Rapids, MN 565/2 Application for Variance - Supplemental Information Darin and Marcie Pfingsten, 43593 Inlet Beach Road, Lake Lida Please consider the following as you review our application. We purchased this 1977 built Montana Lodge Pole Pine log cabin in 2005. This home is true log home, which means that the logs you see on the outside are the same logs seen on the inside — our inside walls are logs. At the time we purchased the property, we were assured that the logs were fully intact, meaning no dry rot. The Montana Lodge Pole Pine log cabins are not made anymore because the logs are pine and thus are more susceptible to dry rot. In 2006, we discovered quite a bit of dry rot occurring. We stripped the logs, fixed the dry rot spots and re-stained and re-caulked the logs. This was costly. In 2006, the cost to fix logs was $100 per foot. Each year since then, we have maintained the logs as directed - coating with sealants and replacing caulking» About 3 years ago, the dry rot started re-appearing. When there would be driving rains, the cabin would leak. With the storm that occurred the first week of August of 2012, water seeped in and damage occurred on 2 levels. We looked into fixing the dry rot again. There were road blocks: we could only find 1 company willing to fix the logs (and they are located in northern Minnesota), the cost went up, and it would be more than a year until that person would be available to help us. Because the logs are pine, the dry rot will be ongoing, even if the current rot is fixed again. Selling the property would be very difficult, if not impossible. No bank would allow a mortgage on a property with dry rot. In addition to the on­ going maintenance nightmare, mortgage underwriting rules changed after the mortgage crisis in 2008. Now, a marketplace mortgage for log homes can be granted if there is a valid appraisal. A valid appraisal for a log home includes comparable log home SALES that have occurred within 6 months and a 50 mile radius of the said property. Log homes are very uncommon; and log homes SOLD within a 50 miles radius and 6 months is nearly impossible. We have decided that the logs need to removed and the home re-built as the pine logs will continue to deteriorate (they are 35 years old). No doubt with what I have stated above, we would qualify for the ability to re-build without a required variance since we are keeping the same footprint. However, the log cabin was built with a barn-style roof and we do not want the new structure to have that barn style roof. Therefore, the core reason for this variance request is to allow us to change the roof line of the house. Presently, the cabin is a 4 bedroom (5 bedrooms if you count the bunkhouse room), 2 'A baths, 2 story home. We are requesting that we keep the same footprint and rebuild with a different roofline. This will allow us to minimize the loss we will take on the property by tearing down and rebuilding as we will not have re-do the foundation. RYDEEN, husband and wife, hereinafter referred to as "Rydeens” and Michael T. Helm and Kay S. Helm, hereinafter referred to as "Helms". WHEREAS, Rydeens and Dale Slotten and Lorraine Slotten did obtain a Sewer Easement, a copy of of which is attached hereto as Exhibit 1; and WHEREAS, Rydeens are currently owners of an undivided two-thirds interest in said Sewer Easement; and WHEREAS, Dale Slotten and Lorraine Slotten are currently owners of a one-third interest in said Sewer Easement; and WHEREAS, Helms are the owner of a tract of real estate described on Exhibit 2; and WHEREAS, Helms wish to obtain an undivided one-third interest in said Sewer Easement liOW, THEREFORE, in consideration of the sum of ONE THOUSAND DOLLARS ($1,000) and other good and valuable consideration, receipt of which is hereby acknowledged, the parties hereto do hereby agree as follows: Rydeens do hereby grant, convey and quit claim to1. Helms, their heirs and assigns, an undivided one-third interest in the Sewer Easement described on Exhibit 1, and the drainfield constructed thereon, subject, however, to the terms and conditions thereof, for the benefit of the real estate described on Exhibit 2.
