Glen Anderson, part of Government Lot 2, Section 15 of Edna Township by Paul and Rusch Lakes, requested the
following:
Parcel “A” - 5.6 acre lot to be declared a “buildable” lot (only has 57’ frontage on Paul Lake - supposedly needs 150’),
Parcel “B” - 12,000 square foot parcel to be attached to Parcel No. 20000990345000 owned by Charles and Deborah
Bartz- 125 between parcels.

Charles Cavanaugh appeared with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a
motion, second by Paul Larson and unanimously carried, to declared Parcel “A”, as depicted on the picture submitted
with the variance application, a buildable lot, to approve the permanent attachment of Parcel “B”, as depicted on the
picture submitted with the variance application, to Parcel 20000990345000 currently owned by Charles and Deborah
Bartz and to declared Parcel “C”, as depicted on the picture submitted with the variance application, a buildable lot
only if Parcel “C” is permanently attached to either Parcel 20000150087021 or to the Paul Lake property currently

David S. and Mary M. Johnson, part of Government Lot 4, Section 4 of Lida Township by Rush-Lizzie Lake, requested
the following:
ta the December 12,2013 meeting of the Board of Adjustments a variance was granted allowing David S. and Mary M. Johnson to build within 128 feet of the ordinary
high water Jmc of Rush/Lizzie take to have a primary septic location lOO feet from the ordinary’high water line at its nearest point,

When implementing the easement, as shown on die attached September 2014 survey drawing, the Johnson tract becomes encumbered by a 20 foot wide building
setback from the south line of the easement (north property line) per the lakeshore ordinances of Otter Tail County.
The most imr&erly comer of the garage in the 2014 house plan shown on the September 2014 survey drawing fells 10 feet southerly of the northerly property line.
Although the 2014 house plan is different than the one shown to the Board of Adjustments at the December 12,2013 meeting, the north -south distance of 78 feet
between the most northerly comer to the most southerly wall is the same in both plans.
Because of dm practical difBculty'we are requesting a variance as stated below.
A variance of 10 feet from the 20 foot setback requirement from an easement along the north property line.
Approval of this request wUl result in a projected impervious surfece percentage of 12.1%. (3468 garage + home + 558 porches + deck + 1300 misc. concrete walks and
pad = 5326 square feet: 5326/43,823 = 12.1%)

Glenn Howe, Surveyor appeared with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion,
second by Robert Schwartz and carried with Paul Larson voting no, to approve a variance of 10’ from the required 20’
road right-of-way setback for the development as described in the variance application dated September 17, 2014 and
as depicted on the drawing provided at the hearing, which is dated October 9, 2014. Those voting in favor noted that
establishing the proposed ingress and egress easement created a practical difficulty for the applicants because they
now need to meet a 20’ setback or before the requirement was 10'. It was also noted that the applicants would not
need to create the proposed ingress and egress easement; however, it is what should be done. If the proposed
easement is not created the applicants would not need the variance. The member oppose to the granting of the
variance indicated that the practical difficulty is self-made and only financial in nature and that the variance previously
granted provides the applicants with a reasonable use of the property.

Bonnie Beach Resort - A pproved the application as requested. (7:50 p.m.)
Bonnie Beach Resort, part of Government Lot 3 and part of Government Lot 4, Section 11 of Clitherall Township by
Clitherall Lake, requested the following: Requesting setback variance on replacement cabins at Bonnie Beach Resort.
Cabin 5 setback to lake is 65’ including deck. Cabin 6 setback to lake is 55’ including deck and side lot line 23’. The
audience was polled with Jeff Stabnow speaking for the variance as requested. Ron Sugden represented the applicant at
the public hearing. A letter from Roger Specht, Clitherall Lake Association President in support of the variance as
requested was read for the record. After consideration and discussion, Michael Harris made a motion, seconded by
Thomas Lee and unanimously carried, to approve the placement of Cabin 5, including deck, 65’ from the ordinary high
water level and to approve the placement of Cabin 6, including deck, 55’ from the ordinary high water level and 23’ from
the side lot line as described in the variance application dated July 12, 2012. It was noted that all of the proposed
development will be an improvement to the existing development._______________
Glen and Noel Brakke - Approved the application as requested with a condition. (7:54 p.m.)
Glen and Noel Brakke, part of Government Lot 5, Section 27 of Lida Township by Lake Lida, requested the following:
We would like to replace old cabin that is 27’ from lake and replace it with a little larger cabin and set it back 34’ from the
lake. We would also like to put up a garage on back lot 27’ from lake and 20’ back from traveled surface of road. Old
cabin is 520 square feet and new cabin will be 728 square feet. Required setback from ordinary high water level is 75’
and required road right-of-way setback is 20’. Loren and Tami Crist represented the applicants at the public hearing. The
audience was polled with no one speaking for or against the variance as requested. After consideration and discussion,
Rick Wilson made a motion, seconded by Thomas Lee and unanimously carried, to approve the proposed development
as described in the variance application dated July 11, 2012 and as depicted on the drawings submitted with the variance
application with the condition that the variances as approved do not directly or indirectly grant any variances for the
proposed development (specifically septic system and lot line variances). Hardship/practical difficulty is the terrain
features of the applicants’ property. The proposed development will be an improvement to the property as it currently
exists.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 8:20 p.m.

