This Indenture effective the day of January, 2007, from,Grantor to Grantee:
Definitions. For the purpose of this Indenture:1.
"Grantor" shall mean Wells Fargo Bank, N.A., whose mailing address is 406 Main
Avenue, Fargo, North Dakota, 58126, as Conservator of the Estate of Kathleen I.
Boreen, a single individual.

"Grantee" shall mean Randall C. Olson, whose mailing address is 16307 Franklin
Circle SE, Prior Lake, Minnesota 55372.
b.
"Indenture" shall mean this conservator's deed between Grantor and Grantee.c.
"Property" shall mean the following described real estate, together with all
improvements, hereditaments and appurtenances, in the County of Otter Tail, in
the State of Minnesota:

A parcel of land (with a frontage of 50 feet measured along the shore of
Lake Lida) located in and being a part of Government Lot Five (5) in
Section Twenty-Seven (27), Township One Hundred Thirty-Six (136) North,
Range Forty-Two (42) West and described as follows:
Beginning at a point located by running North 462 feet from the Southwest
corner of said Government Lot Five (5) to the shore of Lake Lida and
thence North 41° 20' East 214.5 feet along the lake shore; thence North
53° 40' East 202 feet along the lake shore; thence North 39° 10’ East 216.1
feet along the lake shore; thence North 28° 06' East 130 feet along the lake
shore; thence North 17° 26' East 140 feet along the lake shore to the point
of beginning;
Thence from said described point of beginning and running North 10° 39’
East along the lake shore 50 feet; thence South 61° 48' East 156 feet;
thence South 17° 26' West 50 feet; thence North 61° 40' West 150 feet to
the point of beginning and containing 17/100 (0.17) of an acre more or
less, and together with the perpetual right of way and easement granted
hereby, the purchaser shall have the right of ingress and egress at all
reasonable times upon, over and across that part of said Government Lot
Five (5) reserved for a jointly used access roadway which roadway is now
located and running between the public road and the premises herein
described. This tract is also known as Lot E4.
2. Consideration and Conveyance. For a valuable consideration and subject
to the limitations set forth in Paragraph 3 of this Indenture, the receipt of which is hereby
acknowledged, Grantor hereby grants and conveys the Property to Grantee.

a; That this Indenture conveys after-acquired title;
b. That Grantor has not made, done, executed or suffered any act or
thing whereby the Property, now or at any time hereafter, shall or may
be imperiled, charged or encumbered in any manner; and,
c. That Grantor hereby grants and conveys property to Grantee.
4. Minnesota State Deed Tax. Minnesota State Deed Tax shall be due in the
amount of One and 65/100 ($1.65) Dollars.
5. Benefit This Indenture shall benefit, and shall be binding upon, the parties
and their respective successors in interest.

level. Dean Drewes, Up North Construction, the applicant’s contractor appeared with the applicant at the public
hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration
and discussion, Randall Mann made a motion, seconded by Paul Larson and unanimously carried, to approve a
variance of 22’ from the required ordinary high water level setback of 75’ for the placement of a dwelling 53’ from the
ordinary high water level. The proposed development is no closer to the ordinary high water level than the existing

Gregory and Kathleen Truax. Sub Lot C of the Northwest Quarter of the Northeast Quarter, Section 11 of Aurdal
Township by Fish Lake, requested a variance of 100’ from the required ordinary high water level setback of 200’ and a
variance of 7’ from the required side lot line setback of 10’ for the construction of a garage 100’ from the ordinary high
water level and 3’ from the side lot line. The audience was polled with no one speaking for or against the variance as
requested. After consideration and discussion, Randall Mann made a motion, seconded by Steve Schierer and
carried with Michael Harris voting no, to approve a variance of 100’ from the required ordinary high water level
setback of 200’ and a variance of 3’ from the required side lot line setback of 10’ for the construction of a garage 100’
from the ordinary high water level and 7’ from the side lot line. The practical difficulty is the unique shape and contour
of applicants’ property. It was noted that the applicants’ property is a substandard lot. It was also suggested that the
applicants might considered a smaller structure to maintain the desired separation between the existing house and
the proposed garage.
Dennis and Shirley Davidson - Application approved as requested with a condition. (7:32 p.m.)
Dennis and Shirley Davidson, Lots 2 and 3 Gulliver’s Travels, Paul Lake in Edna Township, requested the following:
Per application - We want to add a second story room above an existing basement room. Per Land and Resource
Department Notes - the variance requested is a variance of 30’ from the required top of bluff setback of 30’ and a
variance of 16’ from the required ordinary high water level setback of 100’ for the placement of the proposed
development 0’ from the top of the bluff and 84’ from the ordinary high water level. An email from Roger Neitzke in
support of the variance as requested was read for the record. The audience was polled,with no one speaking for or
against the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by
Thomas Lee and carried to approve a variance of 30’ from the required top of bluff setback of 30’ and a variance of
16’ from the required ordinary high water level setback of 100’ for the placement of the proposed development 0’ from
the top of the bluff and 84’ from the ordinary high water level with the condition that the applicants must obtain
professional certification (engineer/licensed contractor) stating that the existing structure and foundation can support
the proposed development and if the existing structure/foundation cannot support the proposed development then this
approval also grants the applicants permission to place appropriate footings in the bluff If the existing
structure/foundation cannot support the proposed development then the placement of footings to support the
proposed development will protect the bluff area.
Mark and Anita Anderson - Application approved as requested with a condition. (7:40 p.m.)
Mark and Anita Anderson, part of Government Lots 4 and 5, Section 27 of Lida Township by Lake Lida, requested a
variance to create two parcels of land out of one (37-000-27-0141-002). Parcel A as depicted on the drawing on file .
with the County Auditor’s office will remain a single family residential lot with 314 feet of Lake frontage and 37,688
square feet of surface area excluding road right of way and other land owned on other side of road. Parcel B as
depicted on the drawing on file with the County Auditor’s office would be permanently attached to another parcel of
land (Parcel C - 37-000-27-0140-006) and would remain a single family residential lot with 125 feet of lake frontage.
Marty Hanson represented the applicants at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by
Michael Harris and unanimously carried, to approve the variance as described in the variance application dated July
13, 2011 with the condition that the area within proposed Parcel B cannot be used when calculating imperious surface
coverage for Parcel C. Practical difficulty is the terrain and shape of the applicants’ property.

After consideration and discussion, Randall Mann made a motion, seconded by :Paul Larson and unanimously carried, to approve
a variance of 22' from the required ordinary high water level setback of 75’ for the placement of a dwelling 53’ from the ordinary
high water level. The proposed development is no closer to the ordinary high water level than the existing structure and is within
the building line. It should be noted that the variance as approved does not directly or indirectly grant any other variance for the
