hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and the
applicant does have the option to plat their property through the planning commission process.

Eckley Estate - Variance application approved as requested with a condition. (6:35 p.ni.)
Eckley Estate, Lot 7 Eureka Beach, Jewett Lake in Elizabeth Township, requested the following: To add a
10’ by 10’ open-sided and open roofed pergola directly in front of existing cabin, lakeside. The requested
pergola would be 50’ from ordinary high water level. It will provide no visual distractions or occlusions for
neighboring properties; we request this as reasonable use of this property. The applicant was represented by
Roger Lemmer, Son-In-Law of the late Allen and Irene Eckley. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a
motion, second by Ward Uggerud and unanimously carried to approve a variance of 25’ from the required
ordinary high water level setback of 75’ for the addition of a 10’ by 10’ open-sided and open roofed pergola
directly in front of the existing cabin (approximately 50’ from the ordinary high water level) as depicted on
the drawing submitted with the variance application with the condition that the sidewalk marked on the
drawing for removal must be removed by May 1, 2015. It was noted that the applicant’s development is out
of the shore impact zone. The variance as approved does not directly or indirectly grant any other variances
for the proposed development.
Greg and Vicki Bauman - Variance application approved as requested. (7:00 p.m.)
Greg and Vicki Bauman, part of Government Lot 2, Section 31 of Edna Township by Pickeral Lake,
requested the following: Proposing a variance for substandard lot size and structure setback. All existing
structures will be removed; dwelling and detached garage will be 43’ from ordinary high water level.
Appearing with the applicant was his daughter and son-in-law. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a
motion, second by Thomas Lee and unanimously carried, to approve a variance of 157’ from the required
ordinary high water level setback of 200’ for the placement of a dwelling and a detached garage 43’ from
the ordinary high water level, 30’ from the top of the bluff and 20’ from the road right-of-way. It was
recommended that before the applicants proceed with their proposed development they should have the
Land and Resource Department determine the bluff setback. It was noted that the development as proposed
will be an improvement to the property. The variance as approved does not directly or indirectly grant any
other variances for the proposed development.
David and Shayla Durick-Tabled Per Applicants’ Request. (7:09 p.m.)
David and Shayla Durick, part of Government Lot 9, Section 2 of Edna Township by Little McDonald Lake,
requested the following: The road we want to butt up against is outside the easement and is on our property.
The 20’ setback has been pushed south. Because of that we are requesting a 20’ variance from road right-
of-way setback. The audience was not polled as the applicants were not able to attend the public hearing.
Prior to the meeting Mr. Durick submitted an email request to have the public hearing tabled until the
October 8, 2015 meeting of the Board of Adjustment.

to use certificate of survey (not plat). Create 3 lots, 2 would be attached and 1 stand alone. Lot 1A to be
permanently attached to Parcel 37-000-99-0787-000 for nonresidential use.

for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion,
second by Loren Bailey and carried with Jodi Sazama abstaining and with Ward Uggerud voting no, to deny the
variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the
granting of the variance as requested and the applicant does have the option to plat their property through the
planning commission process.
Mark Bloomquist - Variance application approved as modified. (7:29 p.m.)
Mark Bloomquist, Lot 5 Johnson’s Maple Point, East Spirit Lake in Dora Township, requested the following:
We would like to add a 12’ by 20’ addition onto our building starting at NW comer west 12’ and south 20’.
Our second choice would be to go 12’ out the back (south side) with a 6’ jog in the SW comer. Both meet lot
line setback, but both are closer to lake. We are open to any suggestions also (North or East). Addition to be no
more than 59-60’ from lake. The audience was polled with no one speaking for or against the variance as
requested. An email from Norman Buktenica in support of the variance as requested was read for the record.
After discussion and consideration, Thomas Lee made a motion, second by Ward Uggemd and unanimously
carried, to approve a variance from the required ordinary high water level setback of 100’ for a 240 square foot
addition to the existing dwelling with the placement of the addition to be determined by the architect/contractor.
The variance as approved does not directly or indirectly grant any other variances for the proposed
development. Hardship/practical difficulty is the unique shape of the applicant’s lot (water on two sides). It
was noted the proposed development will not obstmct the view from the adjacent properties.
David and Bonnie Stabnow - Variance application approved as requested. (7:37 p.m.)
David and Bonnie Stabnow, Lot 3 Block 1 Stabnow Addition to Clitherall Lake and part of Government Lot 6,
Section 1 of Clitherall Township by Clitherall Lake, requested the following: Retain the riparian portion of Lot
3 and permanently attach the non-riparian portion of Lot 3 to Parcel 10000010004012. This will create two
residential buildable lots. The parcels will meet the minimum lot size and lot width requirements of the
Shoreland Management Ordinance for platted lots within the shoreland area of a recreational development lake.
August 13*'’, 2015 Meeting - The audience was not polled as this public hearing was not held due to the
absence of the applicants. After consideration and discussion, Steve Schierer made a motion, second by
Thomas Lee and unanimously carried, to deny the variance as requested due to the failure of the applicants to
appear at the public hearing unless the applicants submitted a letter/email granting the Board of Adjustment
permission to table the public hearing until the September 10, 2015 meeting. September 10***, 2015 Meeting -
Jeff Stabnow represented the applicants at the public hearing. After discussion and consideration, Steve
Schierer made a motion, second by Ward Uggerud and carried with Loren Bailey abstaining, to approve the
variance as requested in the application dated July 22, 2015 and as depicted on the drawing submitted with the
variance application.
