April 10, 2014 meeting - The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Steve Schierer made a motion to deny the variance application. Upon additional discussion and consideration, Thomas Lee
made a motion, second by Rick Wilson and unanimously carried to table with the verbal agreement of the applicant (Marty) this public hearing
until the May 8, 2014 meeting to allow time for the Land and Resource office to determine the ordinary high water level and for the applicants to
consider other possible alternatives. There was some concern expressed by members of the Board that this particular property may not be
suited for any type of development. May 8, 2014 meeting - The audience was not polled as there was no one in attendance at the time of the
public hearing. Marty Hanson appeared at the public hearing and noted that the size of the proposed structure would be reduced from 40’ by 60’
to 20’ by 30’ and that the proposed structure would be placed 40’ from the ordinary high water level. After discussion and consideration, Steve
Schierer made a motion, second by Michael Harris and carried with Rod Boyer abstaining, to approve a variance of 35’ from the required--^;;
ordinary high water level setback 75’ for the placement of a 20’ by 30’ structure 40’ from the ordinary high water level and at least 20’ from the
road right-of-way.

John and Mary Carlson - Approved the variance application as requested. (7:05 p.m.)
John and Mary Carlson, Lot 8 Block 1 Twin Lakes Shores, Unnamed Lake in Eagle Lake Township requested a
variance of 4’ from the required side lot line setback of 10’ for the placement of a dwelling 6’ from the side lot line.
John Carlson attended the public hearing. The audience was polled with Lane Lockrem the owner of Lot 7 Block 1,
Twin Lake Shores, which is the property immediately adjacent to the applicant’s property where the structure has
been placed too close to the property line. Mr. Lockrem’s desire is for the applicants to place the structure in
compliance with the setbacks as stated in the site permit that was issued. Mr. Lockrem also discussed the lot line’s
location, the clearing of trees from his lot and questioned how and why the applicant’s structure got placed where It
did. Mr. Lockrem recently had the property surveyed. Emails from Daryl and Carol Johnson and Roger and Donna
Westerling in support of the variance as requested were read for the record. After discussion and consideration,
Michael Harris made a motion, second by Steve Schierer and carried with Rod Boyer and Paul Larson voting no, to
approve a variance of 4’ from the required side lot line setback of 10’ for the placement of the existing dwelling 6’ from
the side lot line. In general, the board members voting for approval determined that the placement of the dwelling in
its current location was not intentionally done by the applicants, it was an honest mistake, that the applicants acted in
good faith and that the costs to the applicants to either move or alter the structure to meet the required 10’ setback
would be excessive and would exceed the benefit received by the County.

The Otter Tail County Board of Adjustment met Thursday, April 10, 2014, with the following persons in
attendance:

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the December 12, 2013 meeting
as mailed.
Chair and Vice Chair Selection -
Steve Schierer, 2013 Chair, called for nominations for Chair and Vice Chair of the 2014 Board of
Adjustment. Michael Harris made a motion, second by Ward Uggerud and unanimously carried, to direct
the Secretary of the Board of Adjustment to cast a unanimous ballot for Steve Schierer as Chair and for
Thomas Lee as Vice Chair of the 2014 Board of Adjustment.
The Board of Adjustment considered the foilowing applications for variance:
Darold B. Sanderson - Variance application approved as requested with a condition. (6:32 p.m.)
Darold B. Sanderson, Lot 12 and the East Half of Lot 13, Kozelnik’s Beach, Big McDonald Lake in Edna Township,
requested the following: Decrease in lot size. The lots do not meet current setback standards. Cabins were
constructed on lots in late 1950’s. Request to grant my aunt Evangeline Sanderson et al 1.77 feet of my west half of
Lot 13. This is to clear an encroachment of Evangeline’s cabin onto my half of lot. This is per a survey done by
Anderson Surveying in November 2013. Upon approval of the corrected lot line, I request proposed Lots B1 and C1
(as shown on the drawing on file with the County Auditor’s office) to be considered buildable for residential purposes.
The audience was polled with Mark Sanderson speaking for the variance as requested. After discussion and
consideration, Paul Larson made a motion, second by Thomas Lee and unanimously carried to approve the proposed
subdivision as described in the variance application dated January 7, 2014 and as depicted on the submitted
drawings with the condition that a registered surveyor’s drawing must be provided at the time of conveyance. It
should be noted that Lots B1 and Cl as depicted on the drawing will be considered buildable lots for residential
purposes; however, this variance as approved does not directly or indirectly grant any other variances for current or
future development.

After consideration and discussion, Rod Boyer made a motion, seconded by Michael Conlon and unanimously carried
to approve a variance of 70’ from the required ordinary high water level setback of 75’ for the placement of a second
story and new roof on an existing garage 5’ from the ordinary high water level. The Board noted that the applicants’
proposed plan does not change the footprint of the building nor does it affect the view from the adjacent properties.
Hardship is the terrain and topography of the property.

Motion was made by Randall Mann, second by Cecil Femling and carried with Mark Steuart voting no, to approve a
variance to place a holding tank, and if a drain field is possible a lift station 4’ from the property line, 8’ from the
neighbor’s building and 4’ from the road easement with the condition that the adjacent property owner must submit a
letter approving the placement of the proposed tank/lift station 8’ from his guest house. It was noted that the variance
as granted would maintain a 50’ setback from the ordinary high water level and would maintain a legal setback from
the applicants’ well, as well as, from the neighbor’s well. It was also noted that drain fields have been place right up to
the lot lines and the road right-of-way. Hardship is a substandard lot of record.