Steve and Colleen Brakke, part of Government Lot 5, Section 27 of Lida Township by Lake Lida, requested a variance
of 41 ’ from the required ordinary high water level setback of 75' for the replacement of an existing dwelling with a new
two story dwelling 34' from the ordinary high water level and 20' from the traveled surface of the road easement. The
audience was poiied with no one speaking for or against the variance as requested. After consideration and
discussion, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve a variance
of 41' from the required ordinary high water level setback of 75' for the replacement of an existing dwelling with a new
two story dweliing 34' from the ordinary high water level and 20' from the traveled surface of the road easement as
depicted on the proposed drawing submitted with the variance application dated June 18, 2013. The proposed
development will be further back from the ordinary high water level than the current structure. Hardship/practical
difficulty is a substandard lot of record. The variance as approved will allow the applicants to enjoy the same rights
and privileges as others in this immediate area.
Paul and Glenda Ellingson — Approved the variances as requested for Items 1 and 2 and denied the variances as requested for Items 3 and 4. (S:S5 p.m.)
Paul and Glenda Ellingson, part of Government Lot 3, Section 19 of Leaf Mountain Township by an unnamed lake,
requested the following:
Proposing to develop the property for single family use. Would like to place a dwelling and non-dwelling
structures onsite. Requesting a 120' variance being 80' from ordinary high water level for structures. The
required setback is 200'.
Proposing to place a septic system being 80' from the ordinary high water level. Requesting a 70’ variance
for the septic. Required setback is 150'.
Also requesting permission to locate a maximum of 4 RCU's onsite for occasional family functions/gatherings.
These 4 RCU’s will also need a variance setback from the ordinary high water level of 120’ being 80’ from
ordinary high water level.
This lot meets all the requirements in the Shoreland Management Ordinance to comply with the amendment
to the Shoreland Management Ordinance dated March 16, 2010 which allows you to locate an RCU on site
when one dwelling already exists. However, we would like to request a variance of 120' to place the RCU 80’
from ordinary high water level.

The audience was polled with Sharon Frey asking for a definition of “occasional”. After consideration and discussion,
Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve (Item No. 1 above) a
variance of 120’ from the required ordinary high water level setback of 200’ for the placement of a single family
dwelling and allowable non-dwelling structures 80’ from the ordinary high water level, to approve (Item No. 2 above) a
variance of 70’ from the required ordinary high water level setback of 150’ for the placement of a septic system at
least 80’ from the ordinary high water level, and to deny (Items 3 and 4) all variances as requested for the number and
location of the proposed RCU's. The variances as approved will provide the applicants with a reasonable use of their
property. The hardship/practical difficulty is a substandard lot of record, terrain features and the lake shore shape.
Michael Noesen — variance application was approved as requested with acknowledgment of Planning Commission action. (7:05 p.m.)
Michael Noesen, part of Government Lot 7, Section 32 of Dora Township by East Silent Lake, requested the following:
The proposed grading plan and new house location are within the bluff impact zone. The variance is addressing to
allow topographical changes and alterations of existing topography in bluff area. From top of bluff to front of deck is
19.7' requirement is 30”. Julie Noesen, spouse and Chris McConn, Interstate Engineering appeared with the
applicant. The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Michael Harris made a motion, second by Bernie Larson and unanimously carried to
approve the variance as described in the variance application dated June 19, 2013 and as depicted on the drawings
submitted with the variance application noting the Planning Commission’s approval and recommendations.
Andrew Kellogg — Approved the setback variance as requested and denied the variance for the additional size. (7:12 p.m.)
Andrew Kellogg, part of Government Lot 2, Section 23 of Lida Township by Lake Lida, requested a variance of 12’
from the required road right-of-way setback of 20' and a variance of 28 square feet from the allowable 260 square feet
for the placement of a 288 square foot water orientated accessory structure 8’ from the road right-of-way. Carrie
Kellogg and her father appeared with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. Letters from Edward and Sue Barlow and Lida Township in support
of the variance as requested were read for the record.

