Eaily Suzanne Lindsay - Approved
Emily Suzanne Lindsay, Fargo, ND, requested a variance of 7' from the required road right-
of-vay setback of 20’ for the location of an existing garage 13' from the road right-of-
vay. The property is described as Lot 15, First Addition to Plainview Sandy Beach, Little
McDonald Lake in Edna Township. The audience was polled with no one speaking for or
against the request. Letters from the following individuals, in favor of the applicant's
request, were read for the record: Matthew and Michael Walsh, Clyde and Mavis Ahlschwede,
Helga Flatau and Ronald and Lugardia Bethke. After consideration, motion was made by
Cecil Femling to approve the variance as requested due to confusion of information
regarding where to measure the setback from when the road is not located in the center of
the right-of-way. The motion failed for lack of a second. After additional discussion
and consideration, motion was made by John Everts, seconded by Craig Anderson and
unanimously carried, to approve a 7' variance from the required road right-of-way setback
of 20' for the location of an existing garage 13' from the road right-of-way with the
condition that the property owner and the contractor must meet within 30 days with the
Administrator of the Land and Resource Department to discuss how the determination was
made to place the garage in this location and to discuss the proper procedures for
determining setback locations from the road right-of-way. In addition, the Land and
Resource Department shall provide the Board of Adjustment with a report of this meeting at
the October 5th, 1995, meeting of the Board of Adjustment. It was noted that the location
of this garage does not present a safety hazard for the public. It was noted that there
was confusion regarding measuring from the center of the driving surface verses measuring
from the rear lot line stakes.
Dene R. Boyd - Denied
Dene R. Boyd, Dent, MN, requested a variance of approximately 30' from the required side
lot line setback of 40' and a variance of approximately 17' from the required ordinary
high water level setback of 20' for the construction of an 8' by 8' storage shed
approximately 10' from the side lot line and approximately 3' from the ordinary high water
level. The property is described as Lot 11, A L Peach's Outlets to A L Peach's Lakeshore,
Star Lake in Dora Township. The audience was polled with no one speaking for or against
the request. A letter signed by the following individuals in favor of the applicant's
request was read for the record: Gordon LaValley, David Kuntz, Lyndon Maasjo, Warren
Wasescha, Donald Heintzman, Teenie Everhart, Woodrow Everhart and Mary and Joe Ryan.
After consideration, motion was made by George Walter, seconded by John Everts and
unanimously carried, to deny the variance as requested as no adequate hardship had been
shown.
Patrick Smith - Approved
Patrick Smith, Pelican Rapids, MN, requested a variance to subdivide a parcel of less
than 5 acres from an existing 10.94 acre parcel. The parcel would be approximately 1.18
acres and would be permanently attached to the adjacent property owned by Victor and Gail
Satter. The property is described as part of Government Lot 1, Section 32 of Lida
Township on Lake Lida. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by Cecil Femling, seconded by Craig
Anderson and unanimously carried, to approve the variance as requested with the condition
that a registered surveyor's drawing and a letter stating that there are no boundary line
disputes must be presented when the document is recorded.
