3.) the statements made in the variance application concerning the removal and/or conversion of various structures
must be completed as stated in the application. It was noted that the variance as approved will provide a reasonable

Patricia M Pettit and Paul Rukavina, Eagan, MN, requested the following: “Unable to meet 20 feet setback
from the road right-of-way, request variance of this requirement. If this is unfavorable, request variance to
build structure 90 feet from the shoreline. Request variance to convert existing structure into storage
space.” From the applicants’ drawing it appears that the proposed 28’ by 46’ structure would be 12’ from
the road right-of-way and 100’ from the ordinary high water level and the existing 12’ by 32’ structure is 12’
from the ordinary high water level and 12’ from the side lot line. The property is described as Lot 1,
Hackberry Point Beach, Dead Lake in Dead Lake Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Paul Larson, second by
Cecil Femling and unanimously carried, to approve construction of the proposed 28’ by 46’ structure at the
string line/building line with the condition that the existing 12’ by 32’ structure located 12’ from the lake
must be removed before a site permit can be issued for the new construction and with the condition that
the new construction must meet all other setback requirements of the shoreland management ordinance.

Gary and Lola Keller, Pelican Rapids, MN, requested the following: We would like to change our resort
from a cluster development into two residential lots. The existing home would be lot one with 100’ of
frontage. The second lot would be a buildable lot with approximately 75’ of frontage. Both lots would share
the existing septic system. We will be getting rid of Cabins 3, 4, 5, 6 and 7. We will be turning cabin 1, 2
into a storage building, We will take out toilets, fixtures etc. Most of the lots along this beach have
frontages of between 65 and 75’ and so we would just like to be able to have the same living opportunities
as our neighbors. We can split Lot 1, Block 8, if needed, to give both lots enough square footage. The
property is described as Lot 1, Block 1 and Lot 1, Block 8, Crystal Lida Beaches and the West 50’ of
Government Lot 3, Section 14 of Lida Township by Lake Lida. The applicants presented a letter, in support
of their request, signed by 22 individuals. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by Cecil Femling, second by Paul Larson and unanimously
carried, to approve the variance as requested for the conversion of an existing resort into two buildable
residential lots with the following conditions: 1.) each parcel must have at least 20,000 square feet of area,

registered survey. The 245’ by 198’ parcel would be conveyed to Stewart Hofland for the purpose of
constructing a road to a home he is building on Mud Lake. The property is described as the West 40 rods
of the North 12 rods of the Northwest Quarter of the Northeast Quarter, Section 4 of Perham Township.
Stewart Hofland and Marlin Zitow represented the applicant at the public hearing. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Steve Schierer,
second by Joe Maske and unanimously carried, to approve a variance to subdivide, by metes and bounds
description, a 245’ by 198’ parcel from an existing 3 acre parcel with the condition that a registered
surveyor’s drawing must be provided at the time of recording.

Dear Mr. and Ms. Keller,
This letter is a follow up to my 1/27/03 phone conversation with Mr. Keller.
I met Mr. Keller onsite on 1/24/03 to inspect the conversion of Cabin/Units #1 and 2 as per
the 6/13/02 Variance Approval. I observed that all sinks, toilets, shower stalls and fixtures
(i.e. faucets and showerheads) had been removed. However the plumbing (i.e. water pipes
and drains etc.)Temained. After discussing this issue with Bill Kalar (Land and Resource
Administrator) it appears you have complied with the conversion of the structure as stated in
your application.
In addition, on 11/21/02 I verified the removal of all structures as noted in your application.

RE: Gary Keller, Lakeview on Lida Resort Conversion and
property division.
Pat,
I spoke to Gary Keller by phone regarding your on-site
inspection results of 11/21/02. His response to your concerns
is as follows:
> The deck that is still in place: hadn’t planned on removing
that, figured it could remain as part of that lot.
> The exposed soil areas: will get those stabilized to prevent
erosion.
> The “cabin conversion”: All water lines and sewer and
plumbing lines/connections have been removed. All the
underground hookups were removed when the other cabins
were torn down. There is no water or sewer hooked to
“cabin 1 Ss 2”. The only fixtures remaining are the kitchen
sinks, all other plumbing fixtures are gone (except shower
stalls). Toilets, bathroom sinks, etc. have all been pulled
out. I haven’t talked to Bill about this, figured you could
address it with him since you have been on site. But if there
is not plumbing of any kind hooked to those sinks, could
that be considered as not useable for dwelling purposes?
Please call him on Monday to discuss whether or not this
would constitute “conversion”. He needs to know where he
stands before he can “record” the final survey/split of this
property.

County Shoreland Management Ordinance and/or the Subdivision Controls Ordinance. The Otter Tail County Board of
Adjustment will assemble for this hearing on
Thursday, June 13, 2002, at 6:30 p.m..
in the Commissioners’ Room of the Otter Tail County Courthouse, Fergus Falls, MN. (Please use the west Law
Enforcement entrance.) Individuals; requiring special accommodations should contact the County Auditpr’s
office prior to the date of the public hearing.

The variance requested is:
the following: We would like to change our resort from a cluster development into two residential lots. The
existing home would be lot one with 100’ of frontage. The second lot would be a buildable lot with
approximately 75’ of frontage. Both lots would share the existing septic system. We will be getting rid of
Cabins 3, 4, 5, 6 and 7. We will be turning cabin 1,2 into a storage building. We will take out toilets,
fixtures etc. Most of the lots aibng this beach have frontages of between 65 and 75’ and so we would just
like to be able to have the safne living opportunities as our neighbors. We can split Lot 1 Block 8, if
needed, to give both lots enough square footage.
