SUBJECT: Fire Number L4222
The following are the reasons for my request for variances with the fish house and
storage sheds on my property.
The property was purchased on April 29, 1988 and the first shed (fish house) was
built 2 feet from lot line and 21 feet from OHWL on August 5, 1988, this shed is
8x10. The second shed was built on August 2, 1992 and is 2 ft. from lot line and
61 feet from OHWL. Both of these sheds have been there for over five years and
both of them have underground wiring for lights that I put in. As you can see by
the pictures, if I move those two sheds inside the lot line, it will prevent me from
taking out 160 feet of roll-in-dock and also my canopy since there is rip rap 10
feet further east. I have over $7,000 invested in dock and boat lifts and would be
unable to use them if the sheds were moved. In addition, I assumed that they were
both okay since a good amount of time has elapsed. The third shed was built this
year by the same carpenter who built the other one and I thought everything was in
compliance but it was my fault for not checking. That third shed is 10 x 12 and I
realize that it is not in compliance with regulations, so I am asking to move it
across the lot where it would be closer to compliance. My problem is that there is
a tree on the other side, as per the picture and I would like to keep this shed to the
shoreline side rather than move it to the other side of the tree and block my
neighbors view. Neighbors on both sides would prefer that my request for these
variances be okayed rather than moving them to some other position.

RE: March 26, 1998, Board of Adjustment Meeting.
Dear Mr. Atkins,
Enclosed please find the following:
1. A revised copy of the minutes of the Thursday, March 26, 1998, Board of Adjustment
Meeting, and
2. A copy of the tape from the above referenced meeting.
In reviewing your file I did find a copy of the revised request that had been forward to Pat Eckert
and which he did present for my review. Upon my review a decision was made that a new
application for variance was not required since your variance requests were of the same type
and basically you were requesting fewer and smaller variances from what was contained within
the original application for variance.
The minutes of the Board of Adjustment meeting typically reflect what has been requested in
the official application for variance, the names of individuals from the audience who speak, a
brief legal description of the property and the action taken by the Board of Adjustment.
Generally, the minutes have not reflected all of the conversation and discussion leading up to
the Board of Adjustment’s action nor have revised or modified request been reflected in the
minutes unless they become a part of the Board of Adjustment’s motion or unless the Board of
Adjustment’s motion depends upon the revision or modification that has been presented.
I understand from our conservation that your were greatly disappointed with the minutes of the
March 26, 1998 meeting and generally with the Board of Adjustment. I have very little control
over actions of the membership of the Board of Adjustment, but I do prepare the minutes for
each meeting. Therefore I have revised my minutes as they related to your particular public
hearing. The minutes now include your original request, your revised requested as stated in
your letter of March 24, 1998, your drawing as an attachment to the minutes, my summary of
your revised request, summarized highlights of the discussion (not intended to be a transcript of
the meeting) and the Board of Adjustment’s action.
I hope you find this revision acceptable and I hope the revision contains sufficient information to
address your concerns. If you should have any questions or additional concerns after reviewing
this information please feel free to contact. I sincerely apologize for any problems my
previously prepared minutes may have created between you and your neighbors.
