X ’C.Application dated 7 Signature Of Applicant 19^£j:J.Date of hearing:Time:M MOTION AS FOLLOWS: Motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance of 14 from the required 18' maximum height of a non-dwelling structure for the construction of an 80’ by 96’ structure having a height no greater than 32’. It was noted that the staicture will be approximately 275 to 300’ from the ordinary high water level and it was also noted that the run off from this location is away from the lake towards the road. BK 0795-001 277.206 • Victor LundBcn Co., Primeri • Fergus Fal.ls. Minnesota August 1,1996 3 Ray A. Chase - Approved Ray A. Chase, Tavernier, FL, requested a variance to allow five substandard contiguous lots to remain as individual buildable lots. The applicant’s lots do not contain the minimum lot area as required by the Shoreland Management Ordinance. The property is described as Lots 4, 5, 9, 10, and 11, Oxcart Trail, Unnamed River in OtterTail Township. The audience was polled with Jerry Baldwin, Don Nelson and a third individual whose name was not stated speaking against the variance request. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to allow Lots 4, 5 and 9, Oxcart Trail, to remain as separate buildable lots and Lots 10 and 11, Oxcart Trail must be joined as a single lot. It should be noted that the additional width of these lots was considered as an adequate offset to the amount of area that these lots were lacking (approximately 1,600 to 4,300 square feet). It was also noted that Lots 10 and 11, Oxcart Trail, should remain combined because of the significance amount of low ground identified on the plat. Greg Erickson - Approved Greg Erickson, Pelican Rapids, MN, requested a variance of approximately 12’ from the required 18’ maximum height of a non-dwelling for the constmction of an 80’ by 96’ structure having a height of approximately 30’. The property is described as part of Government Lot 2 and Government Lots 5 and 6, Section 6 of Lida Township by Rush Lizzie Lake. It was noted that the structure will be approximately 275 to 300’ from the ordinary high water level and it was also noted that the run off from this location is away from the lake towards the road. The applicant indicated that his farm operation is serviced by a lagoon. Hardship being an agricultural use located within the shoreland area. The granting of this variance is consistent with prior actions of the Board of Adjustment. Ronald Francis Schallenkamp - Tabled Ronald Francis Schallenkamp, Sioux Falls, SD, requested permission to purchase approximately 8’ from the owner of Lot 3, Martee Beach and a variance of 7’ from the required side lot line setback of 10’ for the construction of a 12’ by 18’ porch 3’ from the side lot line. It should be noted that the porch will be 3’ from the side lot line after the addition of the adjacent 8’. The property is described as Lot 4, Martee Beach, Blanche Lake in Everts Township. The audience was not polled. The applicant did not appear at the public hearing. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to table the applicant’s request until the September 5, 1996, Board of Adjustment meeting. Richard and Lorna Treptow - Approved Richard and Lorna Treptow, Plymouth, MN, requested a variance of 6’ from the required ordinary high water level setback of 100’ for the construction of a 22’ by 24’ addition to an existing cabin 94’ from the ordinary high water level and a variance of approximately 18’ from the required ordinary high water level setback of 100’ for the construction of a deck, to the addition and to the existing cabin, having a depth of 12’ and being approximately 82’ from the ordinary high water level. The property is described as Lot 5, Walvatne Addition, Blanche Lake in Everts Township. The audience was polled with no one speaking for or against the request.
