MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT June 2, 1983 The Otter.Tail County Board of Adjustment met at 7:00 p.m June 2, 1983, with the following members present: George Walter frank Lacfiowitzer Craig Anderson Tom Stringer John Everts Thursday,• > -«Wi Minutes of the May 5th meeting were approved upon correction of 50' rather than the 5' from the center of township road on the Norberg request for the placement of a garage on Lot 7, Olson's Northshore, Eagle Lake Township. Old business: Leland Latham, Wetiiiore, KS, requesting permission to place a holding tank 50' from lake, 5' from lot line, 3' from house, on E>s of Lot 5, Block 3, Crystal Lida Beaches, Lida Township, was denied at the October 7th meeting for lack of adequate hardship, After discussion, motion was made by George Walter, seconded by Craig Anderson and ■* carried, to approve, hardship being only place-“on lot to place tank. John Everts and Tom Stringer voting "no". Mrs. H. M. Embertson, Pelican Rapids, MN, tabled from the October 7, 1982 meeting, was represented by her son, Tom Stringer "sitting out" because of conflict of interest. After listening to various interested parties, including Attorney Krekelberg and adjoining neighbor, Don McCracken, the application was withdrawn. After consideration, motion was made by Tom Stringer to deny for lailure to show adequate hardship, with an alternative of moving well and holding Lank to other locations. The motion was seconded by Frank Lachowitzer and carried. Miig.irot C. Johnson. Pelican Rapids, MN, requests permission to place drainfield 95 ieet from a shallow well, or as an alternative to place drainfield eight feet into Lida Street, on Lot 20, Block 1, Crystal Lida Beaches, Lida Township, was representated by attorney Steve Rufer. Attorney Charles Krekelberg appeared re­ presenting opposition to said variance. Because Tom Stringer is affiliated with the same firm as Krekelberg, Stringer requested to "sit out" the Johnson case. The motion was seconded by Craig Anderson and upon roll call vote, John Everts and MotionCraig Anderson voted "yes", George Walter and Frank Lachowitzer voted "no". Anderson, Fargo, ND, requested permission to construct an addition to cabin five to six feet from property line, on Lot 2, Viken Bay Beach, Dunn Tov/nship. AFter discussion, motion was made by John Fverts, to approve, hardship being a small, pre-ordinance lot of record, no better place on lot to build structure, appro­ val given by town board, no fire hazard being created because there is adequate space between proposed structure and neighbor's building.The motion was seconded by Tom Stringer and carried. Russell Rulon, Decorah, lA, requested permission to build a garage between 11'3" and 15' from the road right-of-way, on Lot 7, 2nd Add'n to Haggstrom Beach, Maine Township, After discussion motion was made by Tom Stringer, to approve, hardship being no other practical location on lot, respecting the road authority of the town board who gave their approval, the terrain factor of the lot, cannot build any closer to the lake shore and septic system would interfer with placing the garage at any other location on the lot. The motion was seconded by John Fverts and carried with Craig Anderson voting "no". Leland Latham, Wetmore, KS, re-appeared after being granted permission to place a holding tank 5’ from lot line, 3' from house, on the E^;t)f Lot 5, Block 3, Crystal AFter placing the holding tank, Mr. Latham was in­ formed by the Land & Resource Management office the holding tank was 36 feet from his well, 14' closer than the required separation, and requested a variance for Lida Beaches, on June 2, 1983. said 14' feet.After considerable discussion, motion was made by Tom Stringer to deny variance, no record to justify a variance and granting such a variance would subject the county to law suits. The motion was seconded by Craig Anderson and carried. Norman G. Mheeler, Dent, MN, requested permission to sell approximately seven or eight acres in G.L. 7, Section 29, Edna Township, retaining approximately acres. without platting. After discussion, motion was made by George Walter, seconded by Frank Lachowitzer and carried, to table.