LAD Properties - Approved the variance application as requested with conditions. (7:21 p.m.)
LAD Properties, part of Government Lots 8 and 9, Section 26 of Dead Lake Township by Dead Lake, requested a
variance from the required ordinary high water level setback requirement of the Shoreland Management for the over
hangs on west side 10’ by 41' of remodeled cabin and maybe east side 12' by 41’. Post supports also. They are
within original footprint. A second story addition and garage was approved by variance on June 3, 2010. Don and
Luke Prettyman represented the applicant at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Michael Harris made a motion, second by
Steve Schierer to deny the variance as requested noting disregard for the previously granted variances and permits.
This motion failed with Thomas Lee, Robert Schwartz and Ward Uggerud voting no. After additional consideration
and discussion. Ward Uggerud made a motion, second by Thomas Lee and carried with Michael Harris and Steve
Schierer voting no, to approve the variance as requested in the variance application dated July 17, 2013 with the
condition that no additional variances will be granted for this development and with condition that the structure
currently being used for residential dwelling purposes must be converted back to a storage structure immediately
upon completion of the dwelling construction project.
Welle Family Trust - Approved the variance application as requested. (7:48 p.m.)
Welle Family Trust, Lot 2 Ironwood Beach, Pickerel Lake in Maine Township, requested a variance of 67’ from the
required ordinary high water level setback of 100’ for the replacement and addition to existing deck located 33’ from
the ordinary high water level. Present configuration is not functional and a safety hazard. Gail Welle represented the
applicant. The audience was polled with no one speaking for or against the variance as requested. After discussion
and consideration, Thomas Lee made a motion, second by Robert Schwartz and unanimously carried, to approve a
variance of 67’ from the required ordinary high water level setback of 100’ for the replacement and addition to existing
deck located 33’ from the ordinary high water level. It was noted that the proposed development will be no closer to
the ordinary high water level than the existing deck, the proposed location will not obstruct the view from the adjacent
properties, and the existing deck is in a state of disrepair and is in need of maintenance. The variance as approved
does not directly or indirectly grant any other variance for the proposed development.
Patrick H. Simmers - Approved the variance application as requested with a condition. (7:58 p.m.)
Patrick H.Simmers, part of Government Lot 5, Section 27 of Lida Township by Lake Lida, requested the following:
Proposing to replace existing cabin with a new structure being 68’ from the ordinary high water level. Requesting a 7’
variance from required 75’. Requesting a variance of 5’ to place the new structure 15’ from road right-of-way instead
of 20’. Proposing impervious to be 27.85%. 21.38% structures and 6.47% other. The audience was polled with no
one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a
motion, second by Michael Harris and unanimously carried, to approve a variance of 7’ from the required ordinary
high water level setback of 75’ and a variance of 5’ from the required road right-of-way setback of 20’ for the
replacement of an existing cabin with a new structure 68’ from the ordinary high water level and 15’ from the road
right-of way with the condition that no more than 25% of the total eligible lot area can be covered with impervious
surfaces. It was noted that the proposed development is an improvement over the existing development and will be
further back from the ordinary high water level than the existing development.
Earl E. and Penny L. Rydell - Approved the variance application with a modification. (8:05 p.m.)
Earl E. and Penny L. Rydell, Lot 6 Block 1 Star Point Estates, Star Lake in Star Lake Township, requested a variance
of 32’ from the required side lot line setback of 40’ for the placement of 10’ by 16’ structure 8’ from the side lot line.
The audience was polled with no one speaking for or against the variance as requested. A letter from Clark and
Violet Lien in opposition to the variance as requested was read for the record. After discussion and consideration,
Ward Uggerud made a motion, second by Robert Schwartz and unanimously carried, to approve the location of an
existing 10’ by 16’ structure in its present location (on the existing slab), which is assumed to be 8’ from the side lot
line. It was noted that had this request come before the Board before placement of this structure in its current location
the Board would have given consideration to approving placement at 10’ from the side lot line. The hardship/practical
difficulty is the terrain features of the applicants’ property. The variance as approved does not directly or indirectly
grant any other variances for the location of this structure.
