5'-8' onto Tunwall's property. Shed can be built with 10' setbacks (no variance) but would be only 4'-5' from this garage
(roof eaves closer). This is a fire safety concern. Tunwalls request a variance to build the shed 3' from west property line
(instead of 10' setback), which allows IT-12' separation from neighbor's garage to the east, and still 26' to the
neighbor's garage on west side. Tunwall's existing non-compliant garage to be removed (is over west property line 3'-4’)
Also request to build shed 15' from edge of back road; cun"ently there is no easement (existing garage is IT from road).

Warren & Deborah Tunwall - Variance Application Denied (8:02 p.m.)
After consideration and discussion Michael Donoho made a motion, seconded by Thomas Lee to approve the
variance to construct a shed (28’ x 44’) being 9 feet from the west property line. This motion has failed (4 to 3
vote). After further discussion Darren Newville made a motion, seconded by Terry Marthaler with Michael
Donoho and Mark Johnson voting no to deny the variance as requested as there is adequate room to meet the
lotline setbacks of the Shoreland Management Ordinance. This decision is based on the Findings of Fact and
Decision Form, which contains the criteria reviewed and the Board’s fmdings have been attached to and
incorporated as an official part of the minutes which have been placed on file with the Land & Resource
Management Department.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Purchased the 2 parcels in 2008 and the front parcel has the original
cottage built in the 1930's and want to maintain that, therefore would like to build on the back lot. We had the property surveyed
and found that there are structures that overlap on adjacent properties. If a 10' lotline setback is maintained the roofs on the
structure would be very close to each other feel that is a safety concern.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. [Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.
Jon & Rhonda Ellerbusch - Variance Application Approved as Requested (7:38 p.m.)
Jon & Rhonda Ellerbusch, Pt GLs 1 & 9 Com El/4 Cor., Mud Lake (56-381) and Pickerel Lake (56-475) in Maine Township
requested the following; The ordinance requires lots located on lakes classified as “natural environment” be a minimum of 200 feet
wide to build a residential dwelling. Our proposed house with garage would be on a 2.49 Acre lot that is 150 feet wide. Requesting to
have the lot buildable for single family residential use. Important note is County Highway 32 separates the Mud Lake shoreline from
the proposed site for the new house with garage.
Jon & Rhonda Ellerbusch, property owners, represented the variance application.
The audience was polled with Bernard Mackowicz speaking in support of the variance as requested. Erw in & Marilyn Wahlgren
submitted an email in opposition to the variance as requested.
After consideration and discussion, Darren Newville made a motion, seconded by David Wass with Terry Marthaler voting no to
approve the variance request for the lot to be considered buildable for single family residential use. This decision is based on the
Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s findings have been attached to and
incorporated as an official part of the minutes which have been placed on file with the Land & Resource Management Department.
Fisherman’s Village Resort - Dave Thompson - Variance Application Approved as Requested (7:52p.m.)
Fisherman’s Village Resort - Dave Thompson, Lots 5, 6 & 7 of Beauty Beach on Deer Lake and Part of GLs 1 & 2, Deer Lake (56-
298) in Everts Township requested the following: To meet the requirement of “adequate” parking for a PUD, we have to create
additional parking which increases our impervious from 42.2% to 46.8%. We are asking for a variance for this increase. Please note
that 1600 sq.ft, of new parking will be grass but has to be considered impervious per ordinance.
Fisherman’s Village Resort - Dave & Bev Thompson, property owners, and Dave Anderson, Anderson Land Surveying, represented
the variance application.
The audience was polled with no one speaking for or against the variance as requested
After consideration and discussion, Thomas Lee made a motion, seconded by Rick West and carried to approve the variance request to
increase the impervious surface from 42.2% to 46.8% of impervious surface coverage for additional parking to meet the “adequate”
parking requirement for a PUD. This decision is based on the Findings of Fact and Decision Form, w hich contains the criteria
review ed and the Board’s findings have been attached to and incorporated as an official part of the minutes which have been placed on
file with the Land & Resource Management Department.

