The variance we are requesting would be the string line from the lakeside corner of the Morris home to the lakeside corner of the wooden structure of the Hovden home. We believe this is an appropriate request, since that part of the Hovden home is a permanent wooden structure, is insulated and heated, and serves as a living room, dining room and a T.V. room. Darrel Forsgren, Pelican Rapids, MN, requested a variance to split a parcel of less than 5 acres from an existing 78.37 acre tract for the purpose of permanently attaching the parcel to Lot 14, Outlet Beach. '*■" January 6, 1987 ^2) Mr. Darrel Forsgren Rural Route 3, Box 53 Pelican Rapids, MN 56572 Dear Mr. Forsgren: LIMITED PERMIT NO. 86-1004, CHANNEL CLEANOUT BETWEEN LAKE LIZZIE AND LAKE LIDA, OTTER TAIL COUNTY Enclosed is Limited Permit 86-1004 which authorizes the removal of sediment within two specific areas in the subject stream. Please read the permit carefully since it does not include all of the work that you had applied for. The limitations put on a 7 ft. width, a low grade elevation of 1313.0 ft., and two excavation areas all result from high water concerns in downstream areas as expressed by county officials, D.N.R. field personnel, and local residents alike. MN. Rules Chapt. 6115.0200 Subpart. 5.D requires that "the excavation must be limited to the minimum dimensions necessary for achieving the desired purpose." Site surveying performed by the Area Hydrologist and his assistant shows that the authorized work does represent the "minimum dimensions necessary" to improve outflow from Lake Lizzie while at the same time minimizing the impact upon downstream riparian prperty owners. Pursuant to Minnesota Statutes, Section 105.44, Subd. 3 and 6, the applicant, the managers of the watershed district, the board of super visors of the soil and water conservation district or the mayor of the city may demand a hearing on the Order provided the demand for hearing and the bond required by Subd. 6 be filed with the Commissioner within 30 days. No bond or security is required of a public authority which demands a hearing. The statutes further provide that if no demand for hearing be made or if a hearing is demanded but no bond is filed as required by Subd. 6, the Order shall become final at the expiration of 30 days after mailed notice thereof and no appeal of the Order may be taken to the Minnesota State Court of Appeals.