The audience was polled v\ ith Jeffrey Aga does not oppose the proposed structure but oppose the request for the lotline setback, Bev
Aga Schmidt does not oppose the structure however, she does oppose the lotline setback request. Glen Aga has concerns w ith the road
and having legal access maintenance. Beverly Aga Schmidt submitted an email in opposition to the variance as requested. Jeffrey Aga
submitted an email in opposition to the variance as requested. Glenn Aga submitted an email in opposition to the variance as
requested. An email from Carol McCamy was submitted in opposition to the variance as requested.
After consideration and discussion Michael Donoho made a motion, seconded by Thomas Lee to approve the variance to construct a
shed (28' x 44') being 9 feet from the west property line. This motion has failed (4 to 3 vote).

Thursday, July 14, 2022, at 7:00 p.m.

Additipnal inforniation
Date: June 22, 2022
- Warren & Deb Tunwall purchased the property at 26579 San Dee Cove
Lane, Verges, MN, (on Lake Lida), in Sept. 2008.
- Includes 2 parcels (Lake Front 37000990421000, and Back Lot
37000260129003).
- The front lot contains the original 1930's seasonal cabin. The back lot has a
single car garage constructed in the late 1960's.
- We had the property surveyed on May 25, 2022. The survey showed the
neighbor's garage to the east extends 5' - 8' onto our backlot.
- We Intend to build a 2-story shed on the back lot. The shed fits but due to
the location of the neighbor's garage, our shed footprint would be only 4'-
5' away (eaves 3'), if we built law the 10' setback from each property line.
We feel building that close is a significant fire safety concern.
- We are submitting a Variance application to allow the shed to be built
closer to the west property line, so the structure Is further from the
neighbor's garage to the east (ll'-12'), while still maintaining 26'
separation to the neighbor's garage to the west
- Also, building per the variance request will require us to remove our
existing noncompliant single car garage which the survey revealed was 3'-4'
on to the west neighbor's property.
- Also, several mature trees could remain as well as a small berm that exists
next to east property line if we can build in accordance with the variance
request.
- We are also requesting to build 15' from the back 'road'. This is farther
away from the road then our existing garage. No easement is shown for
this road and apparently the road was put in several years ago (50+) by
adjacent landowners without consent to form a turn-around loop with San
Dee Cove Lane. No structures open up on to this road, it just runs behind
garages.

We oppose this variance due to several issues : Is this truly a shed or a second living quarters? Water and sewer in a
shed? A two story shed and a garage for a less than 700 square foot cabin?
How about the tax issues? How will this be taxed?
Is Ottertail County going to address /fix the issue of a lack of survey when these garages were built and purchased
without a survey ?
Will we just keep issuing variances?
Has anyone looked at this property? If so, correct all the above issues and stop putting a bandaid on all the violations.
How will anyone sell or get a new mortgage?
We feel these issues should be addressed and resolved /answered plus also parking needs to be addressed as the road
behind the property is our only access. It is very wooded along the road and parking will be an issue. Allan and Carol

We received notification of the building variance requested by Warren and Deborah Tunwall, for
26579 San Dee Cove Lane, Verges MN 56587.
We are the neighbors directly to the west of the Tunwall property. Our back lot currently has the
existing Tunwall garage extending onto our property. We are very glad to see they plan to remove
this non-compliant structure, from our land.
Like the Tunwalls, WE ALSO have future plans to build a two story garage on our back lot. We do not
want a decision to be made regarding this Tunwall variance request, based on our CURRENT
existing small garage. This is very concerning to us. In no way do we want our future building plans to
be negatively impacted, limited, or compromised, by a neighbor who has a structure that overlaps our
property, or does not follow the required setback requirements.
Therefore, we do NOT approve of the variance requested.
